TAXES TO THE AMOUNT OF $100000,000 and that at the present time the annual charge for the priv ilege of engaging i" this great beneficent enterprise amounts to $9,000,00. Pueh a tax would be onerous and oppressive if these institutions tere merely money making enterprises, but as a distin nfehed senator from Massachusetts, Charles Sumner, once pointed out upon the floor of eoagress, INSURANCE IS NOT "A MONEY MAKING BUT A MONEY SAVINO BUfcIINr.8," ana mese enormous iioeme taxes are, therefore, direct taxes upon tnrm. THE EVIL IS RECOGNIZED, AND THE REAL QUESTION IS. TO WHAT EXTENT. IF ANY, CAN THE FEDERAL GOVERNMENT SUB STITUTE ITS REGULATION FOR THAT OF THE SEVERAL STATES T Primarily and chiefly the question is one of constitutional power. No clause of the constitution has had such a continuous evolution as the commerce clause of the constitution. This was inevitable. The facflitv for intercommunication between the states created CONDI TIONS OF WHICH THE FATHERS OF THE REPUBLIC NEVER DREAMED and has caused a corresponding expansion of the commercial poweV of the federal government to adapt it to the needs of the American people. MR. Thus it has been held that the mere transmission of a message over telegraph wires is commerce and that the passage of a citizen over an interstate bridge is commerce equally with the shipment of wheat or cotton to Liverpool. The question at once suggests itself that if the mere transmission of a telegraph message from state to state is interstate commerce why the vast system of intercommunication between the citizens of the various states to which any one great insurance company gives rise should not EQUALLY be such commercial intercourse. It must be admitted that the supreme court, in decisions from Paul and Virginia, decided in 1868, to Nutting versus the common wealth, decided in 1901. has persistently held that such form of com mercial intercourse IS NOT INTERSTATE COMMERCE within the meaning of the constitution and that it is therefore subject to the arbitrary and despotic power of every state. The force of these cases it is idle to gainsay. IF THE COURT, HAVING DUE REGARD TO THE ENORMOUS GROWTH OF INSURANCE AND THE FACT THAT IT UNQUESTION ABLY IS A MOST IMPORTANT PART OF THE COMMERCIAL INTER COURSE OF THE AMERICAN PEOPLE, 8HALL SEE FIT HERE AFTER TO MODIFY OR ABROGATE THE DOCTRINE OP THE INSUR ANCE CA8ES SUCH ACTION WILL NOT BE WITHOUT PRECEDENT, FOR THIS GREATEST TRIBUNAL IN THE WORLD HAS NEVER HE8ITATED TO ADMIT ITS OCCASIONAL ERRORS OF JUDGMENT IN SUBSEQUENT DECISIONS.
