Sen tence Passed Also Upheld. SALEM. May 28. (Special.) In af firming Circuit Judge Knowles, of Un ion County, in the appeal of Chong Ben, Won? One and Li Hung, Chief Justice McBride, of the Supreme Court today holds that Section 17, of an act of 1917. relating1 to paroles and indeterminate sentences, is void insofar as it en deavors to limit the right to parole. This section provided that the court ;ould not parole a -prisoner while his cause is on appeal to the Supreme Court. The case affirmed today developed in connection with the tone war, and the defendants were convicted on a charge of assault with intent to kill. Appellants contended that the sen tence passed was frong under the law of 1917, which changes the indetermi nate sentence law, but the court holds that the old law is still good as it re lates to crimes committed prior to the act of 1917 becoming effective. In the case of Thomas Malloy versus Marshall-Wells Hardware Company, Justice McCain ant, in reversing Circuit Judge Belt on appeal from Multnomah County, also decided a question relative to bills of exception which has been a moot one for some time. He holds that in the future all bills of exception which are filed under either of the forms prescribed by the act of 1913, covering such bills, will be regarded by the court as sufficient.
