It was further pointed by Mr. JWhitcomb that investors who have purchased bonds other than the city of Edmonton issue and who bold the Interim certificates issued by Eth eridge are in the same predicament as those who have these certificates rn the Edmonton bonds. There were many persons who felt that they would not lose through tne rauure ,fcy reason of the fact that their cer tificates called for other bonds. Court Order Is Essential. A. B. Winfree, of the law firm of (Teal. Minor & Winfree, bond attor neys for Morns .Brothers, inc ana ow legal advisors to Receiver Whit romb, said that not one article will fce removed from the building except Upon order of court. He confirmed the statement of Mr. Whitcomb that jersons who had paid for and re ceived their bonds and left them with aiie firm, would in due time have them yetnrned. Mr. Winfree likewise concurred rith Mr. Whitconrb in the announced determination to let the public have U news concerning the failure as it develops day by day. "This is a matter of public Interest and the public generally is entitled to know everything in connection frith this affair," he eaid. In conformity with this announce ment, Mr. 'Whitcomb has arranged to receive newspaper men twice daily in order to give out everything which Is uncovered during the course of the audit. Nothing will be kept from jpublic view, is his assurance. , $150,000 Returned in Week. Another angle to the events lead ing up to the closing of the doors Monday morning developed yesterday when it was learned that investors in bonds who held interim certificates cashed in something more than $150, 000 in cash on these certificates dur ing the week preceding the closing of the doors. ' On the Saturday night that Ether Idge appeared before Al Kader tem ple of the Mystic Shrine and there confessed his past criminal record in one of the most dramatic sessions of the temple, his firm had approxi mately $457,000 in cash on deposit in banks throughout the northwest. Rumors of Etheridge's past peni tentiary record, coupled with street stories of the uncertain condition of the firm, caused many persons hold ing these certificates to return them to the firm and receive their cash. ( Various Amounts Saved. i Many instances were related yester day of persons saving from $100 to $5000 each by cashing these interim certificates a day or two before Elher idga fled from the city. The audit thus far made disclosed that the firm had but $301,000 on deposit in banks yesterday. It was also learned yesterday that he 20w shares of stock which Ether idge held in the Ladd & Tilton bank were transferred by him to the firm When he signed over all his interest and that of his wife to Fred S. Mor ris on the afternoon of his departure. This bank stock is now listed as among the firm's assets and will bring above par, was the belief of Mr. Whit comb. ' . Although the filing of the voluntary petition in bankruptcy late. (Korrell. one of Hale's attorneys, but Tit brought to light no new angles to -Jhe failure. A Branches Ordered to Clone. ? After he had taken full charge of ,lhe affairs yesterday morning. Just what disposition will be made ?f the $75,000 in bonds now held by Sheriff Hurlburt on the direction of .District Attorney Evans has not yet 'been decided. These bonds were -seized at the office of the American IRailway Express Monday afternoon 'on search warrants in the hands of deputy sheriffs. They comprised ifconds which Etherldge bad shipped to the Portland firm from Tacoma the Bight he headed east. Return Be Asked Later. f Mr. Winfree said yesterday that .when the affairs of the receivership iare shaped around better he will make (a demand upon the county officials for the return of the bonds, as they ;'are now listed as assets of the cor poration. He does not anticipate any . trouble in having them restored to the "receiver, but will be prepared to take 'the matter into the courts should the ; necessity arise. ; Discussion is now rife concerning 'the probable temporary trustee in I bankruptcy to be elected by the cred itors of the concern. Not until a complete schedule of assets and lia bilities is filed In the federal court wlll it be possible to call the cred itors together for the purpose of j electing a permanent trustee to suc- ceed the temporary receiver, v Some of the largest creditors are vow waking overtures to each other 'for the purpose of agreeing upon a permanent trustee, but as yet no def inite action has been taken. Mr. Win free announced yesterday that he will put forth every effort to have Mr. Whitcomb retained as truestee. He said that Mr. Whitcomb is not con nected with any bank or bond house and lb his mind would make the best possible trustee. The meeting o creditors probably will not be held