(Communicated ) "To err is human," and whether through inadvertency, ignorance, or bias of mind, the said human product is ever with us, work ing evil, in matters where truth only should have recognition, frequently seeking and ob taining a hearing through some local publi cation for the sole purpose of moulding pub lic sentiment in its favor. Misrepresen tations and untruthful statements are thus often printed over an assumed or anonymous signature like "A Laboring Man" under a communication of such purport, in your paper Jot Nov. 3rd on first page. Said pro duction is a very feeble effort at apology for the assignment, an unwarranted and cow ardly thrust at imaginary enemies, a spon taneous output of the diseased imagination of a servant, who merits more sympathy than censure, and seeks to shield his identity under the signature "A Laboring Man." An apology is due to the reading publicfor infringement on their time to read matters that can only be of interest to the creditors, but I most gratefully ask your kind indulg ence while I briefly refer to the article mentioned. Referring to first sentence of the article by "A Laboring Man" I will say that the mill is not "closed," but on the contrary the as signee will saw, plane and sell lumber just as before the assignment, and a debtor being required to pav claims that are overdue, does not "add dark page to history Sentence No. 2: The yards were not de stroyed by fire, nor was the lumber on thi vard destroyed. On the contrary, the lumber on the west yard was all saved, and some of it used in the construction ot the new mill, while another lot of the same shed lumber was sold to Mr. Stone and other partie The loss by fire was not so great as generally supposed, for the mill was very old and badly decayed and the saving of the lumber, the boilers and other ma chinery, together with the insurance money made a great help in offsetting the supposed loss. Sentences 5, 6 and 7, no comment neces sary at this time. The next sentence, 9 uabwlu elytoo inthl! advancement" in nothing u, help his business, or anything else, except to increase liabiiitie: In sentence No. 10, "A Laboring Man" suddenly leaves bis subjeet. and starts out on another aaestion. which may lend the read sr to believe that "A Laboring Man'1 belongs to the detective service and had just made the discovery that we have in our city Dersons that retard and destroy." Now if this is true and known to ' 'A Laboring Man" to be a fact as he has stated, it is his duty to reDort those destroying characters to the police authorities, and tile his complaint in the office of the honorable police judge, Should he neglect such important duty, he is equally guilty with the "destroying an gels." The remainder of "A Laboring Man V'arti- cle is a peculiar conglomeration of "literary vomit," which conclusively demonstrates the practical exposition of his consummate ig norance. stuDiditude and servitude. After making a distempered rehash of friends and enemies and enemies and friends, he boldly makes a threatening declaration for another Py, how he "would have dealt with them according to their true character, namely his enemies.' It is remarkable that "A Labor- ing Man" should make such an unnecessary exhibition of his unpardonable mendacity and exaggeration. He says in sentence No. 14, "there was no just cause why," etc. Now inhere was any cause in law, equity or rules of business, it was a just cause and no other. The fact of "A Laboring Man's" ignorance of that cause, together with the biased con dition of mind and personal solicitude for the debtor and imaginary "injury that would be done this city," does not justify him in writ ing opinions without knowledge of facts. He did know, however, that his distempered literary vomit was full of his own original mendacity and very, cunningly, hid his iden- titv hvaio-nino-it" A T.ahorinc Man."The as- signment was the voluntary act of ihe as - signor. It was not "forced upon him by parties that sought to injure, him, thinking they would be benefitted thereby." There are no "endeavors" nor " assertions oi ene- mies" in the case, nor do we think it reason able to suppose that the assignor's enemies would loan to him money without security He has no such obliging enemies, and the position taken by "A Laboring Man," is un reasonable, impossible and ridiculously false. After nearly two years of delay on over-due obligations, and in the forenoon of the day proceeding the attachment, the as signor received by the hand of private con veyance a written ultimatum, which con tained three propositions, either and all of which were easy, simple, just and fair. He was politely invited to report in person on the same day his acceptance or otherwise, as he should decide. Although perfectly friendly relations prevailed, he knew and had been so informed, that this matter must have his personal attention at the date named, For some reason, presumed to be satisfactory at least to himself, he failed to report, ig nored the ultimatum and accepted the con' sequences promised him. In his notice of the assignor's property "A ""K Man" makes very unwarranted declaration when he wrote "his property will show his ability to pay two dollars to the one he owes. Now, the sentence is very bad ety mology, and grammatically conveys only the idea that "he owes" some "one," and that "his property shows bis ability to pay two dollars" on the account.. He certainly did not intend to eonyeythe idea that bis property was worth double the amount of hf biht es and that creditor, would ceive double the , amount of their respective Lt JTSJI: personal acquaintance with most of his cred itors I incline to the opinion that they will ask nothing more than did the Egyptians who had loaned to parties bound for the promise! land. They had betn on Friendly terms Long enough to learn that the early modification would ease their anxiety, and possibly save them a journey into the Red sea. 1 have no knowledge of the idenityof "A Laboring Man," but think it safe to pre sume that he is not of the rank nor tile in the flight from Egypt. Mr. Editor, while hoping to pos.-ess aa acute sense of gratitude and humane spirit of forbearance, still lam not entirely wanting in the vindictive courage necessary to resent an insult, correct an error and expose a bun dle of lies. ' In your valued paper of the 27th ult was an article without signature, in which my name was used in connection with thu assignment, and but for this fact alone I should not have troubled you with this com munication.
