This was a suit to foreclose a bjcJ for aded, the defendant misting the fore closure, alleging that the plUctiiTs agent dad been guilty of fraud in describ ing tbe boundaries of the land, when the sale was made. The trial in the lower court resulted iu a foreclosure cf the bond, and the defendant appealed. It was proven that the defendant had en tered into possession of, and reUined the land for three years, af;er he kcew that the alleged fraud would uot be remedied and waited until this suit was brought before seeking a recession of the contract.
