Baeley has re ceived the opinion from the bu preme Court confirming his de cision in lillamook County awarding Wesley Raney $2,000 for the loss ot a hand while teed ing an ensilage cutter for R. D Tinnerstet. Raney sued the State Industrial Accident Com mission, alleging the accident came under the commission latitude, automatically, as haz ardous employment. Judge Bag ley gave him judgment, and it was appealed, only to be amrm ed. Judge Bagley says that the last legislature passed a law tak ing this phase of industrial lite out of the liability on the part of the commission, and only the construction of buildings hereaf ter will so apply. The accident to Raney was in July. 1916. This leaves the commission im mune unless the farmer accepts the commission, which he still can do if he so desire. Many farmers, where they have severe! employed, are tak ing out the insurance under the terms of the commission, it hx ing the rate, which is very small. Judge Bagley himself has made application for a rate, and will operate his farm under the pro visions of the law. lhe law now reads that counties can have their employes on roads and bridges, and school districts, building school houses, can take out insurance under the commis sion.