until late next week "or the week fYtllnwinfir. Deputy Sheriffs Schirmer and Scott left Portland yesterday morning for Minneapolis to take Etheridge Into custody and return him to Portland. They went without extradition papers by reason of the fact that Etheridge has signified his willingness to re turn. A few days ago he received $4000 worth of per cent gold certificates, sent to him by the bank. Sibley was known to have servea terms in several eastern peniten tiaries. He came to Oregon a lew vears ago. He was received at the iocal prison on October 28, 1919, to serve a term of two years. He after ward was paroled, but violatea tne provisions of his release and was re turned to the prison. ETHERIDGE CHAUFFEUR FIXED Driver of ex-President of Bond Honse la Speeder. . Rot Fike. employe of Morris Bros., Inc., was fined $26 in the municipal court yesterday on a charge of speed ing. The sentence was suspended. He was arrested Saturday when return ing from a trip to Tacoma. Wash., after taking John L. Etheridge and his wife to that city and seeing them on board an eastbound train. Fike was making 50 miles an nour on the Linnton road, according to the testimony of Tatrolman Shayler, who made the arrest. BOOKS STRAIGHT, REPLY (Continued From First Page.) now being made. In explaining his predicament Eth eridge said it was due to personal an tagonism between himself and a news paper publisher of Portland. On Vacation Is Reply. This antagonism reached its most dramatic stage when the paper pub lished the fact that he had served two years in the New Jersey state peni tentiary, 12 years before, for drawing a check on a bank without funds and had later been Jailed for drawing on deposit that his wife made in a bank. He Insisted that he had lived down the first affair and that the second was due to a misunderstanding. When the account of his earlier trouble was published after the exposure he said he had received a vacation from Mor ris Brothers and was on his way east when he was taken into custody here. Newspaper Man Is Blamed. Superintendent of Police Walker said that Etheridge Insisted he was victim of circumstances. He de nied, according to Superintendent .Walker, that he had fled with any of tle bond house money and ex plained that he was starting on an extended vacation when he was ar rested. Etheridge also said he did not know the company had failed until he was informed of it by Mr. Walker. 'I'll not fight extradition," Mr. Walker quoted Etheridge as saying. If you want to send one of your detectives with me back to Portland I'll pay all of the expenses. My pres ent difficulties are the result of a controversy I had with a newspaper man who learned of my past record and used the information to dis credit me." ETHERIDGE WAXTED IX EAST Xew Jersey Prison-Keeper to File Detainer With Authorities Here. TRENTON, N. J- Dec. 28. (Spe cial.) John tt. Etheridge, who served wo terms in the New Jersey state prison here, has a long criminal rec ord and is wanted here by Prison Keeper Mulhron who will file a detainer with the Oregon authorities for Etheridge, who is alleged to have broken his parole. Etheridge came here In 1907 and described himself as the son of a prominent clergyman of England. He was generally attired as a clergyman and was of suave manner, but did not appear to have any regular occu pa- ion. He was here but a short time when accused of passing bad checks. A warrant was Issued for his arrest and the police began a search for him. Captain Clancy of the local police bureau located him at Stamford. Conn., and Detective Pilger brought him back. He was tried and convict ed of obtaining money under false pretenses. On December 3, 1S07, he was sent to tne state prison for two years. He was paroled on November iaa. rrevious to tnis ne was ar rested in Monmouth county. New Jer sey, and on October 21, 1905, was sent to prison for 18 months for obtaining money under false pretenses. He was discharged January 24, 1907. At the time of his arrest he was Impersonating an Episcopal clergy man, wniie in prison ne received a job as clerk. He was arrested in Asbury Park. New Jersey, by the late Chief of Police Smith and made his escape. He later was recaptured in New York. More than 1000 persons are listed as holders of interim certificates on bonds purchased through the defunct firm of Morris Brothers, Inc., accord ing to the schedule filed in the federal court in the voluntary petition m bankruptcy. In addition to the names appearing in The Oregonian yesterday morning, these are included in the list of pos sible losers through the wrecking ot the bond house. The audit now being made by Whit comb, Whitfield & Co., public ac countants, has brought to light the names of nearly 1000 more holders of interim bonds.
