Mr. Schwartz waa shown the 'statement of Mr. Heney to the effect that the pardon of Mr. Jones had been granted through tha aid of political In fluence and charging particular polltl 'cal activity on tha part of ex-Senator Fulton. -The fact of the matter is." said Mr. fichwarts. "that politics had absolutely nothing to do with the granting of the pardon. It Is further a fact that poi ltics had all to do In securing the conviction not only of Jones, but of Mays. Williamson, Mitchell. Hendricks and such other defendants aa were convicted. Senator Fulton seems to be abundantly able to take care or himself, but when Mr. Heney ennea vors to make It appear that Mr. Jones secured his pardon because of political considerations. It becomes necessary to give the public of Oregon a little direct Information showing not only how the conviction waa obtained, but alio how the pardon was procured. - "Mr. oJnes application for pardon came before tha President twice. It was presented to Mr. Taft by the At torney-Qeneral first In March. 1911. At that time there waa before the Presi dent no suggestion or charge that : there had been a deliberate manlpula . tion of the Federal Juries by Individ' nala connected with the prosecution and with the fritted Slates Court fot the district of Oregon. That matter was not then presented to the President, tor the simple reason thst Jones' at- . tornevs did not have proof or Jury rlarlng. although morally convinced of the true atate of facts. Tha matter submitted to the president on behalf of Mr. Jones In March, 1911. was such as usually comes up In pardon cases. being the official reports and rec ommendations of all officers having to da with the prosecution, together with petitions and letters of recom mendation from cltlsens of standing and character In the community In which Mr. Jones resides. Whatever . may be said In reference to political Indorsements ran apply only to that presentation. Absolutely no recommen dations or petitions by cltlsens were considered by tha President at the time the pardon was granted. The pardon waa finally granted be.cc.uae. In tha opinion of tha Department and tha President, the official recorda now on file In the Department support the charges made by Jones. The charges ' were, briefly: First, that false and highly prejudicial testimony had been given In the trials against him: sec ond, that witnesses were coerced and Intimidated by the Government officers Into testifying falsely; third, that the proaecuuQn i?iociea a jury wild po- 'Iltlcal bias and stuffed the Jury with men whom they had Interviewed and found were for the conviction of the Presides Make laveatlgatloa. "The President in his warrant of pardon recites that the commitment of Jonea had been postponed for tha pur pose of Investigating the truth of tha charges mad by him, and further re el tea that a careful investigation has , been made by the Department, and ' that as a result of such Investigation, It Is necessary, and he doea grant a full and unconditional pardon to Mr. Jones. In his letter directing the pardon to be prepared for his signature, tha President says that tha manipulation of the Jury box was tha moat high handed outrage that had ever come to his attention In his entire experience on tha Federal bench, and ha designates Heney and Burna by name, and ssys that their conduct waa reprehensible in tha extreme. "So far aa Mr. Heney's pretended be lief that Mr. Jones secured aid be cause of Senator Fulton's political strength, the fact of the matter Is that all tha politics connected with the Oregon land cases was tha political manipulations by which the convic tions were secured. Re publican party In tha State of Oregon, and a complete understanding and aympathetlo co-operation between the machinery of the Federal Court and tha office of tha Public Prosecutor, Heney. "That the people may Judge ronnem- selves whether the letters of recom mendation were of such a Republican political bias aa to Influence the Pres ident, I will mention tha more promi nent cltlsens of Oregon who addressed communications to the President rec ommending that a pardon be granted to Mr. Jones. I wish to add, however, that these letters were only considered In March. 111, at tha time the Presi dent ordered that eight months be stricken on the prison sentences Im posed upon Mr. Jones. The following recommended a complete paraon: uov- raor Oswald West. Democrat; senator Chamberlain. Democrat: -Unltea States Senators Simon and Fulton, Re publicans; Senator Bourne, antl-Taft Republican: Congressman Lafferty. In surgent Reoubllcan: es-Govemor Bow. erman. Republican; Circuit Judge Hunt, the trial Judge: Editor jacaaon, or mo Democratic Evening Journal. These reDresent tha extent of the Indorse ments front eminent parsons having romlnent political character. There were other indorsements from nersons not In political Ufa. United States Attorney McCourt and Assistant Attorney-General Townsend recom mended that tha Imprisonment part of tha sentences be remitted upon condi tion that Mr. Jones pay tha fines and admit a civil liability for certain lands be subsequently purchased from entry men Who acquired title. Francia J. Heney had the sentence In one caae changed from one year In tha peniten tiary to four months In the County Jail, and recommended to tha President that the sentence of eight months In the second case be reduced to four months. President Taft. acting upon these let ters of recommendation. In March, 1(11, nd assuming that Jones had had a fair trial, and hence must necessarily have been presumed guilty, at least -tech- Irally, followed tha recommendation f Heney, and directed that the two- sentences be reduced to a single sen tence of four months. Tickets purchased for the Wednes day performance, which waa postponed out of courtesy to the Rose Festival, will be. exchanged for the best tickets available for Friday night or will be exchanged for cash, at the option of tha bolder. Approximately 28.000 per sons saw the two performances of "The Bridge of the Gods." There was no mora commendable feature than tha magnificent scenery, which transported the spectators to the foot of Ut Hood, with the Columbia River just In the foreground and the old mountain, once a volcano., clove behind. Tha performance Friday will Inter fere In no way with the programme of the Rose Festival, and George Hutchtn, manager of the Festival, last night de clared that the plan of putting on "The Bridge of the Gods'' for a final per formance had the thorough approval of the association.
