Ed. Goaiiti. In the case of the Stato of
Oregon vs Ellis Eastwood a motion was filed
to set asido the indictment against him on
the ground that two of the names of the
grand jurors presenting said indictment, to
wit: Jasper Wilkiua audC.M. Hrattain, were
not taken from the last proceeding assessment
roll for Lane county in accordance with the
provisions of Sec. 021, Title 2, Chapter 12,
Civil codo. Upon my attention being called
to the matter I And that the name of Jasper
Wilkins appear in conjunction with his
father's and brother's, and that the name of
C. M. Krattain as returned by the Sheriff
should have been C. E. Rratlain. This mo
tion was not based on the ground that those
gentlemen were uot taxpayers, for it is well
known that both are leading farmers and are
possessed of considerable property on which
they pay taxes, but as alsjve stated, the
ground of its motion was that their name
did not appear on the roll ai required by said
section. I make this staU-ment that nil may
know that there was no intention to cast any
reflection on either of these gentlemen and
to correct any erroneous impression that may
