Counsel for the defense in the Booth Singleton conspiracy case yesterday laid the foundation on which they expect to Impeach the Government's principal wit ness, I. Thomas Agee. Dan J. Malarkey, in his cross-examination of Agee, gained the admission that Agee when confronted last Monday by Miss Myrtle Fitxwater, former clerk lh the Roseburg Land Of fice, told T. B. Neuhausen that he did not recognise her. The following afternoon at another meeting between Agee and Miss Fltzwater, the witness said he rec ognized the woman as the clerk before whom he made final proof prior to deed ing the land to the Bnoth-Kelly Lumber Company. Mr. Malarkey sought further to discredit the testimony of the witness by bringing out that Agee had made a number of entries, pertinent to the case. In a memorandum book In addition to those he had testified about on direct ex amination. The examination of Agee was practical ly completed yesterday, although United States Attorney McCourt reserved the privilege of recalling the witness when court convenes this morning. Mrs. Agee reached Portland last night from her home at Mapleton and will be a witness for the Government in assisting to ac count for the authorship of certain letters and signatures that have been submitted In evidence In the case. Court will ad journ over Bunday at noon today. Tries Patience of Court. Repeated prodding of Agee by Judge Wolverton failed materially to expedite the examination of the witness, who an swered the most simple question only after considerable hesitation, severely trying the patience of both counsel and the court. Judge Wolverton found it necessary repeatedly to rebuke the wit ness for his dilatory replies to questions. "You must answer questions with greater dispatch," said the court. "By your hesitation you are taking up a great deal of the time of the court. You can and must answer more rapidly." But even this admonition did not Improve - matters much and the examination of the witness continued at a Bnail-like pace all day. Agee proved an unusual witness, dis closing a memory or rather a lack of memory which perplexed those that heard him as much as oxaluria has excited the medical profession In Portland. He tes tified with reasonable accuracy and posl ttveness regarding events that happened from 13 to 15 years ago, while he professed no knowledge, of Incidents occurring be tween 1897 and 1303, the period during which the negotiations were conducted by which, he effected the exchange of his land within the forest reserve for the lieu land which he afterwards sold to the lumber company. - Letters Submitted to Jury. Counsel for defense produced several letters alleged to have passed between Agee and J. H. Shupe, now deceased. who served as his attorney in arranging for the exchange of the two tracts of land. Agee denied that he had written or signed or had caused to be written any of the letters produced by the de fense and relating to the transaction. He admitted that he never wrote any letters himself and that all of his correspondence was conducted by his wife, but he refused to Identify any of the communications as being the handwriting of Mrs. Agee. ' He did not remember ever having author ized or directed anybody to write the let ters that had been offered, although he did remember having talked with Shupe personally regarding the subject matter of the letters. At the opening of the afternoon session. Judge Wolverton denied the request of Mr. Malarkey to withdraw Agee from the witness stand in order to call Miss Minnie Shupe. daughter of the deceased lawyer, to prove the authenticity of the docu ments so that the witness could be fur ther cross-examined concerning the cor respondence. The court held that the witness had been examined sufficiently regarding the correspondence and that the request of connsel, If granted, could not expedite the examination. Contending that Mrs. Agee. judging from the admissions of Agee himself, had written the Agee-Shupe letters, Mr. Ma larkey secured the Introduction, over the objection of Mr. Becker, of all the letters that the Jury might .compare the hand writing with the signature of Mrs. Agee In the deed transferring the property and which was admitted by the Government to be Mrs. Agee's true signature. The signatures In the deed and the letters were quite similar. NO REPORT TILIXEXT WEEK Receiver of Title Guarantee & Trust Company Delayed. Impatient creditors of the defunct Title Guarantee & Trust Company will be obliged to wait probably another week before they can learn anything definite as to the condition of the bank's affaire and the amount of the initial div idend. Receiver R. S. Howard. Jr., had ex pected to complete bis report to Judge Wolverton so