Portland Observer December 13, 1979 Page 7 Behind the Wall by L a rry Baker »35021 O. S. P. Corresponden t WITH TONGUE CHEEK Some might wonder why Associate Justice o f the Oregon Supreme Court w ould be interested in a group o f p riso n e rs at the O regon State Penitentiary called the Class o f Legal Processes. We were honored with the presence o f Justice Thomas H. Tongue at last Wednesday's meeting, the 28th, and I ’m sure Justice Tongue wasn’t quite sure ot what he was getting into either, but I ’ m proud to say the meeting was a complete success. Justice Tongue expressed surprise and enthusiasm at the versatility o f the group and our class project. His reserve melted as he got the “ feel” o f the group while his presentation and anecdotes kept the attention o f all. We learned o f his b a c k g ro u n d which includes having a father and grandfather who were also attorneys, his early legal training in Oregon and w ith the G o ve rn m e n t d u rin g the depression, and then in p riv a te pratice on such cases as “ Pandora’ s B o x" and “ Lower 13.” These were the names o f tw o m urder cases in w hich he was the defense counsel. We were surprised to learn that he was chosen as a S uprem e C o u rt Justice by a poll o f the Oregon Bar Association. Most Justices were judges in the lower courts before taking a seat in the highest court o f the state. Justice Tongue was candid in ex plaining his desire to sit on the bench, which began while in private practice as an attorney arguing cases at the state and federal appelate court. One o f his main concerns over the years has been before the Court awaiting a decision. This was evidenced in a recent dissent ing opinion written by him in the case, STATE-V-CLASSEN (1979), in which he coined the phrase, “ justice delayed is justice denied". coined the phrase, "ju stice delayed is justice denied.” He said that he is proud that the C o u rt is presently functioning well w ith in the lim its a case should be D avid C ra w fo rd »39830 Assistant Corresponden! decided, ninety days, and that “ it has alw ays been m y a m b itio n to decide cases properly, p rom ptly, and to w rite opinions that can be under stood.” Ju stice T o n g u e spoke fo r a p proxim ately one-and-one h a lf hours and there is no way I could possibly pass on the amount o f info rm a tio n and wisdom our class received. I can safely say that all o f us walked away fro m that meeting w ith something valuable, and that we are tru ly sorry we d id n ’ t have more time to spend w ith him. Members o f the class have been walking up to me since that meeting and telling me how much they en joyed his presentation. It was kind o f fu n n y , but m ore than one person to ld me that Justice Tongue resem bled Abraham Lincoln, and while I d o n ’ t know i f he’ ll take that as a com plim ent o r not, there is no doubt that he was definitely impressive, a so ft spoken man w ith a p o w e rfu l message. “ T he law is a bo d y o f rules w hereby hu m a n disp u te s are resolved. The C o u rt’ s role is to see that human rights are protected, and order in society is m a intained." By Nathan Scott I w ent to view the m ovie "Freedom R oad” w ith the expressed purpose o f seeing what type o f actor is Muham mad A li. T o m y su rprise and pleasure--I almost immediately found this to be tny second concern. I was moved almost to the point o f tears-by one scene-where the blind g irl fo u n d love. I th o u g h t! W hat courage it must have taken, fo r her, living in a w orld o f darkness to over come such a m onum ental obstacle-- the o ld cliche—any means ju s tifie s the e n d -is not appropriate in this in stant, but, it ce rta in tly is food fo r thought. In order to accomplish anything in life , one m ust stand ready to sacrifice. A nd lik e that b lin d g irl. when faced w ith the p o s s ib ility o f loss through seperation, because o f the p o ssib le chance o f a n o th e r acquiring an education. We too must sacrifice, because knowledge is the key; it is that which opens all doors, be they big or little , small or great! Togetherness was another point so p ro fo u n d ly expressed, and in to g e th e rn e ss, i f one can fin d ple a sure , o h ! “ how tim e slips aw ay” so graphically demonstrated by the railroad construction crews. Gideon’s inability to read or write was overcome by determination and desire. W’e too, have obstacles to over come. It is not enough to say that I d o n 't know the meaning o f this o r th a t. N o! tny brothers, that solves nothing. In fact, it creates a more dangerous situation. Ig n o ra n c e is n o t b liss; it 's s tu p id ity . A ll o f life is a le a rn in g process and should be used construc tively. I fin d that I am surrounded by s tu p id ity , laziness and G od o n ly knows how many other things that w ill n o t he lp ine in m y d a ily liv in g . . . t o say n o th in g a b o u t the projected future. U n ity , we m ust have! D eter m ination, we must have! Goals, we must have! and a concrete fu n d a mental blueprint, is the key that leads toward the accomplishment o f these things. D id you ever th in k w h a t an education is? E ducation is derived fro m the w o rd educate, and one d e fin itio n o f educate is, “ to develop and cultivate mentally and m o ra lly ." It d id n ’ t say anything about school, (altho school is vita lly im portant in acquiring a good education) Why? because we are being educated whenever and wherever we maybe during our awakening hours, and o f what we learn is up to us. B rother, the door is already there. The lock is well secured and in place. The only remaining factor is the key. That iny brothers, is w ithin each o f us. So as we go fo rth from here, lets go in search o f knowledge. Let us ah scribe to the principles o f understand ing, and make wisdom, our common goal. Over Ihe past m onth, I have received phone calls asking just what are the keys to SUCCESS. H A P P IN E S S . H EA LTH , W E A LT H . M O N E Y and RESPECT. Some o f the callers gave ine their opinion as to what they thought the keys should be. None o l the callers seemed to understand that life is a succession or order unique to each in dividual. One person's cure can be anolhers poison. l irst o l all. Follow- thro u g h Keys are like a com bination lock, there must be an order o f understanding before you can make it w ork. Each individual is as different as their finger prints in such areas as ( I ) their actual position in life , relative to others. (2) their age and sex. (3) their personality. (4) their temperament. M y Follow Through concept is based upon the simple fact that all things in life and reality are Ihe results o l a specific succession or order; and learning how to recognize this fact is like recognizing the correct piece o f a puzzle that fits another piece o f the same puzzle and then putting them together u ntil the puzzle is complete and going on to Ihe next one. W ith this m mind here are the Follow-Through Keys: Follow-Through Keys to SUCCESS are: Purpose and preparation: one must have a purpose, goal or objective before one can succeed, but, before one can become successful, one must prepare. Follow-Through Key to H A P P IN E S S is: Positive A ttitu d e . Follow- Through Key to H EA LTH is: To maintain a balance between spiritual, mental and physical aspects o f your life, (as in your purpose and preparation). Follow-Through Key to W E A LT H is: To acquire a product or service that others need or want and learn to manage it to the benefit o f yo u rse lf and others under strict c o n tro l. Example (o il, tra n s p o rta tio n , housing, food, entertainment ect.) (as in your purpose and preparation). Follow -Through Key to M O N E Y is: To sell something o f value to others, more than to buy from other, (as in your purpose and preparation).
