Cynthia. Ky . Aug 14.—The jury in
the Jett-White case at 9 thia morn­
ing brought in the following verdict;
"We find the defendant*, Curtis
Jett and Tom White, guilty, and fix
their punishment at confinement in
the penitentiary for Iff-.- “
The verdict was arr.ved at after an
all night * session At 8; 30 this morn­
ing Judge Osborn asked if they had
arrived at a verdict, but received no
answer He went back, and half an
hour later the court was surprised by
the announcement of an agreemenL

The crime for which Jett and
White have been convicted was the
murder of an attorney named Mar­
cum who was using hi* influence and
professional skill to effect a recount
of tne vote cast in Breathitt county
last fall. On the face of the returns
the faction to which Curtis Jett and
Tom White belonged, was success­
ful.
Ijut spring, while in the court­
house on business connected with the
contest. Marcum was shot down in
cold blood by an assassin who came
up behind him. The preponderance
of testimony showed that Jett did the
shooting and that White was an ac­
cessor.
The verdict is a grest surprise to

Seattle. Aug 14.—A jet of boiling
water struck William Tracy blind
Saturday morning. Tracy is a loco­
motive engireer on the Northern Pa­
cific. The accident happened in his
cab a* he was taking the engine to
the roundhouse.

general hospital by tbe city ambu­
lance. h.s Injuries were dressed. He
is scalded aliout the face and will
lose the sight of one and perhaps
both eyes.

Walla penitentiary as the result of
the supreme court’s decision In the
anti-gambl ng case. Under the new
law tbe sentence of felons begins to
run from the time they reach th* pen­
itentiary. The old scheme of using
up a year or two In the county jail
pending an appeal, does not work any
more The new law went into effect
the same day tbe gambling law did.
Convicted felons are allowed two
months for good behavior during the
first
year of their incarceration.
Dietrich got a year's sentence, and
if be l-ehaves himself he will be out
at the end of 10 months.
It is stated on good authority that
Dietrich gets $6 a day. while in dur­
ance from the gamblers who put up
the money to fight the law. This $6
a day will be turned over to him on
his release from the penitentiary. It
will date from Jure 14 last, when he

from criminal assault by a big trump
Thursday evening. The little girl
was in the section house yard, near
home, when a tramp slouched up to
the fence and asked in a surly voice
for a drink of water. The girl told
him to help himself After drinking
he grabbed her in his arms and start­
ed to carry her towards the railroad
track.
Not realizing the exteut oi her dan­
ger. but knowing she must get free in

and mauaged to wriggle from the
