Complying with the provisions of the will the executors have themselves taken over Louis Flelschner's interest In the wholesale dry goods firm of Fleischner. Mayer & Co. This at the time of his death, was worth $180,000. Cannot Sell Valuable Corner. The will provides that the executor hold tha real and personal property in trust to be sold at such times aa they think best. The exceptions to this pro vision are that they shall not sell the three lots at the northeast corner of Third and Morrison streets, nor the In terest of the deceased in the dry goods Arm. They were to hold all the real estate, except such as was unproduc tive, and when the unproductive land was sold It was only to be for the purpose of paying debts, or of making Improvements on other property. The final account shows that all the personal property except seven shares of stock In the Portland Hotel Com ' pany, and the furniture belonging to the Fleischner residence, has been con verted Into cash. Besides the $22,045.02 cash now held by the executors, there is unsold real . property belonging to the estate, as follows: The block bounded by Seventh, Park, Ealmon and Main streets, except the ' west hnlf of lots 7 and 8; lots 12, 13 and . 14. block 11, North Portland, on Wil son street, opposite the Chapman School; half of lot 8, block 10, Couch Addition, at the southwest corner of Front and Burnside streets; a third interest In 160 acres In section 8, town ship 1 south of range l east, southwest of Portland; a half Interest In 47 acres . In section 17, township 1 south of range 1 east, also southwest of Portland. Lots Now Vnder Contract. Besides this property-, there are the ! three lots at Third and Morrison, and . SR5 acres In section 20 and 29, town . ship 1 north of range 2 east. The real estate firm of Hartman Thompson is '; under contract to sell the latter at $500 : an acre. A portion of the tract has ' already been laid out In Rose City Park, Belle Crest and North Belle Crest. The executors state that the amount which will be received from the sale of the balance Is uncertain. The will provides that Jacob Fleisch ner, brother of the deceased, receive $250 a month for life. This has been paid to the present time, according to the executors' report. The three nieces, Llllle. Gertie and Belle Schwarta were to receive $50 a month aa long as they remained unmarried and lived together. As they have all married, the monthly payments to them have ceased. To his five nephews and nieces, Llllle, Oertle, Belle. Louis and Isaac Schwartz, Mr. Fleischner bequeathed $10,000 each, to be paid 12 years after his death. These amounts have been paid, accord ing to the executors' report. Morritx : Schwarti. who was cut off with only ; $100, has not received the money, as . the executors do not know his where - about. Residue Goes to Five Heirs. According to the provisions of the t will the balance of the property is to : be divided equally between the fol lowing nephews and nieces: I. N. Fleischner, Marcus Fleischner, Emma Goldsmith. Llllle Davis. Hattle Blu mauer and Minnie Fleischner. They are also to have a life estate In the property at Third and Morrison streets, but this may not be sold. It is to go to their children at their death. Min nie Fleischner died unmarried after the will was made, so that her portion will be divided equally among her brothers and slaters. The First Hebrew Benevolent Society will receive 15 acres of land In the northeast portion . of the southwest quarter of section 20, township 1 north of range i east, east of Portland, for the erection of a hospital or a home. The will provides that the executors elect a suitable tract of this size for a hospital, orphan home or home for indigent aged persons. From the personal property ap praised at $14,689.88 the executors realised $18,161.61. The present value of the real property.appralsed 12 years ago at $583,750, is not given. A part of It has since been sold. WILXJXG TO SEIX FOR $10 Widow Seeks Order from Court to Dispose of Mining Claims. The mining properties near Nome, Alaska, belonging to the estate of Free man B. Xhxg-g-ett will be sold for $10 If tha County Court Issues an order in ac- cordance with the petition of Marie E. Zaggett, the executrix, filed yesterday. She states that as the value of these properties is unknown, and P. A. Mc pherson has offered $10 for them, she deems it wise to sell at that figure. Daggett formerly had an Interest In the Golden Oats Hotel, at Nome, but the ex ecutrix states that a Nome attorney has investigated and found that this Interest was sold before Daggett died. Daggett also held an eighth Interest In five tracts of 190 acres on the Snake River, In the Cape Nome Mining District. 15 miles from Nome. A fourth of this Interest was transferred to R. Reed for prospecting the estate, and a half of the remainder was given to R- W. Bowan for staking and caring for the property, so that the- es state's interest In this land is now three-sixty-fourths. It also holds an eighth Interest In four lao-acre tracts between Oeborn and St. Michaels, Alaska. C A. Dunn Sued on Note. Chester V. M Stevens Company, to answer ques tions under oath regarding Mr. Stevens' holdings of stock. With this In view A. E. Clark, attorney for Mrs. Stevens, filed with the clerk of the Court yester day two affidavits to show that there is sufficient cause upon which, to base such an order. Mrs. Stevens recently brought suit to recover $3000 from Stevens on the allega tion that be had failed In making pay ments on a contract, as ha had agreed. Upon this camplaint writs of attachment were issued August 11, end the Sheriff attempted to attach sufficient property belonging to Stevens to sausry me judg ment of the Court, should It be rendered In Mrs. Stevens' favor. Stevens was found to have no money in the bank which could be levied upon, and the Sher iff has been unable to obtain any of his property In the Portland Rice Milling Company or the T. M.
