The request w ill keep Scott D ean H arberts behind bars until the ju s tices m ake a decision. David Groom, director o f the state public defender’s office is the attorney who helped defend Harberts after his death sentence was automatically ap pealed to the Oregon Supreme Court. "I quite honestly d o n ’t see them changing their m ind," Groom said. T he h igh court recently ruled that prosecutors and the state attorney 3BT g en e ral’s office violated a state con stitutional guarantee o f a speedy trial for H arberts by m aking unreason able delays that harm ed his ability to m ount a defense. T he attorney general’s office has conceded that the chances o f per suading the court to reconsider such a strong decision w ere slim , espe cially because only one justice dis agreed w ith the m ajority ruling. But the charges against H arberts are so serio u s that the atto rn ey g en e ral’s office m ust exhaust every o p tio n , sa id P e te r C o g s w e ll, a spokesm an for the office. H arberts was arrested in 1989 for the aggravated m urder o f 2-year- * S co ff D ea n H a rb ets old K ristina Lynn H o m y ch o f O r egon City. But he w as held in jail w hile p rosecutors rep eated ly ap pealed a trial court ju d g e ’s ruling su p p ressin g in c rim in a tin g sta te m ents Harberts m ade to police. Meantime, Clackamas County Dis trict Attorney Terry Gustafson said a grand jury will consider filing separate rape or sodom y ch arg es ag ain st Harberts. A woman came forward who said she was attacked by Harberts when she was 10 years old. The woman says she didn’t tell authorities about the crim e previously because Harberts was facing the death penalty and she felt there was no rea son to prosecute him further. Police began in v estig atin g the new allegations against H arberts the day after the court set asid e his 1994 conviction. Man Accused of Boy’s Kidnap and Assault Pleads Not Guilty T he m an accused o f kidnapping a 10-year-old boy from a Salem -area park and cutting his throat said h e’s innocent. He is charged w ith T he P ortland Police B ureau is notifying the com m u nity o f a R egistered Sex O ffender living in the 6800 Block o f N. C olum bia Blvd. T he sex offender has been convicted o f a sex offense that requires he register w ith a law enforcem ent agency in O regon. His crim inal history places him in a cat egory that indicates he m ay reoffend. This subject is not w anted by the police at this time. This offender has served his sentence and is no longer being superv ised by the O regon D epartm ent o f C orrections. The purpose o f this com m unity notifica tion is to reduce the chances o f further victim ization by this offender, as w ell as to prom ote com m unity aw are ness arid child saffefy. W hitney Sm ith, candidate o f the Pacific G reen Party in Senate D istrict #8 in.north and northeast Portland, received a phoned-in death threat, after appearing on a cable access TV show. W hen Sm ith returned from appearing on the TV show during the evening o f Sept. 14, he checked his phone answ ering m achine m essages and heard a threat ening voice say, “Y ou run, you die!’ Sm ith then dialed *69 to return the call. The person w ho answ ered sounded like the voice on the m essage tape. “This is W hitney Sm ith” Smith said, “Y ou left a voice mail for me and I’m returning the call.” T he person on the other end w as dum bfounded for a couple o f seconds before saying he had been trying the investigation including Portland and S t Helens police. Officers said they also found stolen items, and an old drug lab in the building. Police busted a working drug lab on Deer Island, several miles west ofPort- land last week, arresting three people.
