When the Circuit Court convened here October 1? several Important cases were placed before tne grand Jury. The prin cipal one waa the murder of Jack Barry, a bartender, who la said to have been shot by l-ouls Vevasade. a sheepman, in Hart's saloon here latst August. The tragedy followed a quarrel over die and a sulorHit wrestling bout. Veyssade la represented by Attorney Conn, of Lakevlew. and the state by rrocu tin Attorney Kuykendall. of Klamath Kails. Attorney Webster, of ivv-tland. and Attorney Batchekier, of I-akevteW. Another case Is that of Bernard Kuhl. who Is accused of stealing horses and mules from Mr. Brewer, a rancher of S;lvrr Lak. Kuhl and his alleged ac omi-llce. Do Moss, bad homesteads In that aectlon. Brewer discovered tha loss of his etork and accompanied by four of his neighbors started tn pursuit. At the Klamath reservation tbey secured the aid of two Indian guides, who traced Kuhl and De Moss to tha Callahan ranch. 1J miles northwest of Dairy. Th horses and mules were found grazing In a near by pasture, while th mea were camped some distance away. Dt Moaa arose tar. lv to look after the horses and was shot through the ceart by Brewer. Crlppen on tha witness stand today In his own defense and th opening statement of hi coun ael. tha direction to be taken by the efTort to free Crlppen from the charge of murdering his wife. Bella Elmore, became known for th first time. It became known also that the de fense will endeavor to prove positively that the body found In Crlppen 's home wss not that of his wife. Mr. Tobln. the lawyer for the de fense. contended that the prosecution's assertion that a desire for money and tha wish to marry Kthel Clare Lenevo formed a motlv for tha murder was untenable. Crlppen, he said, owed nothing, and he had not married MJss Leneve. sine th dlsapearance of hia wife, although he had had a chance to do so. Absence of Weapon Noted. No purchase of lime. In which the parts bad been burled, had been traced to Crlppen. nor had a weapon with which th deed could be connected been found. Counsel said that the prisoner's dally demeanor sine Febru ary 1, the dat of hia wife's disappear ance, and the absence of an appear ance of haunting care, disproved th theory that he waa a murderer. Mr. Tobln said that Belle Elmore had threatened frequently to leave ber husband and at last carried out ber threat. Who knew, ha asked, whether Bell Elinor was alive or dead? Th Jury, however, must know before It could condemn a man to death. The defense Insisted that It was per fectly natural that Crlppen should take flight In th company of Miss Leneve. and both In disguise, when he reallsej that the lies which h bad told to cover up th scandal of his wife's de parture had served only to create a mountain of prejudice against him. Mr. Tobln then made the surprising state ment that Crlppen two days before his arrest on the stesmer Montrose arranged with th quartermaster to hide blm In the cargo and to land him in the night time at Quebec Prisoner Calm on Stand. Crlppen leaned against the rail of the box In a characteristic easy atti tude, and gave hie testimony In a steady, clear and calm voice. He told of the gradual alienation of his wife's affections antil th climax waa reached In a quarrel on th night of January tl last. His wife. . he said, had accused him of lack of attention to Mr. and Mrs. Martlnettl. who had spent the evening with them. They quarreled and on the following day his wife went away. Ha bore out his counsel's state ment of an alleged plot which he had formed to escape from the steamer ieontrose. He said the quartermaster had told him the captain had recognized him and Miss I-eneve and that he was to be arrested when the steamer landed. The quartermaster offered to make a splash In the water during the night, when Crlppen was to pretend to com mit suicide. The quartermaster had told him there was no charge against Miss Leneve, and he planned to sep arate from her for a time and Join her later. Th case for the prosecution was closed with the testimony of Drs. Mar shall and Spilabury, who examined the parta of the body unearthed In tbe Crlppen house. The cross-examination was technical and was directed to an ndeavor to prove that an alleged scar waa only a fold In the skin. Harry Rhelnstrom, Edna's husband, has returned to a sanitarium in Oakland where lie says he is going to stay until he Is cured, as the pace he has led has broken down his' health., and only re centlv he was arrested on the street of Oakland on account of his apparent Insanity. Corporations Pay Tax Willingly. WASHINGTON, Oct. 20. Virtually all of the corporation tax. aggregating in excess of $27,000,000, has been collected by the Treasury Department. Officials say it was collected with less annoyance and was paid apparently with less re luctance than other Internal revenue taxes.
