CHANGE OF VENUE ISSUE Defendants AVJII Be Removed to Pendleton for Resentencing by Judge Fheipa. SALEM. Or Sept. JOa (Special.) John I Rathle and Elvle D. Klrby, convicted In the Umatilla county' cir cuit court on charges of first-degree murder In connection with the slaying of Sheriff Til Taylor In July. 19:0. will be hanged for the part they played in the crime unless the death sentence Imposed by Judge Phelps Is commut ted to life imprisonment by Governor Oicott. This was made plain here today when the Oregon supreme court de nied the petition of the accused men for a rehearing. It will now be necessary to remove Rathle and Klrby to Cmatilla county, where they will be resentenced and a new date of exe cution fixed by the court. Following their conviction in ths lower court, Hathle and Klrby were sentenced to hang. They afterward were brought to the penitentiary, but before the execution date arrived they perfected an appeal to the supreme court. This appeal later was denied by the court and the sentence of Judge Thelps was allowed to stand. Original Verdict Stands. "We have carefully considered the petition of the defendant! for a re hearing and are unable therefrom to ftatn any substantial reason for devi ating from the views expressed In the nriRlnaJ opinion," said Justice Mc Brlde. who wrote the opinion handed down today. "It Is true that by Inadvertence It was stated that Edward J. Clark, an attorney of Pendleton, was a non renlrtent of the county, but in view of what we consider the weight of affidavit testimony introduced in the motion for a change of venue, we do not look upon that face as control ling. The motion was heard befor a judge who had resided In the county for many years, and who, by his long residence and necessary acquaintance over the county, was well qualified to pass upon the condition of ths public mind and to appraise the value Okf the testimony Introduced relating to this matter. "The other matters urged In the petition for rehearing were carefully considered before the original petition was handed down. and. as before re narked, we see no reason to change our views. We fully appreciate the serious consequences of our decision, but these consequences are such as the defendants have Invoked by their conduct nnd which we cannot avert wlthotft doing violence to established principles of law. Trial Held Fair Oae. "The defendants, in our opinion, had a fair trial, and anyone who reads the record will see that they were ably defended. So, viewing the case, we are constrained to deny the peti tion for rehearing, and it is so or dered." During the past few week consid erable Influence has been directed at the executive offices with a view to having the death sentence Imposed upon Rathle commuted to life Im prisonment. Petitions have been cir culated among ths various-war moth, ers' organizations of the state, and these are now on file In the execu tive offices. Hope for commutation of Rathle's sentence was based on his war record. When asked If there was any basts for speculation that he might com mute the sentences of Kathle and Klrby to life Imprisonment, Gov ernor Oicott said: "I think there is none." Neil Hart, who fired the shot that killed Sheriff Taylor, was hanged la the penitentiary here more than a year ago. Trior to his execution he made a statement to local ministers in which he assumed ail blame for the sheriff's death. In a second opinion Justice Mc Bride upheld the lower court, which dismissed a petition for rehearing on grounds of "coram nobia," a legal term for a certain kind of error. It was held that this no longer obtains In Oregon law. ALASKAN VEGETABLES BIG - Shipment Received in Portland Knows Agricultural Possibilities. Vegetables which ar declared to be record breakers for sixe were re ceived by Mrs. Charles E. Kekert, 102S Vancouver avenue, yesterday from Charles H. Thompson who Is con nected with the government hospital at Anchorage, Alaska, The vegetables were grown In the vicinity of the hospital and are declared to be proof of the agricultural possibilities of that territory. Mrs. Kekert reported " that she weighed the vocetablea and found them to weigh as follows: One white turnip ( pounds, three ruta bsgas 17 pounds, three beets 9 pounds, 11 po tatoes IV4 pounds, four carrots 1H pounds, three parsnips 1 pound. In addition she said there were a num ber of white radishes ss large around aa a silver dollar and about eight inches long. PERU TO HONOR AMERICAN Government to Participate In Un veiling of Monument. WASHINGTON, D. C. Sept. JO. Peru, It was announced at the Pan American union today, will officially participate Sunday In ths unveiling near Puno, Peru, of a monument over he grave of Dr. James Orton. Ameri can sxplorer, who lost his lifs 44 years ago while doing research work for the Smithsonian institute. - Dr. Orton va a professor at Va-ssar college and the funds for the granite shaft to honor lila memory wars raised through that institution. The widow and two daughters of Ir. Orton. now living in California, will attend. Elaborate ceremonies have been planned. Warrant Out for Rail Head. ' CHICAGO, Sept. 20 Warrants for the arrest of H. K. Byram, president of the Chicago, Milwaukee & St. Paul railroad, and thrre other officials of the line, were issued by Conntr Judge Relghelmer, charging them with refusing to give employes their statutory two hours off on election day to permit them to vote. Rhea, the chief bone of contention In the board of directors, resign and that at the earliest possible date an engineer be obtained to succeed him. The special committee slso recom mended the appointment of R. M. Thompson, ex-city engineer of Seat tle, to have complete, charge of the contractors' work. Further new developments are tie resignation from ths board of di rectors of Leonard Csrpenter, who Mood with Engineer Hhea In oppos ing Patrick Welch, the contractor, and the sDnointment of John A. Westerlund, to replace him as di rector. Assurance has been given by Welch that the system will be completed snd water in use by the summer of ma. State Engineer Percy- Cupper has been asked to recommend at once an able engineer to succeed R. W. Rhea and to be In absolute control of the building of the big Irrigation system. Engineer Thompson will be In charge Only of the contractor's work snd Mr. Welch pledged to the special com mittee that whatever Thompson said stoould be done would go with him. Mc Claskey Sons distillery, bound and blindfolded them and escaped in seven touring cars with 88 cases and three barrels of whisky early yesterday. Luehrs, of an unsuc cessful attempt to railroad her to the Insane asylum, and of numerous threats to succeed in such an under taking. In a divorce suit filed in the circuit court yesterday. He swore to a complaint and compelled her to sub mit to an examination into her san ity, she alleged, but Dr. S. E. Josephl pronounced her sans. The threat was made by her hus band that If she sued him for divorce that "neither she nor any "if her rela tives would be in The land of the liv ing In one year," It was asserted. The Luehrs were married the first time In 1915 under the name of Porter, lira. Luehrs discovered the name was an assumed one and demanded a re marriage. It waa said. In 1919. Carroll J. Bennett on one occasion flew into a rags and broke his chil dren's toys, declared Lena B. Bennett In a divorce action. He found fault with her methods of raising their child and criticised her cookine, sji further complained. 1 Frantlska Xemec asserted in a di vorce suit that her husband, Miloslav N'emec, struck her with a picture which was a Christmas gift to their child, breaking tbe g-lass and frame. This act was accompanied by "a tor rent of oaths," she declared. Nellie Milner complained that Carl F. Milner kicked her, tramped on her and made fun of her. In a divorce action bearun yesterday.