that It could be filed in the United States Court not later, than to day. Receiver Howard said yesterday that It would be Impossible for him to complete the report and submit it to the court before some time next week. A great amount of clerical work has been found to be necessary properly to present the actual condition of the bank's affairs to the' Federal Court. Until this has been done no dividend can be declared. Realizing the intense Interest of several hundred depositors In the forthcoming distribution of funds. Received Howard is proceeding with all reasonable haste to complete the report. A number of minor orders wer made by United States Judge Wolverton yes terday authorizing the sale by the re ceiver of considerable furniture and other fixtures Included In the personal property belonging to the bank. SPIRIT AWAY CHIEF WITNESS Evans Tells of Incident in Baker City Trial. Walter H. Evans. Assistant United States Attorney, returned yesterday from Baker City, where as representa tive of the Government he attended the preliminary examination of R. R. Iuffy and Ida Chase before the United State Commissioner. The couple had been, arrested on the request of the Federal authorities of Idaho on the charge of conducting a notorious re sort . near Payette and selling liquor at retail without procuring a Govern ment license. After the examination Duffy was discharged, but the woman was held to the grand jury under $1000 bonds. It Is probable that more serious charges will arise out of the facts sur rounding this case, according to Mr. Evans. It is alleged that on the night before the preliminary examination friends of the defendants invited one of the Government's principal wit nesses to "go out for a time." The young fellow was given a few drinks and then taken for an automobile ride. He was taken about 35 miles out in the country and, as he stepped out of the machine on the suggestion of his companions, the chauffeur started on the return trip, leaving the witness for the prosecution at 3 o'clock in the morning about 35 miles from Baker City, where he had been summoned to testify 'the same day. The witness walked all the way back to Baker City, reaching that place at 12 o'clock noon. He related his ex perience to the Assistant District At torney, who has instituted an Investi gation that may give the Incident a more serious aspect than the principal performers Imagined. DIAMOND CASE UP AUGUST S Clutes "Will Fight Extradition lor Trial in Canada. On application of Robert S. Bacon, member of the British Columbia De tective 'Service. United States Commis sioner Cannon yesterday Issued a war rant for the arrest and appearance be fore him of Myra Gleason, alias Lillian Clute, and her husband, Arthur Clute, who are wanted by the Canadian au thorities for diamond stealing. They were arraigned before Commissioner Cannon and resisting extradition pro ceedings without a hearing. August 3 was set for an Investigation of the case. This was necessary In order to give the witnesses in the case, many of whom reside at Vancouver, B. C, time to reach Portland. The bail of the ac cused was fixed at 32000 each, and the prisoners expect to furnleh the neces sary surety. The warrant Issued by Commissioner Cannon charged the defendants with the larceny of diamonds of the value of 11000 from Jacob Fleishman, of Vancouver, B. C. The alleged theft included the following articles: One diamond star, one diamond pendant and one diamond and pearl pin. PASS TIME BY SINGING HYMXS Jurors in Conspiracy Case While Away Tedious Hours. Members of the jury in the Booth-Singleton conspiracy case are making the best of a tedious and patlence-trylng in vestlgatlon that already has become monotonous alike to the jurors and to the large number of Interested spectators attending the proceedings. Among the 12 jurors are a number of good singers and much of the time between sessions of the court Is spent singing various hymns familiar to churchgoers. After listening for five hours each day to the unsuccessful attempt of counsel for the defense to have the Government's witness identify Important documents that have been offered In the case, the Jurors are glad of an opportunity for relaxation of any kind. "Nearer, My God, to Thee" and "Where Is My Wandering Boy Tonight" were two of the selections rendered during the noon recess yesterday. These sacred hymns were sung in a manner that dis counted the vocal efforts of the aver age church choir of equal membership. MRS. STEVENSON IS ILL Condition of Widow of Novelist Said to Be Serious. . SAN FRANCISCO, July 24. It is re ported that the condition of Mrs. Robert Louis Stevenson, who Is 111 at her home near Gilroy, Is regarded as serious by the attending physician.
