Public Bervice Commissions of Washington. Oregon and Idaho today filed com plaints with the Interstate Commerce Commission attacking the 25 per cent Increase In freight and 10 per cent In crease In express rates as applying to fruit, vegetables, berries and fish hipped from the Northwest. The rates are declared to be dis criminatory and unauthorized under the law by which the Government as sumed control of the utilities. The commission Is asked to set aside the rates and establish new rates not greater than formerly prevailed. These complaints. It was said at the Interstate Commerce Commission, were the first important ones opposing the new rates. Director-General McAdoo and 26 rail roads are named as defendants In the freight rate case and that attacking the expreM rates names the American Railway .Express Company, the ex press combine established under gov ernmental auspices. Both were filed by the commissions on behalf of sev eral fruit-growing associations in the Northwest. The Increases on a percentage basis. . ,F11i. w.v. I It is contended, give fruit and vege table growers in the Middle West and East an advantage over the Northwest ers growers and "disturb the relation ship that had existed between compet ing points" This advantage, it Is al leged, will destroy the Industries in the Northwest. Increases, It is also charged, were not needed by the carriers or express com panies. It has been the contention of the Public Service Commissions of Oregon, 'Washington and Idaho, ever since the Issuance of order No. 28. on May 24. that the Increase as applied closed mar kets of the great consuming territory east of the Rocky Mountains to fruit products of the Pacific Northwest. Owing to the fact that the state commissions In the Pacific Northwest states had dealt reasonably with the railroads, permitting the roads to es tablish and maintain rates that afford ed a reasonable profit on the traffic the advance of these rates on a per centage basis made business from this territory bear an excessive and dis criminatory rate as compared with the corresponding rate from other locali ties that previously paid too little, it I Is held. In reference to the proposed Increase In express rates, the Oregon Commis sion has refused to sanction the pro posed advance of 15 per cent because It would curtail markets to the pro ducer on interstate traffic, and as to Intrastate business the express compa nies had pledged that certain estab- j lished rates should not be disturbed, and it was In support of this under standing in connection with other facts that the commission refused to approve the application of the American Rail way Express Company for permission to raise rates. Removal from Columbia County to the local Circuit Court of the $25,000 alienation of affection suit of Ellen Murphy against Elsie Marlet was made yesterday, and the case, which prom ises to reveal the high lisrhta of St. HeJens' social activities, will be tried in the local courts during: the Fall terrr.v Mr: Murphy, who lives at St. Helens. Is suing- Elsie Marlet. of Portland, fori the alleged alienation of the affections of Char les Murphy, . husband of the plaintiff. The defendant sought to escape sum mons to thd suit and in an affidavit which is a part of the record filed yes terday she alleges that plaintiff's at torney practiced fraud and deceit in having the papers served on her. This I was denied in a counter-affidavit, and following a hearing by Circuit Judge Eakin. at St. Helens, her charges were held groundless, and the case was transferred to Multnomah County for trial. According to affidavits and Colum bia County records. It will be shown that Charley Taylor, alleged object of i-lsie Marlet s affections, staged an all- night liquor party at St. Helens on the night of May 1J. They were arrested by Sheriff Stanwood for violating the liquor laws, and Elsie Marlet pleaded guilty and paid a $250 fine. Murphy. however, pleaded not guilty, and it was while the Marlet woman was sum moned as a witness for the prosedution at his trial that Deputy District Attor ney Metsker served the papers on her In the civil suit. The other 19 men to race against Smith will be named during the coming! week. Colonel Smith, who is 71 years of age. has been granted the courtesies of the Multnomah Amateur Athletic Club, and is working out each after noon on theh Wlnged-M track. The veteran Is in first-class shape. Ym terday three youngsters from the elub gave the veteran a lively tussle fof three miles, but the gray-haired war rior soon forged ahead, and the youngsters dropped out. The race will take place Wednesday, August II. at 3 o'clock, on Multnomah Field.
