Louise Palmer Weber, In Boost ing Walter Pierce, Recommends jf Governor for Re-Electlon. ' Both A. G. Rushlight and Arthur B. Siaines are ousted as candidates for City Commissioner in the coming municipal election, according to the opinion of City Attorney La Roche City Auditor Funk so notified Mr. Rushlight and Mr. Baines. and these men will institute mandamus proceed ing to have their names placed on the ballot. Mr. Rushlight will be represented by TValdemar Seaton. Frederick W. Mul- key is representing Mr. Baines. Wilson T. Hume is representing a taxpayer, not named. These three will look after the mandamus proceedings, probably this morning. Dr. T. L. Perkins, a dentist, filed Tuesday afternoon for the short term of seven months. About 5:30 o'clock Mr. Rushlight also filed. In the past It has been customary for nominating petitions to be filed up to practically midnight on the last day, but Dr. Per kins conceived the idea that if a ruling co Id b obtained that the Audit office closes officially at 5 P. M., he would have a cinch on the election and draw the City Commissioner's salary for seven months, the compensation being approximately $2911', a sum not to be sneezed at. Lrcal Prlft Is File. Gus C. Moser, recent candidate for the Republican nomination for Gover nor, appeared as Dr. Perkins' attor ney, and filed a protest against Mr. Rushlight's name appearing on the bal lot for the short term in opposition to his client. Auditor Funk passed the protest to the City Attorney for an opinion. Mr. LaKoche ruled that the hours for official business have been set by the Council as from 8 A. M. to S P. M.. and that a nominating petition filed after 5 o'clock could not be ac k ccpied. This ruling also shut out Mr. Baines. who had filed shortly before 7 I. M., as a candidate for the long term of four years. "Tuesday was the last day for fil ing." observed Mr. Rushlight over the telephone last night. Mr. Rushlight being home sick with grippe, "and it wis Tuesday all day and up to mid night. When Mr. Barbur was City Auditor he accepted nominating peti tions, many of them, long after 5 o'clock of the last day. and there was no attempt to keep any of. these late filings oft the ballot. The Auditor's office was open and I filed; had the office been closed I could not have presented my petition. My friends 1 am here with a sick family are look ing after the situation and will bring mandamus proceedings to keep my name on the ballot." 1'erk.lns Ifa Clear Field. If Mr. Rushlight and Mr. Baines are kept out of the election by Dr. Perkins, St will have somo important bearings on the result. For instance, this w'iU leave Dr. I'erkins with a clear field, unless someone's name should be writ ten in so extensively that the dentist would be defeated and it requires a stretch of the imagination to expect urn an outcome. Also It reduces the number of can didates for the long term to four: C. A. Bigelow and Dan Kellaher, incum bents; S. C. Pier and Oscar W. Home. And where there are two places to fill and only four candidates, the second choice does not apply. In other words, each candidate would have his fate determined without the assistance of second choice votes, otherwise, with two places to fill and only four can didates, an elector could vote for the bunch, giving first choice to two and second choice to the remaining pair. There is no doubt but that the sec ond choice votes were being depended on by one or more candidates to pull them through, and the oprnion of the City Attorney now deprives them of this hopeful reserve strength. Because of this. Mr. I-a Roche's ruling barring Messrs. Rushlight and Baines affects the candidacy of all the men running for the long term. Mrs. Louise Palmer Weber, the In dustrious epistolary campaign mana ger for Walter M. Tierce. Democratic candidate for Governor, is now in dorsing Governor Wlthycombe. Mrs. Weber's effort is intended to boost Mr. Pierce, but it is actually a recommen dation for Governor Withycombe. She wants men elected who will support the President's war programme, and Gov ernor Withycombe lias made a record doing that. In fact, a Government of ficial is quoted as saying that Gover nor Withycombe stands higher at Washington than any other Governor by reason of his promptness In carry ing out such part of the war pro gramme as has been assigned to him. J. L. Day, chairman of the Republi can County Central Committee, is send ing out the following letter to prac tically the same list of women who re ceived Mrs. Weber's communication: Dear Madam: Many of the prominent club women of Portland are receiving a letter from Lou! Palmar Weber on a letterhead et the National League for Democracy, dated October 14. Mrs. Weber la a paid sec retary in the office of W. M. Fierce. Demo cratic candidate for governor and a re cent participant In the Non-Partisan League orcamxation meetings. This particular letter strongly Indorses the e'ei-tion of men' who wilt support the President's ir programme. We are taking tins opportunity of indorsing the sentiment here expressed, and calling your attention to the fait that our representatives In the I'ntted States Senate and Congress have voted in support of the Administration on every measure advocated by the President. The war programme of our Governor Is one of which every Oregontan can fee. proud. It is pointed, to as an example from one end of our nation to the other. He has tlned every means at hts command to back up the boys who are so nobly sacrificing themselves that our Nation nnicht livV. and we are asking you at this time, as good Americans, to forget the camouflage slogan, 'politics is adjourned." and get your friends oat to the poll, that the men who have made good may be sustained. Judge Bennett, of The Dalles. Is yielding a little bit to th requests and suggestions of friends that he be a candidate for the vacancy on the Supreme Court bench. Judge Bennett has consulted with a number of Demo crats and asked their opinion. He be lieves that he would draw more labor votes than any other candidate mentioned.
