Vaughn alleges that he came here with Frank Smith, from .Seattle, and that he bought the Anderson place or $900; that shortly after the pur fchase Mrs. Guishwiller and Frank Smith, arguing that Vaughn's wife, with whom he had not lived for fifteen years, had someone look ing up the records to get hold of the property, and, therefore, he had better deed the property to the woman as a matter of protection Vaughn alleges that he did this, and also gave her $300 for like safe keening. He sets up that he did this in good faith and that he was to have the property back when.de manded. F. F. Randolph, of Seat tie, and S. B. Huston of this city are Vaughn's attorneys. Mrs Guishwiller, when demand was made for the property, de- clined, and her defense is that the money paid for the property was hers, and that the reason the place was deeded to Vaughn at the time of the sale, was because she owed few bills and did not want the title until she was clear of these debts The original deed was made atighn, Mrs. UuiBliwiller paying over the money in the presence of witnesses, boon thereafter Vaughn deeded the place to the defendant. She says she never got any money from Vaughn, except a malter of a few dollars which she paid over to him when the deed passed to her from Vaughn. H. T.
