Blum, an Incompetent, against the Leonard Construction Company. In denying the nonsuit Judge W.olverton announced that he would cover the matters raised by tbe defendant In his Instructions to the Jury. The suit Is to recover 150.000 for personal I Juries that are alleged to be of permanent character. Blum was placed on the stand to tell how the accident occurred but proved to be such a nervous wreck ava to be Incompetent to testify. Jacob Levttt Not Maw Fined. Mayor Rushlight and the members of the City Council and the Executive Board have been officially Invited to attend the ceremonies of rose-planting day, February 22, at 3 P. M.. In the City Park. Reports that many children attend ing the Shaver School In Lower Alblna are not properly nourished and come to tbe school pale and weak are pro nounced without foundation by Prin cipal Spiers, iter. Albert KhrgotU of the East Side Baptlat Church, said at the tost Side business Men's Club luncheon on Monday that he had been Informed that many of the children are underfed, and aaked the club to tn- veatlgate. "I know that there la no foundation for these reports." said Principal Spiers yesterday. but of course there are poor families whose children attend the Shaver, aa they do all the public schools, but the teachers and myself have kept cloae watch of the children here, especially since this statement was made, and have failed to find any foundation for the reports. We would know If there was any such general condition among the children, as tha teachers keep In close touch with af fairs. Wolf, prisoners at the City Jail, failed to bold up the bank of Ashley A Rumelln, at Second nd Stark streets, said Young. In giving his testimony In the Municipal Court yesterday. The prisoner Is only 17 years old. while his companion is mature and a Socialist agitator. Wolf worked upon the boy, he says. by Inveighing against the conditions which made It useless for a man to tr- to make an honest living. The lad, whoso parents live In St. Johns, had been lodging with a brother at First and Market streets. He fell In with Wolf and became a convert to his Industrial Ideas. Wolf then pro posed, he said, that they rob the bank, and they pooled their money to buy revolver. Young was to go In first. ask to have a check cashed and then present the weapon, commanding all those in the bank to lie down on the floor. Wolf was then to enter, gather up all the money in sight, and flee, leaving Young to cover his escape and back out later. The coup was to have been made Saturday, but tha conspirators were asleep until too late. Yesterday they were to hnve carried it out, but Young became frightened. Then Patrolman Cameron arrested him for carrying a concealed weapon, and his statements led to the arrest of Wolf. The older prisoner was defended In I the Municipal Court by a aoap-boz orator who was a candidate for Muni cipal Judge at the laat election. The court ruled that In the future these advocates who are not attorneys will not be allowed to plead cases. Wolf was sentenced to serve six months. Young was turned over to the Juvenile Court.
