THE MORNING OREGONIAN, THURSDAY, JULY 30, 190S. STREET ORATORS ESCAPE After Eloquent Appeal by C. E. S. Wood, Five Socialists Are Released. TECHNICAL ERROR FOUND Because Complaints Were Irregular, Case Falls and Main Contention, "Right of Free Speech," Is Xot Yet Settled. Portland Soclalints won their initial brush in the fight which they are waging for the privilege of converting public atreets and highways into meeting places. Municipal Judge Van Zante dismissed the cases against five spellbinders, yes terday afternoon, when they were taken Into court on charges of refusing to move Dn when so ordered by policemen. But the court's decision was based on a technical imperfection In the drawing up of the complaints against the quintette and In no wise touched upon the "in alienable right of free speech.' upon which basis the Socialists fought. So the end Is not yet and the police are de termined to break up the first street congestion caused by a Socialistic meet ing, and the City Attorney's office will make out new forms of complaints em bodying the wealth of legal verbiage which, so Judge Van Zante held, Is nec essary in the drawing up of all com plaints, no matter how insignificant the charge. Wood Comes to Kescue. C. K. S. Wood was on hand to repre sent the downtrodden public which task he performed with a show of high rlght eouB indignation and a profusion of ihet orlc. It is somewhat doubtful if the "public" would have had very much of a chance of escaping conviction but for Colonel Wood's masterly efforts. The "public" was represented by some 50 male Individuals, very few of whom gave any appearance of having been annoyed by talkative barbers these many days. The city, In its turn, was represented by Deputy City Attorney Sullivan, who con ducted the case under this ordinance. "Any person or persons who shall stand In or upon the Btreets or sidewalk within the limits of the city of Portland after being notified to move on by any police officer of said city, shall, upon convic tion thereof in the Municipal Court, be punished by fine not exceeding J10." The complaints in the case named A. LJoyd, James Jackson and K. C. Good win as (hose who had refused to "move on." H. Uoyd and E. L. Closset were charged with having interfered with the officers.- Sergeant Cole and two of his subordinates. The scene of trouble was Fourth and Alder, the time Sunday night and the cause of police action blockading of the street by the Socialist orators and their hearers. Moves to Dismiss) Case. Colonel Wood, whose services were given gratis, it is understood, because of the moral principle Involved, moved the immediate dismissal of these charges on the. grounds that facts sufficient to con stitute a cause of action had not been stated. . He then waxed eloquent on the subject of free speech. "I am not a Socialist," he said, "and have no sympathy with the Socialistic doctrine. But by the living gods I be lleve in the principle of free speech as one of the rights of the people under the laws of this Republic. "The streets and public highways have long been recognised as a place of public meeting." he continued. "In Enaiind to this day meetings are held free and un molested under the red flag. They are allowed free speech in that monarchy. They ought to expect it in this Republic. I say that when the streets are not in use for traffic they are open to the use of the public in meetings. The people who founded our constitution did not meet in rented halls but on the streets and the people who started the revolution assem bled In the streets to discuss their grlov ances. Takes Fling at Police. . 'The streets belong to the public, and not to the police or to the representatives of wealth and capital. The police have no right to interfere with public meetings which are being conducted In an orderly manner. "Take a good honest carpenter or use ful workman and put a blue coat on him." added Colonel Wood, indicating a knot of policemen in the courtroom, "and he seems to become Imbued with the idea that he is all-powerful. He seems to think he Is a Monarch a Czar. He is only a public servant a servant of the people. When a policeman taps a man on the shoulder and commands 'move on' he's an arbitrary tyrant. "Is this court going to take the position that because a policeman doesn't happen to like a certain man he can walk up to ' him on the street, tup him on the shoul der and order him to move on? He's not acting within the law. It Is not within the power of the legislature of this state or of the city to place such power in the hands of a police officer. Ordering a man to move on Is Interfering with his constitutional rights." Sullivan Reads Ordinance. Mr. Sullivan .read the ordinance and said that the streets could not be kept crowded from curb to curb to the detri ment of traffic whether by Socialists, democrats or Republicans. He said that while the complaints failed to particular ize as to the specific nature of the of fenses alleged, it was not necessary to make complaints complete in cases where no crime was charged. "This is not a civil action, therefore It must be criminal, since there are but the two classes under municipal government." said Colonel Wood. "If it is not neces ' sary to state the facts in a complaint, then the first thing we know a man can be held on a complaint charging that he 'committed the crime of murder' without going further into the nature of the crime. The complaints In these cases simply set . out that the dofendants 'refused to move on.' " Judge Aprees as to Error. 'I believe that the complaints should be . more definite and certain," said Judge Van Zante. "They can be amended." suggested Mr. Sullivan, but Colonel Wood protested bit terly. "The law cannot have two slaps at these men." he said. "They have been put to Inconvenience enough. The law has had its chance at them and failed." "I hardly think new complaints would be merited." said the court, which settled the matter.
