HE DISPUTES MAP'S LINES Accused Man Declares He Did Not Know of Barrier Until After In dictment Was Found Spe cial Agents Recalled. Insisting that he had never fenced any Government land, and had always op posed on principle the Inclosing of the public domain. William Hanlej . the bin ranchman of Burns, went on the stand yesterday in the Federal Court a a wit ness in his own behalf. Not only did Han ley deny knowledge that the French Glenn fences effectually Inclosed Govern ment land, but directly disputed the ac curacy of witnesses as to the effective ness of the rimrock barrier on the west of the tract. He declared witnesses who said they could see the rimrock from the road at the base were mistaken, and. In fact, he disputed the claim that there was a continuous rimrock on the west, as shown by the map submitted in evi dence by the Government. Mr. Hanley testified h was oom in Ttofrue River Valley, and had a-nne to Harney County in 1X79. Two ranches there the "Bell A" and the Trouble O" are controlled by the William Hanley Company. These ranches are not in cluded in the land alleged to be inclosed by the fences of the French-Glenn Com pany or its successor, the Harney Valley levelopment Company. His first connection with the manage ment of the latter tract, he said, began in April. 1P07. and he had never Inspected the fences or rimrock barrier until after the preliminary information had been filed, against him. He and his partner. M. K. Parsons, of Salt I-ake. he said, had contracted for the cattle on tbis prop erty In 1S"S. The land Itself had been and is now for sale. There was no occasion for maintaining fences around the graz ing lands mentioned in the Government indictment, he declared, as the deeded land was not maintaining more than So per cent of the number of cattle of which It was capable. Cattle were maintained there, he said, to provide a temporary in come from the property pending Its sale. Thought Fence Open. "I never knew that there was a fence or a pretense of a fence on the west side of the Government land until the indictment was found." he said. "1 had understood there was a fence along the eastern row "of deeded forties, but understood that It was open so that stock could pass to and fro. I never ordered it kept tight was satisfied and knew it never was kept tight." Mr. Hanley also detailed a conversation already repeated by other witnesses, which he had had with Inspector Stoner in October. "I said to him." testified Hanley. " "Mr. Stoner. I suppose you have heard of the open and notorious fences of the French Glenn property? 1 understood they have not been kept up. but if you want to go over them at any time I will go with you, and if you are dissatisfied I will make them right." Mr. Stoner replied: 'Mr. Hanley, if all the men In this country were like you, there would be no need for so many Government agents." " Mr. Hanley declared he never knew there was any question about the fences until he read of his indictment and was served with papers in the case. He fur ther said he did not know of the change in- policy of the Ltnd Department, which dispensed with the former custom of no tifying the owners of offending fences to remove them. PEDDLER LICENSE CONTESTED Salt Affecting Buggy Business in Federal Court. Unconstitutionality of the act of 1908 by the Oregon legislature licensing and regulating peddlers is asserted In an ap plication for a writ of habeas corpus filed by John Martin in the United States Court yesterday. , Martin is an agent for the Spaulding Manufacturing Company, of Grlnnell, Iowa, manufacturers of bugg'.es. wagons and other vehicles. He alleges In hls ap plication that he is engaged in selling vehicles from samples and that on May 27 , he was arrested by Constable Iyu Wagner on a charge of violating the new statute. The complaint filed against him shows that on May 26 he sold a bug gy to John Duley. of Multnomah County, and did not possess a license In accord ance with the requirements- of the law. The principal attack itpnn the law is that it is in contravention of article 1. section S. of the United States Constitu tion, reserving to the Government the right to regulate interstate commerce.
