SUPREME COURT TO ACT Judge Tucker Declares Issues Are Soon to Be Heard op Appeal and He Delays Decision. "In balancing the respective ele ments of damage to the plaintiffs. It seems to the court that the damage to the plaintiffs (theater owners) is clearly more Imminent and substan tial if the picketing should be -con-J tinuea in tne interim man iai would be visited upon individual members of the union, or the union Itself, in vacating the order," an nounced Judge Tucker, "and for this reason the restraining order will be continued in force until a decree is rendered and entered after the trial of this suit upon Its merits, and the order will not be Broadened but limited to the act of picketing as alleged was being carried on." Supreme; Court Soon to Act. Several questions involved In the suit will be entertained shortly by the - state supreme court in similar cases and for that reason Judge Tucker decided that any opinion he might give as to the erral effect of the facts alleged would be academic and of no avail at this time. The only question with which he was concerned was the one Involved in the motion seeking to dissolve the tem porary order. The sympathetic strike was called because operators walked out In a Tacoma, Wash., motion picture thea ter, in which Jensen rfc Von Herberg had an interest, in an attempt to force through wage Increases. The local men were receiving the scale demanded in Tacoma, It was said, and there was no local dispute as to wages, hours of lab'or or terms and conditions of employment. After walking out locally In sympathy with their Tacoma affiliations, the unions caused pickets to be placed In front of several of the local picture houses, Until restrained by a temporary in junction. No Local Dispute at Issue. The fact that the walkout and subsequent picketing did not grow out of a local dispute, said Judge Tucker, "becomes important upon the question of whether defendants are acting primarily for their own indi vidual benefit and to bring to them selves Individually a bettor condition of wages, hours of labor or terms of employment, or whether their acts are designed primarily to injure the employer in the hope that other re mote benefits will result to them. "It seems to the court that the liti gation gives fair promise to disclose a situation upon the trial of the suit wherein a direct benefit to the em ployes is not the chlf but the sec ondary aim of the controversy. The proceeding Is in the nature of a boy cott." FRUITS, PRCDUGE BREAK SEATTLE CONSUMERS REFUSE TO PAY HIGH PRICES. Potato Market Drawing Little In terest; Yakima Cantaloupe Sea son to Open This Week. SEATTLE, Wash., Aug. 16. (Spe cial). There Was a marked downward undertone in prices of fruits and pro duce on Western avenue for the open ing of the week, jobbers stating free ly that consumers seem unwilling to continue to pay high prices for per ishable fruits. This undertone has unsettled futures and is reported for the lack of stability that ran through all trading and carload orders for further than spot delivery. The potato market, which at this time of the year should bes shaping Itself on the digging-time basis, is drawing little interest. Jobbers and carload buyers say that there will be an ample crop and that there is no occasion for haste at this time to close future contracts. This attitude Implies that carload buyers expect1 a low fall market. Toward the end of the week Yak ima cantaloupe season will open with first carload shipments. Express lots show a satisfactory quality and the crop, it is believed, is heavy. The completion of the loganberry season shows that the crop was 25 per cent of normal, owing to freez ing out of the plants last winter, and . average prices to growers of $1 per crate. The raspberry crop was 75 per cent of normal, producers getting av erage returns of $3.75 per crate. Bid prices of pears have fallen from the high point of $90 to $65 per ton at the orchards and the market Is weak. Peaches are holding firm. DAILY CITY STATISTICS Marriage Licenses. Facts Regarding Whisky and Scuf fle at Lambs' Club Yet to Be Brought Out. y NEW YORK, Aug. 16. "Too ill to be Interviewed." This was the mes sage delivered today to federal prohi bition agents who called at the home of John W. MeGraw to ask the man ager of. the New York Giants if it was true that he had bought whisky at the Lambs club. An admission to this effect, alleged to have been made to the-dlstrict at torney's office in its Investigation of how John C. Slavin, actor, received a fracture of the skull In front-of Mc Graw's house about a week ago, today attracted the attention of J. S. Shev lin, enforcement officer. It was he who dispatched the dry agents to McGraw's home with the threat that if MeGraw did not present himself at the federal district attor ney's office a subpena would be sought. I The agents reported they could not see MeGraw, who Is recovering from a blow on the head. This blow, he told the district attorney's office, was re ceived in a scuffle in the Lambs club the night the actor also was injured. Slavln's condition - today was re ported worse and for this reason Dis trict Attorney Swann announced he would not present the case to the grond jury for a few days. CHILD INJURED BY TRUCK Little Girl Suffers Broken Jaw as Result of Accident on Highway. SALEM, Or, Aug. 16. (Special.) Katherine Gouley, aged 11, is In a local hospital suffering from & broken jaw and internal injuries sustained late Sunday when she was run down by an automobile truck on the Pacific highway, about 11 miles north of Halent. The little girl had been play ing beside the road and was said to have emerged front behind an auto mobile directly in front of the truck, which was driven by Frank C. Perry of Portland. She was struck by the fender and knocked to the pavement. Later the girl was brought to Salem for med ical treatment. She is said to be in a precarious condition. Her parents. " Poultrymen will learn the proper methods in the culling of poultry flocks at the Multnomah county farm bureau today, when "poultry week,'" August 17-20, begins.
