This was a suit to foreclose a bjcJ for
aded, the defendant misting the fore
closure, alleging that the plUctiiTs
agent dad been guilty of fraud in describ
ing tbe boundaries of the land, when the
sale was made. The trial in the lower
court resulted iu a foreclosure cf the
bond, and the defendant appealed. It
was proven that the defendant had en
tered into possession of, and reUined the
land for three years, af;er he kcew that
the alleged fraud would uot be remedied
and waited until this suit was brought
before seeking a recession of the contract.
The court holds that such conduct evi
denced his election to abide by the terms
cf the contract, and it is now to-j late to
invoke the relief sough;, and the decree
is, therefore affirmed.

ery claim, under the local laws of the
mining district in which tuey were situ
ated. Later in 1S72, the claims passed
into the hands of plaintiiT by p'ir-hae,
since which time he has benn in p"8ft-r-eion
and has performed the rrtin!rd la
bor. In ISihi tU defendants, claiming
tbe ground as unoccupied mineral land,
entered upon and located the same in
pursuance of laws of congress, beginning
work, when plaintiff brought -this suit
which resulted in his favor. Tbe appel
late court holds that a possession of a
mining claim in a raining district is pre
sumed to bu the oaner thereof until the
contrary is showu, and as the adver-e
claim was not proven, the court atlirmed
the lower court.
