Gresham Liquor-Dealer Is Dismissed on Charge of Threatening to Kill. "These two prohibitionists, James H. Chalker and H. F- Harvey, came Into this court and perjured themselves In order to convict me of the charge In the com plaint," said Ford Metzger, saloon-keeper of Gresham. in his testimony In the East SIdo Justice Court yesterday, -when he was tinder examination on a charge of threatening, to kill James Chalker. Metzger was discharged at the close of the trial because Justice Waldemar Seton did not consider Chalker was In danger of his life and because It appeared that Metz ger and Chalker, representing the Hq,uor ousiness ana uia iiiuiuuiuuu cicuicuu, u spectlvely, had a row over the remon strance circulated by Chalker against Metzger securing a license. Chalker, the complaining witness, testified that on or about July 1 he encountered Metzger In Tv" H. Hamilton's place of business in Gresham. "I walked into the store," said Chalker, "to hargaln for a wagon, when I saw Metzger, who immediately applied a vile epithet o me. After some further words Metzger said he would cut me to pieces and throw the pieces into the creek. He -wassthen put out of the store by Ham ilton. X.ast November while in company with Harvey, a friend, near Metzger's caloon, Metzger came out and watched lis and tried to hear what we were talk ing about. Presently some large stones -were thrown at us from the "building. One struck Harvey on the top of the head. Metzger went out into the road and also threw stones at us. In order to escape "we moved away. About 40 stones were thrown, hut I escaped being hit. "When I reached zsy home a big stone was fired through the window, scattering the glass over two room?. I distinctly saw Metzger throwing Btones. It was in the evening, but the moon was shining. I am in constant fear that Metzger will carry out his threat. I circulated a remonstrance to prevent Metzger getting a license, and for that reason he attacked me." TV. F. Hamilton testified that Metzger came into his store to pay a bill. "When Chalker came In a row took place and the two men commenced striking at each other, with Hamilton 'between them. Ham ilton said ho told them they must go out side. Metzger admitted he had a row -with Chalker in Hamilton's store, and that he Ibegan it in words, when Chalker struck at him. He said that he had no recollec tion of having threatened to cut Chalker to pieces. He said: "I deny positively that I threw stones at Chalker. These two prohibi tionists have come into this court and per 3ured themselves In order to convict me of this charge. Chalker has been Inter fering -with my huslness. Nobody' respects him." CONSIDER BROOKLYN SEWER. The Property-Owners Will Meet In Blanck's Hall Tuesday Evening. Property-owners within the limits of the proposed Brooklyn sewer district are Invited to assembly in Blanck's Hall, on Powell and East Fourteenth streets, Tues day evening, December 15, to hear reports on the plans, the probable cost of the system, and to take such steps as may be necessary to letting the contract for the construction of the sewer In 1904. Most of the open opposition to this improvement seems to have disappeared, but a great many people in the district affected want to know something about the cost, when the contract can be let and how soon the big conduit and its branches may be com pleted. City Engineer "W. C. Elliott and City Auditor T. C. Devlin have both con sented to attend this meeting and give all the information they can along these lines. Mr. Elliott has the plans so well advanced in his office that the contract may "be let in the early part of next year, provided the preliminaries are started soon enough. Councilman Sherrctt stands ready to get it be1 e the Council when ever the property-" wners desire him to take action. The cost has been variously estimated Irom $100,000 to $175,000. Petitions have been generally cliculated in the district, and may bo signed at the meeting next Tues day evening. As this matter is the most Important ever coming before the district, it is desired that all property-owners should be present, and express their opin ion, and receive the information the offi cials will give on the project. No Fire In Woodstock. A few nights ago some youngsters (bought they would stir up the people of fWoodstock, as things were moving alto gether too slowly out there. They climbed up into the belfry of. the schoolhouse and, cutting the rope by -which the flag was raised, they tied it to the bell rope, which they dropped out of the window. "When all was ready they rang the bell with great vehemence. Naturally about every Ibody in "Woodstock thought there was a Are and rushed out of their homes, but the itooys disappeared in the darkness. East Side Notes. B. Hofer, a Portland young man, form erly in business at Falrview, will enter the mercantile business in Canyon City. He will move there in a short time with bis family. Mrs. May J. Merriman, wife of I, P. Merriman, died yesterday in St Vincent's Sanitarium. She was 26 years old. Two rare foxsklna now on exhibition In the city museum are the subject of a suit flied yesterday in Justice Reld's court And the best of it is that Colonel Ii. Ij. Hawkins, "the father of the city museum," is made to appear as the de fendant in the suit Mrs. B. SInnott is the plaintiff. According to the complaint Colonel Hawkins has Illegally acquired possession of the fox skins. One is an Alaskan white fox skin, the other is that of a red lupine also from Alaska. The legal phraseology Is "that the said property Is in the pos session of tho defendant and 13 wrong fully detained by tho defendant; that the said personal property has been demanded by the plaintiff and the defendant has failed, refused and neglected to deliver same." Their value is set down as $50. The man who stuffs skins told her what he would charge for preparing them for her per sonal adornment. But wheji she returnsd he charged her a much higher price, so says Isaac Swett, her lawyer. So she left the skins on his hands. Rare fox skins are things upon which Colonel Hawkins casts a greedy eye. The great object of his life Is' to make the city museum, of Portland, the best of Its sire and kind on earth. So Mr. Taxider mist kindly turned over the pretty fox skins to the city museum, to the great pleasure of Colonel Hawkins. But Mrs. SInnott protested that they were still hers by rights. She wouldn't pay the taxidermist's price, but she con sidered that she owned the skins. But the Colonel "failed, refused and neg lected" to pass them over to her.
