A decision was rendered at San
Jose, Dec 2d, by Judgo Pavn e,
in the County Court, which is of
particular interest, in showing
the rights of Juntiees ofthe Peace
and arresting officers. The caso
in brief, was as follows: A war
rant for tho arrest of John Doe
had been placed in the hauds of
Peputy Constable Q. "W. Parker
was toTcTthat tho persoi to he
'osted was tho "boss" of a Gui
se wash-house. He entered the
ash-house, and while waiting
for tho "boss" to accompany him
to the City Hall, one of the as
sistants questioned tho Constable's
right to make the arrest, and ap
plied to him epithets of a very
objectional nature. Parker nd,
vancedand menacingly told-him to
shut up, and the Chinaman took
him by the collar. Tho others
took a hand and were making
it lively, when officers arrivod
and put an end to the fecufflo by
arresting the Celestials. The
Grand Jury indicted the batch for
assaulting an officer. At the cloe
ofthe evidence for the prosecu
tion, Hendt & Terry, counsel for
tho prisoners, asked the Court to
instruct tho jury to acquit. After
argument the caso was taken under
advisement, and the jury excused
for three dnj'S. On the re-opening
of tho Court the Jugde charged
the jury in substance, that a wart
raut to bo legal, must name or do
scribe tho person to be arrested,
and that the officer musi know
from tho tone of the warrant,
without any other information,

Tho warrant in this caso, he
'-claimed was therefore illegal,
and the defendant had an undeni
able right to resist an attempt to
make an arrest und er it. He
said considering that "John Doe"
meant the same person, it was
officially his dutv to arrest that
individual or return tho warrant
indorsed "not found." The offi
cers referred to did not do this
and attempted to arrest a person
who was not described in the war
rant, whom ho believed was the
person he was expected to arrest
from information received from a
third person, and not from any
thing indicated in his proces?.
He was therofore committing h
trespass, and not disbarring his
duty, and tho defendant in resist
ing him, cannot be hold criminally
responsible. He then ordered
the jury to find a verdict'of acquit
tal, which they accordingly did.
This is the first time tho question
of arrests made under "John
Doe" warrants was ever raised
in tho State.
A telegram from the East wa3
received a few days ago, at Port
land, by J. C. Ainsworth, on of
tho directors ofthe North Pacific
R. R. Co., announcing that work
on this great enterprise will start
again this year, aud never stop
until it is completed. Eids have
been accopted for tbe construc
tion of one hundred miles west of
the Missouri river, to he complet
ed by the 1st of uext November.
The contract for the remaining
one hundred and five miles to the
Yellowstone is deferred for the
revision of surveys. The building
of this road will no doubt cause a
speedy completion of the Califor
ma and Oregon road, and probaYakima country did not start
bly the 6hort cut from Eugene
City to WinuemuLca, to complete
for the Oregon aud Northoru
travel eastward.
The Post Office Department at
"Washington has ordered that
gold and silver coin may be trans
mitted through tho mails, in
packages not exceeding our
pouuds, at the rate of a ceu per
ounce, with an additional charge
of ten cents on each package
for registr3'. Under this regula
tion, 1,000, in gold coin may be
sent to any point in the East for
64 cents.

The report of the committee
appointed by the Legislature to
inrestigHiO the management of
State affairs daring the Jet tight
year, is very (Jctere in its
condemnation of Gov, Grover. It
lays on him a large part of the ,
blame for the loose, extravagant
aud corrupt administration. The
report is particularly severe in
i elation to the conduct of the
State Board of School Examiners
and School Fund Commissioners,
of which Grover was tho head.
Affidavits allege that this mag
nificeut educational fund baa
been squandered by the Board
with a criminal disregard of pub
lic interests, until it is not worth
fifty ccnty on the dollar, and the
committee sayjhat the righteous
indigWifrGn of an outraged people
against these dishonest officials,
who have so flagrantly betrayed
their trust, should be a warning
to all others. Itisihown by the
committee that Grover himself
tcok large sums from the fund on
very triflingand inadequate securi
ty, and used the money for his
purposes. Also, that he loaned
large sums of the fund to others
in such ways that the money
cime back to his own pecket,
making, for other moneys
in tho name of the State,
almost worthless security, in con
sequence of which there is great
lobs to tho-tund. In one instance
a loan was made amounting, with
interest, to ?33,700, on property
hardly worth 33000. Tho ob
ject ofthe loan was to enable the
borrowor to pa' a note of 30,000
which Grover had against him.
In another case, the committee
roport the Ios3 of 60,000, through
a loan mado in Grover' interest.
Tho committee find further that
in 1875 Grover organized a cor
poration known as the We"t Port-
lana Homestead Association, in

testified that he took four shares
from Grover which he paid noth.

sible for anything he gave. He
gave Grover his proxy and took
no further interost in the matter.
The only busiuess transacted by
this corporation, after the election
of its officers, was to accept this
conveyance from Grover and to
barrow 10,000 from the educa
cational Fond, secured bv mort
gages on this land conveyed to it
by Grover. The sum was more
than double what could have
been obtained from any private
individual. Grover, it will be rpr
inombcred, by virtue of his office
as Governor, had the loaning and
management of the educational
Fund. The committee say that
to the sin of obtaining money dis
honestly is added that of violation
of an oath-bouud trust that of
guarding the fund sacred in the
ej-es of every friend of his country
and his kind. Tho committee
add that many ofthe transactions
of the Board were concealed from
the public, they fulling to report
the same to the Legislature, and
that even such statements as were
made wete false, showing that
the intention to mislead tho poo
pie of the State in regard to
the condition of affairs. Many
of the losses are of a character
which cannot be well estimated
and the probability is that they
will never be ascertained.
