OWN SON AGAINST HIM Ei-Commissloncr to Show Mays, Jones and Smith Opposed His Can didacy Fifth Week of Trial Begins With Today's Session. The fifth and proTbly the closing- week of the trial of BiiiRer Hermann -will open In the United States Court this morning with an endeavor on the part of Attorney Heney to break down the defense by the introduction of rebuttal testimony. The Government will call Harry J. Brown, correspondent for The Oregonian at "Waahlnsfton. who will be followed by H. W. Scott. Attorney Heney desires to eroew examine Mr. Scott at length and It la understood the investigation will embrace the articles concerning land frauds pnbllBhed from time to time from 1900 to 1S02, when the Blue Mountain tforeat reserve was created. Mr. Brown, it is believed, will be asked o tell the Jury of the method by which Jie obtained inside information from the office of the Commissioner of the Qen ; exal Land Office concerning: the forma tion of forest reserves. Hermann announced last night that the oefenee would make use of the volumes of the proceedings of the Legislature of 1903. introduced by Attorney Heney, In an attempt to tear down the theory ad vanced by the Government that Hermann wm to receive the Senatorshlp from Ore- con as his reward for assisting- Mays, Jones and Smith In the formation, of the Shie Mountain reserve. Only Ambition Alleged. In his opening statement. Attorney Heney announced that the prosecution would not contend that Hermann re ceived any monetary consideration for Ills alleged aid of school land conspir ators, but would show that Mays, Jones and Smith were all mem-berg of the Leg islature which was charged with the elec tion of a Senator In 1903 . and that the circumstances would warrant the infer ence that there was an understanding be tween Hermann and those three men. Heney made strong us? of the Brownell letters in support of this theory, in an endeavor to show that Brownell under took to manage the campaign of Her mann, who was a receptive candidate, but who desired to be sprung as the dark horse in case of a deadlock. Heney con tends that the ambition of Hermann to wear the toga caused the defendant to neglect which might have put an end to the land frauds In Oregon. Son Voted- for Fulton. Hermann asserts that the proceedings of the Oregon legislature of 1903 will show that his son. S. B. Hermann, was a member from Coos County and that the young man at no time voted for Hermann. Sr., for the Senatorshlp. Her mann received 1- voten for the place at one time, but the number did not include a vole from Coos County. Young Her mann voted for Fulton every time. "I was for Fulton in 1903 as long as there was a chance for his success," said Hermann, Sr., yesterday, "and at ho time did T ask my son to either work or vote for me. I advised him to stay with Ful ton." Just how the testimony- will be pre sented to the jury was not announced, but it is believed that this evidence and the fact that neither Mays. Jones jtor Smith voted for Hermann will offset the evidence of the Government as to the political, 'interest which Hermann is al leged to have had in the Blue Mountain case. Jleney to Close Today. Attorney Heney says he will close the government's case not later than noon today, and that he will be ready to be gin the opening argument asking a conviction upon the evidence submit ted. The rule of the United States Court as to not indicating what instructions the presiding Judge will give the Jury un til after the argument shall have been concluded, will be set aside in the Her mann case. The instructions will be Agreed upon between the court and the attorneys in chambers before the speeches begin. The procedure is an adoption of the practice of the courts of the restrict of Columbia. Its elect will be that the attorneys will under stand the rules of law to be given the j Jury later, and can avoid references j which may be misleading or confusing to the Jury. Sunday was not altogether a ouiet day among the attorneys engaged in the famous trial. Attorney Heney was busy with his stenographers and assist ants in preparation for his last day of evidence and in drawing up the instruc tions to be submitted to the court. Attorney Worthington visited tile grolf links and later, assisted by Attor ney Gearln, a draft of the instructions they will ask of the court was made ready. Hermann passed the day with mem bers of his family and in receiving a number of callers at his rooms in the Imperial Hotel. Hermann spoke hope fully of the otiteonie of the trial. ta Grande Gets Kire Hose. LA GRANDE, Or., Feb. 6. The dlsturbanre noted yesterday evening is still at sea and this evening it appears to be approaching the coast near Northern California. No high winds have occurred on the Oregon or Washington Coasts and the warnings at Cape Flattery and at the mouth of the Columbia River were ordered down early this morning.
