Sweeny Says His Lower Bid Would Be Carried Out In Good Faith Warren Firm to Ira- .. prove Fourteenth. Contracts for paving 36 blocks in Holla ' flay Addition at a cost of approximately S0.0C0 were given to the Hassam Paving Company by the afreet committee of the Executive Board yesterday. This award was made over the vigorous opposition of S. B. Huston, counsel for J. W. Sweeny, who had submitted a lower bid for the same improvement. Sweeny had submitted a bid of Jl-78 a square yard, while the bid of the Hassam people was 1.90. Attorney Huston demanded that the committee award the contract to his client, who. he said, was prepared to lay the same quality of pavement that was called for under the specifications. He insisted that Sweeny was acting In good faith and, if he received the contract, would pay the owners of the patented article a fair royalty for the privilege of using their patent. -- Georire Hyland and G. W. Stapleton. representing the Ha-sam people, insisted that their companj should receive the contract, for the reason that 90 per cent of the interested property-ownprs wanted that company to -perform the contract. They intimated that Sweeny was acting in bad faith and charged that he was seeking the work on a lower bid prlncl ' pally to freeze the Hassam Company out of the local field. In awarding the contract to the Hassam Company the members of the committee apparently questioned the motives of Sweeny. In answer to questions from Mayor Iane. Attorney Huston admitted , that his client had entered no negotia tions with the Hassam people by which ; be could acquire the right to use the patented article. In addressing the com mittee yesterday. Attorney Huston de clared that it made no difference which of the two bidders should receive the contract, the action of the committee un doubtedly would be. taken into the courts. In support of his contention that Sweeny should get the work. Attorney Huston cited court decisions. Including that re cently returned by Judge Gantenbeln In which it was held that an independent candidate had the right to bid on a con tract even though Its performance in volved the use of a patented article The streets to be improved and in cluded In the contracts awarded to the Ha-sam people are: Clackamas from Kast Seventh to East Fifteenth; Mult nomah, from Grand avenue to East Twenty-flrst: East Twelfth, from Holla day to Halsey; East Seventeenth, from f-lackamas to Broadway, and East Tam Jilll from East Thirty-third to East Thirty-ninth. 1 Two contracts for street Improvements were also awarded to the Warren Con struction Company, as follows: Sixth street, from Irving to Hoyt. and Four teenth, from Jefferson to Gllsan. For the latter contract the company Is to receive The Barber Asphalt Company was awarded the contract for repeating Star street, between Second and Third, for .1429.03. Exposition. June 1. U. P. LETS BRIDGE WORK Steel and Wooden Structure Will Soon Span Chehalls River. ABERDEEN". Wash," May 20. (Spe cial.) Contract for the first bridge to be built for the Union Pacific Railway Company on its Grays Harbor branch has been awarded to the Vulcan Iron " orks Company. It will be a steel and wooden combination bridge of five spans, and is described as an overhead structure, two other lines of railway running underneath. He gave ail honor to organizations like the Salvation Army, the T. M. C. A- and the T. W. C. A., which were not willing- to wait for the church, but went out to the poor and sick with hospitals and asylums, but tie declared their existence "an awful rebuke to the organized church of Jesus Christ. The church ought to have dons what the Salvation Army did." He: then dwelt on the resources of the church for doing this work. These were of great array of material re sources, modern means of communica tion which made the cities of the world one great metropolis and the men and women In the ranks of the church having- the potency for world conquest. Klectlon of Committees. After the election of moderator, the selection of standing committees was taken up. There are SI of these and they are being changed for the first time under the new election district system, and each district caucus nomi nates its candidates for committee membership. Heretofore the selections have been made by the moderator. One of the features of the assembly Is the presence of Rev. John Standing Buffalo, a Sioux Indian, of the South Dakota synod. K. Coman. assistant general freight agent of the road, and K. W. (Jalnes. who has been working to secure a redac tion in the rates. C. A. Spencer, attorney for the road. Introduced In evidence a copy of a contract which (Jalnes made with hun dreds of Eastern Oregon farmers, by which Gaines agreed to agitate the question of lower rates and the farm ers agreed to pay him half the amount of any reduction secured on all the salable wheat they had for the year In which such reduction became op erative. Spencer claimed there la no complaint from the farmers regarding the rates and that the only complaint Is from Gaines, who has a pecuniary interest In seeing th rales reduced. Ten days' time was allowed for the Introduction of certain other testi mony not submitted today, after which the matter will be taken under advise ment by the commission. Contrary to expectations, there were no developments here today In the Kstacada squabble over the recall election that was held there last Saturday. It waa expected that the Reed, faction wonld file an appli cation for a writ of mandamus to compel Mayor Heylman and the Council men to relinquish their offices, but not a move was maae. City Attorney Rartlett was here today and stated that the Heylman people had cards up their sleeve that would be played If mandamus proceedings were Instituted. Recorder Johnson is also Postmaster of Kstacada, and there Is a question as to his legal right to hold both offices. HERVE NOW OUT OF DANGER Survivor of Gates Duel Will Be Ready for Trial In July.
