A new plan under which Swift & Co. and Armour & Co. are to divest tbejn selvest of their interests In stock, . yards and stockyard terminal rail roads was a (freed to today by the department of Justice and immediate ly approved by Justice Stafford of the district of Columbia supreme court. Under the plan the companies must deliver their stock In the yards and terminals to the Illinois Trust & Sav ings bank at Chicago within SO days, for administration by two trustees, Henry W. Anderson of Richmond. Va, and George Sutherland of Salt Lake City, until sold, which must be with in a year. Flaa Readily Approved. "The legal principle, of course, was wp to the department of Justice." Justice Stafford said after he had signed the plan, "and when the de partment had approved the plan It was only Incumbent upon me to see that the law was not violated by any of the particulars. I was glad to find that such was not the case and therefore approved the plan." The trustees are to receive salaries Of tlO.AOO a year each and will have power to interfere in the manage ment of any stockyard or railroad If in the opinion of both either the Sher man act or the terms of the decree are being violated. Stock Must Be Said. The plan sets forth that the de fendants are to proceed to sell their stock with due diligence, with reports of all sales submitted to the court for Jts approval. These reports must con tain the price and the name ef the proposed purchasers and must be ac companied by affidavits that the proposed purchasers are in no way connected with the defendants. In the event that any of the stock remains unsold at the end of the year, the defendants may obtain an exten sion of time upon showing made to the court of diligence in their efforts to dispose of the stock at a fair and reasonable price. Vast Properties Iavolred. The properties stock to be sold by the two companies include Sioux City Stockyard company, St. Paul Union Stock Yards company, St. Joseph Stock Tarda company. Denver Union Stock Yards company, Kansas City j MocKyaras company, St. Louis Na tional Stock yards, Union Stock Yards company of Omaha. Limited; Port land Union Stock Yards company, North Portland, Or.; Sioux City Ter minal Railway company, St. Joseph Belt Railway company," St. Joseph, Mo.; Kansas City Connecting railroad and East SL Louis Junction Railroad company. Agreement to dispose of their stock yard interests was made by the pack ers in the consent decree filed with the District, of Columbia supreme court more than a year ago. "We are glad to have this matter disposed of to the satisfaction of the government," said a statement by Armour & Co today, concerning acceptance of the plan for disposing of that firm's holdings In stockyards. "We entered Into this agreement to dispose of our holdings in stockyards, not because we felt it was economic ally proper but merely through a de sire to bow to the rather widespread, but in our opinion misguided demand. "We do not believe that the pro ducers of livestock will gain any thing by having someone other than ourselves interested In the operation f stockyards, as we cannot . see wherein the consumer will be bene fited. .' Walker and Dr. Harry Feagles have - been named members of the Chehalls park board by Mayor Long. Memorial services were held Sunday for the eight members of the local Moose lodge who died during the last year. Rev. F. F. W. Greene of St. Andrew's Episcopal church of. ficiated. The members honored by the ceremony were Albert T. Ellis, veto de Saute. Robert Pattison. E. W. Hunter. Thomas Stave, George It- Brace, Warren Egerer and Charles Bay. Harrisburjr Watchman Named. HARRISBURG. Or.. April 12. (Spe rial.) Douglas Love, who has been the city's night watchman since last fall, has resigned and the city coun cil has named R. L. Ingram to take his place. The city has dispensed with the services of day marshal and since the change there has so far been no occasion for arrest. The winter season just passed is the first in many years in which no burg laries have been committed. Lumber Worker Killed. CENTRALTA. Wash.. April 12. (Special. T. L. Lusk, employed by the Doty Lumber & Single company, was killed instantly this morning at Doty when he was hit by a heavy block. Hi: skull was fractured, right arm crushed and right leg broken. Lusk was 32 years old. He is sur vived by h's mother, Mrs. Jane Lusk, and three brothers and three sisters. t Armory Bids to Be Opened. CENTRALIA. Wash., April 12. (Special.) Bids will be opened Sat urday for the erection of Centralia's new $50,000 armory. Construction will begin Monday. After state and defense had ex hausted all peremptory challenges, a jury was Impaneled late yesterday in the court of Circuit Judge Morrow to try Joe Brady, the man who is charged with capitalizing the noto riety given the "talkative burglar" last winter, if not being the robber himself. Prospective Jurors were ex amined by George Mowry, deputy district attorney, and Lou Wagner, attorney for the defense. The jurors sworn in were the fol lowing: C. B. Testerman, grocery man; William F. Darr, merchant: Al bert W. Sage, salesman; Horace W. Parker, retired: C. E. Morris, lum berman; Alexander McAllister, long shoreman; W. N. Christensen, cigar dealer; Robert B. Lamson, book keeper; Albert E. Rossiter, retired; Louis Erlcksoiv bridge carpenter; Charles J. Sigger, laborer, and Charles F. Randall, retired. Brady was indicted on three counts, one for the robbery of the home of Roscoe C. Nelson, Portland attorney; a second for the larceny of $100 which Nelson threw in a street for the "talkative burglar." and third for the theft of 36 which Nelson charges he paid to Brady to pay to the talka- tive burglar in return' for a diamond ring held by the robber. Chehalis' city commision has refused to repeal the jitney ordinance which prevents C. E. Jackson from operating a line of stages between Chehalis and Centralis. The Lewis county superior court has tied up I jacKson by a restraining order from running his busses. He asked the repeal of the ordinance under his contention that it was in conflict with the new state law. Jackson has declared his intention to again start his service as soon as the new law -becomes effective. High School Head Re ired. PRINEVILLE, Or, April 12. (Spe cial.) At a recent meeting of the county high school board Professor I E. E. Evans was rehired for the en- suinng year. Mr. Evans, who has I been a member of the faculty for the past ten years and principal three years of that time, recommended the retention of the entire present force of teachers for the coming year.
