SAN FRAXCISCO, Dec. 18 Edmond
Murphy, pugilist and alleged criminal
gangster, went upon the stand today
as a witness In his own behalf in
his trial on a charge of feloniously
attacking Jessie Montgomery of
Reno, Nev, here early Thanksgiving
day. ,
His mother, Mrs. A. Murphy, also
a witness, made a plea to the Jury
to acquit him.
The alleged attack by Murphy on
Miss Montgomery and her companion,
Jean Stanley, formerly of Portland,
Or., was made in a house known as
the headquarters of a gang, tour
other members of the gang are
awaiting trial on charges preferred
by the two girls. The attack on the
girls led to the killing of three peace
officers at Santa Rosa recently, and
the lynching of their accused slayers.

Murphy was withdrawn from the
Stand after a few preliminary ques
tions to make room for other wit
nesses. He had admitted accompany-

Murphy was called to the stand
after his mother had made a dramatic
appeal to the jury. In a voice shaken
with emotion she pleaded for acquit
tal and after she had
prosecution attorneys said they did
not have the heart to stop her. al
though her statement was -purely
inadmissable."
Mrs. Murphy said that when the de
fendant was a sign painter, before he
took up boxing, he always turned
over his weekly pay to her and that
more recently he had always given
her money after he had taken part in
boxing bouts. When she was ill not
long ago her son, she said, paid her
hospital expenses and tenderly cared
for her.
Was Training for Fight.
Murphy was on the stand only a
few minutes, gtving way to other wit
nesses. He said that he was a prize
fighter by profession and before the
Howard-street affair had begun
training for a bout which was to have
been held on December 17. His testi
mony is to be resumed Monday.
A neighbor of the Murphys, testi
fied that at 1:25 o'clock Thanksgiving
morning she heard some one call out:
"Good night. Spud." Murphy, she
aid. replied, and entered his house.
The prosecution closed after two
physicians testified to the condition
of Miss Montgomery after she had
been attacked.

A reasonable guess is that Mr.
Harding will discourage any unnec
essary splendor and veto any ex
travagance so far as it is in his power
to do so.

membership sufficiently to retain to
every state at least its present rep
