This will be held to apply only to relinquishments which are tiled subsequent to date of said act, viz: May 11th, 1SS0. You are instructed not to accept or act - upon any relinquishment, unless made before you, which has not been du!v subscribed by the claimant on the back of his duplicate receipt, acknowl edged, witnessed and executed in a manner which under tho laws of tho State or Territory in which tho land is situated would bo sullictent as a valid transfer of real estate. In case of the loss of a duplicate receipt, or declarato ry statement, an atlidavit ol audi los must accompany the written lelinqnisli ment. Immediately upon a relinquish ment duly executed as above, being re ceived at your office, vou will proceed as follows : 1. Write the words "canceled by relinquishment" ("tvincr date) opposite tho record of the entry in the tract book, the register of entries and the register of receipts. Draw a line over the number of the en try on the township plat. 4. That when a pre-emption Iiomefetead or timber-culture claimant shall file a written relinquishment of his claim in the local land oflice, the land covered by such claim shall be held a.s ojen to settlement and entry without further action on the jiart of the commissioner of the general land office. Sec. 2. In all cases where any per son has contested, paidthe land oilice fees, procured the . cancellation of any pre-emption, homestsad, or timber-culture -entry, he shall be notified by the register of the land office of the district in which such land is situated of such cancellation, and shall be allowed thirty davs from date of such notice to enter said lands; Provided, That said register! shall e entitled to a tee ot one do.lar for the giving of such notice, to be paid by the contestant, and not to be rejKiited. Sc. 3. That any settler who has settled, or who shall hereafter settle, on any public lands of the United States, whether Kurvt-yd or unsurveyed, with the in'enti.m i.f claiming the same un der the homestead laws, shall be al lowed the same time to tile his home-' stead application and jierfect his origi nal entry- in the United States land office as is now allowed to settlers un- der the pre-emption laws to put their claims on record, and his right shall re late back to the date of settlement, the same a3 if ho settled under the pre-emption laws.
