JONES IS HIT AGAIN Sheriff Levies Upon Barber Shops Being Boycotted. DEPUTIES ARE IN CHARGE Will Take Over Dally Receipt o Satisfy Judgment Obtained Two Yearn A Rr Boycott Injnnctlon Still Under Advisement. More trouble fell to the lot of TTH Itsm O. Jones, the .barber who is belns boycotted by the union, yesterday after noon, when Sheriff Stevens deputies lev led upon Jones' two shops, executing a Judgment obtained against Jones In the Circuit Court two years ago. Keepers appointed by the Sheriff are now In charge of both shops, and all receipts will (to to satisfy the Judgment. Two years un TV. L. Morgan brought suit, through his attorney. W. B. Huf fnrd. to obtain from Jones and Alvin A. Muck. t::S. and 10 per cent Interest for two years. The case went In Morgan's favor, but he never collected from Jones and Murk, and the Sheriff was not asked to levy upon their property. But unless the defendants now put up a bond and satisfies this Judgment, the SherlfT may bo called upon to sell enough of their tools and goods to cover the amount. For the present, however, the plaintiff Is sat isfied to accept the dally receipts, there by permitting Jones still to conduct his shops. Judge Oantenbetn. In the Circuit Caurt. took under advisement yesterday after noon the case In which Jones Is seeking a permanent Injunction, restraining the local barbers union from continuing its boycott and picketing. Arguments upon the question were concluded before the court yesterday afternoon by Attornys ius C. Moser. for the defendant union, and W. C. Bristol and Martin Watrous for the plaintiff. Combating the conten tion of Jones' attorneys that union pick ets called the Jones -establishment e 'scab shop." Mr. Moser said that on one occasion Mr. Jones himself appeared it the door of one of his shops and shouted to a crowd which had gathered: "Yes. boys, this is a 'scab' shop. Come on In and get shaved." or a similar ex pression. Mr. Moser also read from The Ore gonlan of October 11. the report of the decision rendered In the Illinois 1'nlted Ftatps Court of Appeals. In which the court held picketing to be lawful. Coun sel for Jones contended, however, that the present issue differs from that raised in the Chicago case. CASE OF Lri BEFORE COURT Gantenbeln to Decide Status of Al leged Lunatic From California. Whether or not Lewis A. Lux shall be returned in charge of an attendant to the Napa State Hospital for the Insane at Napa, Cal., taken to the asylum at Salem or given his liberty, will be de cided by Presiding Judge Gantenbeln tn the Circuit Court this afternoon. Dr. Johnson examined the man yesterday noon and reported to tha court -during the afternoon that Lux Is fit to be at large If be Is cared for by friends-. The physician said the man Is ill and unable to work. Lux recently escaped from the Napa asylum, where he had been Incarcerated because he imagined that ho was Jesus Christ. Attorneys John F. Logan and John H. Stevenson argued yesterday morning that the man cannot be taken to California, because the court records there of the man's commitment are in complete. In case Judge Gantenbein de cides to return him to that state, Lux'a attorneys will probably appeal to the Supreme Court. MOTHER OF SEVEX A FLIRT Alienation or Affections Suit Also Brought by Her Husband. it was after seven children had been born to her that Mm. Josephine Noyes betan a flirtation with a neighbor which "r.aa brought about an abundance of liti gation, according to the various charges and counter-charges being made in the trctiit Court. Her husband. Albert J. Noyes, is suing her for a divorce, and at the same time is suing; George Sollers for $10,000 for alienating his wife's af lecttona. Mrs. Noyes. through her attorney, filed an answer to her husband's compalnt yesterday, admitting that she wrote love letters to Sollers. but she did it merely as a joke, she says. She also declared in the oomplaint that after her husband bad "pestered and tantalised her until she went into a fit of righteous Indentation" she admitted to him that she did love eoller. She asks for a decree of di vorce, in addition to 13 a month ali mony for her own support. $1000 for the support of three of their seven children, together with their custody, and the Twnerhlp of the home at Kenllworth. Bo l'.n owes him $3-00 on a land deal. It Is charged that Bolln agreed to pay $5 an acre as a location fee. He after ward secured C. H. Maginnls and John Pearson, it Is alleged, to file claims on 640 acres, worth SM00. Rose L. Hathaway has filed suit In the Circuit Court against Alex Sweek to recover $T60 and $100 attorney's fee, on a $1150 promissory note. The Bernhard Pape estate has been appraised by O. P. Miller. R. L. Zelier and O. O. Barlow at $27,225. The re port was filed in the County Court yes terday. Mrs. Martha A. Hoyt's will, filed in the County Court yesterday, leaves to Martha A. Hoyt. a daughter, all but $200 of an estate valued at $80,000. G. W. Hovt. a son. is to receive $100. and Mrs. Francis Hoyt Lewis $100. Ward Robertson, alias John Robblns, was arrested yesterday and held in the Justice Court on $1600 ball for polygamy. He was lodged in the County Jail. John William Huggtns. chsrged with assaulting S. O. Vlken wtth a knife Au gust 29. was released yesterday afternoon on $1000 bail. His bondsmen are David K. Huggtns and Mack Hugglns.
