A motion to strike from the Circuit Court records an information against 'Rabe" Walton, the notorious young highwayman now awaiting retrial, was presented before Circuit Judge Clcland yesterday and taken under advisement. As in many previous cases where infor mations have been returned direct by the District Attorney, his authority to take such action is questioned. Briefs will be submitted in the ease. Walton held up a streetcar and shot Patrolman Nelson four years ago. He was tr?ed. convicted and ctren a lencthv term in the penitentiary. Making use of I a technicality. Walton's lawyers appealed to the Supreme Court for a retrial on the grounds that Walton was never arraVrnfd previous to his trial and did not plead. The Supreme Court held this oversight sufficient to warrant the new trial and ordered "Walton released from the peni tentiary and given over to the Multnomah County authorities.
