Invalidating of 1915 Will, Accord ing to Attorneys, Will Give Es tate to Beneficiaries of Former Instrument. A bombshell was hurled Into the camp of both the beneficiaries and con testant of the Xarifa Jane Filing estate, yesterday when John F. Logan, chief counsel for the estate, introduced in evidence a will drawn and executed by Mrs. Faiing on Augrust 25. 1911. In this will Mrs. Faling: bequeathed a greater share of her estate to charity. In introducing a stenographer's tran script of the will, which Judge Tazwell permitted, Mr. Logan told the court that it was for the purpose of shutting off W. Tyler Smith, contestant, from any part of the estate for all time to come. Inasmuch as he is not named in the 1911 will, Mr. Smith cannot claim any portion of the estate under any condition, was the argument advanced by Mr. Logan. Baby Home Beneficiary. On the other hand, should the courts hold that the will signed in 1915, and which is now the subject of litigation, was made while Mrs. Faling was men tally unsound, it will mean that neither C. Lewis Mead nor Thomas N. Strong, chief beneficiaries, shall receive any portion of the estate. The $600,000 for tune left by Mrs. Faling will then re vert to those named in the 1911 will, it .was admitted by the attorneys. The chief beneficiary under this 1911 will is the Baby Home. "However, we still contend that Mrs. Kaling was possessed of all her mental faculties and in every way capable of executing that will in 1915 which Is now under contest," Mr. Logan declared. Testimony regarding the 1911 will was given by Alias Katherine O'Neil, who has been a stenographer in the law office of Thomas N. Strong for the past 23 years. Neither Mr. Strong nor Mr. Mead is named In the 1911 will, al though Mr. Strong is named as one of the executors. The testimony of Miss O'Neil likewise showed that there were six codicils to the 1911 will. Mr. Strong appears as executor. Six Codicils Executed. The first codicil was made October 6, 1911, and names Addison A. Lindsley and William E. Metzger as executors in case of Mr. Strong's death. The sec ond codicil was dated January 25, 1912, and removes Mr. Strong as executor and names W. N. Gatens, William E. Metz ger and Addison A. Lindsley as exe cutors. The third codicil, dated August 2, 1912, increases a legacy to Mr. Metz ger from $6500 to $10,000. The fourth codicil came October 4, 1912, and drops Judge Gatens as executor and names Mr. Metzger and Lot Q. Swetland as executors. The fifth codicil, dated Sep tember 30, 1913, drops Metzger and makes Judge Gatens and Mr. Swetland executors, with a bequest of $5000 to Mr. Swetland. The sixth codicil, dated June 5, 1914, decreases Mr. Metzger's legacy from $10,000 to $5000 and names A. L. Mills as sole executor. Mrs. Faling's changing attitude toward Mr. Metzger, then a young man whom she was educating at the Oregon Agricultural College, is said to be ex plained by the chagrin she felt when she learned that he was about to give up his education In order to be married. Other wills drawn by Mrs. Faling previous to that of August. 1911, are said to have exhibited the same chang ing temper with reference to legacies and executors. Dr. Smith Not Mentioned. In none of her wills and codicils did Mrs. Faling mention Dr. W. Tyler hmitn. the first cousin who is contest ing the last will, which ignored him and bequeathed her fortune to Mr. Mead and Mr. Strong. Attorneys for Mr. Mead and Mr. Strong said they Intro duced the contents of the will of Au gust. 1911, to show that Mrs. Faling had no desire to see her cousin receive any part of her wealth. Miss O'Neil and Dr. P. J. Wiley were the only witnesses called by the benefi ciaries yesterday. . Dr. Wiley treated Mrs. Faling for a bad cold In 1912. Both he and Miss O'Neil said Mrs. Faling had always impressed them as sane and as a sharp business woman. Hearing of the case will be resumed Monday. ORPHEUM SHOW MOVES WEEK'S BILL TO BE PLAYED AT ELEVENTH-STREET HOUSE. s i 5 I Temporary Change Made Necessary by Engagement of Ileitis ""Theater for Entire Week by Road Show. Owing to rental of the Heilig Theater for the entire week by a road produc tion the Orpheum show will be pre sented for three nights and four mati nees at the Eleventh-Street Playhouse next week. The first Orpheum show at the Eleventh-street theater will be staged tomorrow afternoon and the Orpheum show there will close with the Wednesday matinee. Season-ticket holders have been assigned seats in the Eleventh-Street Playhouse correspond ing with their seats at the Heilig. The Orpheum's move is only tempo rary as it will return to the Heilig Theater for the Madame Sarah Bern hardt engagement June 30, the closing show of the season. The seat sale for the entire Bernhardt engagement will be conducted from the Orpheum's box office at the Heilig Theater on the south side of the lobby. The window sale for the Bernhardt engagement will open tomorrow morning at 9 o'clock and the Orpheum ticket office will be open daily from 9 A. M. until 1J P. M. to accommodate patrons who desire to make reservations for the Bernhardt engagement. The Orpheum shows Monday and Tuesday nights at the Eleventh-Street Playhouse have been selected by the auxiliary of Company C, 116th Engi neers as benefit performances for their organization. Members of the auxiliary already have sold nearly 600 seats for the Monday-night show and the sale for Tuesday night Is promising. Stuart Maguire will sing as an act of the Orpheum show Monday night in behalf of the auxiliary and Jane Burns Albert will sing for the auxiliary Tuesday night. To assist the auxiliary In the sale of tickets the band of the G. M. Standi fer Construction Corporation at Van couver and North Portland has volun teered its services.
