- Section Five - a “racial en title­
m ent.”
Section Five requires that the
Justice D epartm ent or a federal court
“pre-clear” any changes m ade to
voting procedures by covered j u ­
risdictions to ensure they do not
“deny or abridge the right to vote on
account o f race o r color.”
T his act w as established to fix a
broken system , and it rem ains rel­
ev an t today. As long as b latant
v o ter su p p ressio n m easures like
voter ID law s and district gerrym an­
dering are being used to keep cer­
tain groups from the polls, the V ot­
ing R ights A ct - in its entirety -
rem ains necessary.

T he V oting R ights A ct, and spe­
cifically its S ection 5 preclearance
provisions, is still n eeded to protect
ag ain st such abuses. W hile Justice
S calia is eith er co n fu sed o r m is­
g uided in his ch aracterization o f the
right to vote as a racial entitlem ent,
in 2006, C ongress u pheld this basic
right by o v erw h elm in g ly reautho­
rizing the V oting R ights A ct for
an o th er 25 years.
H ouse Speaker, John B oehner
said at the tim e, “T h e V oting R ights
A ct has been an effective tool in
protecting a right that is fu n d am en ­
tal to o u r d em ocracy and renew ing
this landm ark law w ill ensure that
each and every citizen can continue
to exercise th eir right to vote w ith­
out the threat o f intim idation o r ha­
ra ssm e n t.”
W e intend to hold the S peaker to
those w ords. If the S uprem e C ourt
declares any part o f the V oting Rights
A ct unconstitutional, C ongress will
have a final chance to keep Section
5 alive.
