TWO CHILDREN INVOLVED Legality of Decree Awarded by lleferee to Be Tested; Wide spread Effect Is Expected. In answer to the divorce action of Mrs. Mabel Etelwer, recently filed in Portland against Leland 1 Stelwer, wealthy banker and stockman of Fos sil, Or., the defendant presents two unique defenses In papers filed yes terday. The first la that he should not be compelled to appear In a divorce ac tion begun by Mrs. Stelwer in view of the fact that he possesses a decree of divorce from the woman, signed by Judge D. R. Parker at Fossil on Janu ary 3. 1921. In a divorce action which the husband had initiated. The second defense is a plea of es toppel, based on official records of Los Angeles county, California, which show that on January 10, 1921, Mrs, Stelwer, representing herself as a di vorced woman, was married Dy Jtiev. v. P. Berry to one Lynn C. Young, resident of Los Angeles. At that time. according, to the certified copy of the records, Mrs. Stelwer gave her ad dress as Venice, Cal. Effect to Be Widespread. The answer, filed by Attorney E. V. Llttlefield, will be attacked 'by a de murrer within a few days in which John W. Kaste. lawyer for the woman, will contend that the divorce granted In central Oregon was illegal because the evidence was taken before a ref eree and only reviewed In transcribed form by the judge signing the decree. On this basis the marriage in Los An geles will be held unlawful, if ad mitted. Decision In the case will be wide spread in its effect. Should the de murrer be sustained and courts hold that a divorce heard before a referee is illegal, the decision would in validate thousands of Oregon divorces for it is a common practice in coun ties outside of Multnomah for Judges to assign the hearing of default di vorce cases to referees. Two children are involved In the case. They were awarded by the first court to the custody of Stelwer." They are: Robert LeLand, aged 7, and Susan Jane, aged 6. The Steiwers were married in Portland, June 15, 1914. Woman Goes to Movies. Mrs. Stelwer left her husband short ly before he obtained his divorce, and went to Los Angeles to enter the "movies." Her husband was opposed to this, according to his testimony in the divorce case, telling her that she had to choose between himself and children and her possible film "career." He told her further, he testified, that It would be Impossible for him to finance her in such a career while she was learning to dance and act. By mutual agreement, Mrs. Stelwer was pal lump alimony of $3000. Stelwer testified at the hearing that this was a fair share of his property and that he felt he "did even more than he was able to." Since the suit, however. Stelwer fell heir to his father's fortune. It Is reported. Wbmerv'iS Activities THE 1923 fair was discussed from every angle at the luncheon of the Portland Woman's Research club held yesterday noon in the Arcadian gardens of the Multnomah hotel. Mrs. Carl O. Tipton was chairman of the affair and prepared one of the most delightful programmes in the history of the club. The speakers were Julius Meier, Mayor Baker and Frederick Vlnlng Fisher. The musical pro gramme was a real treat and In cluded four artists: Mrs. L. W. Wal dorf, violinist, accompanied by Miss Mary Bullock, Mrs. Barge E. Leonard and F. W. Evans, a disabled veteran of the world war, who sang two solos. The programme was immediately followed by a business meeting. . Mrs. A. A. Bailey will entertain the members of the Tuesday afternoon club at 1 o'clock luncheon today at her home, 1516 Hawthorne avenue. Lavender club. Branch No. 2, will meet at the home of Mrs. A. Johnson, 86 East Twentieth street, today at 2 P. M. Take Sunnyslde or Mount Ta bor car to East Twentieth street, three blocks north. Mrs. C. D. On November 3 Mrs. N. P. Oakerman will be hostess at her home, 862 East Eighth street North. SEA SCOUT MOVE AIDED Committee to Select Executive for Work in Portland. Plans to push the development of the sea scout movement in the city were undertaken yesterday at a luncheon of prominent Portland men at the Chamber of Commerce. J. E. Wilder, chief sea scout, presented the aims of the new organization In con nection with boy scout work and told of the hold it has gained on the older men In cities where It is developing. As an outgrowth of the luncheon a committee of those in attendance was selected to take up the organization work. The committee's chief duty will be to pick a man to place at the head of the sea scout work in Port land. The committee consists of Admiral H. T. Mayo, James E. Brockway, J. W Crichton, C. D.
