Donnelly Struck by Machine In Control of Citizen Who Is Taking First Lesson. J. H. Donrelly, a representative of the Pproenply Jewelry Company, ot Chicago. w!-.o has been stopping at the Portland Hotel for several days, was run down and Injured yesterday morning at 10:46 o'clock, as he was leaving the hostelry, by an automobile owned and driven by ex Vnlted States Senator Simon. With Mr. Simon In his automobile at the time of the accident was his chauffeur, Roy Har rington, who was teaching his employer the science of automobile manipulating. .Mr. Hmon was rounding his "first corner,-' when, at Sixth and Morrison strtets. his car struck Mr. Donnelly, knocking the latter down and throwing him under the wheels of the car. Mr. Donnelly was taken into a nearby drug-EV-re until an ambulance was summoned, when he was removed to the Good Sa maritan Hospital. At the hospital it was discovered that the injured man was suffering from a fractured arm and minor bruises. It is also believed that his collarbone Is broken. Mr. Simon says that he will La realtor practice on the country roads until he becomes a master of the automobile. MILLS START UP AGAIN Cottage Grove Appreciates Ruling of Commission. COTTAGE GROVE, Or., July 6. (Spe cial.) The recent rulings by the Inter state Commerce Commission upon the freight rates. Is proving to be a Btimulus to the milling and lumbering industry in this section, one of the heaviest tim bered and heaviest milled parts of the state. The mill men are now much en couraged, and feel that within the next 60 days conditions will be materially im proved. Already inquiries from heavy buyers ae coming in and some orders have been placed. This is of vital in terest Jo Cottage Grove, as the burden or her payroll depends upon the lumber Industry. Good Weather at Colvtlle. COLVILLE, Wash.. July 5. (Special.) Weather Observer Vi". L. Sax has issued his report of observations at the Colville station for June as follows: Average temperature. 79: maximum. 94. on the 24tli ; minimum, 31, on the 20th; precipita tion, 1.08 inches, which was .42 less than the usual amount for June. Clear days. 14; cloudy, 8: partly cloudy. 7. Light frost on the 20th. but practically no dam age from frost during the month. Additional Sleeper to Chicago. On Monday morning. T MAT ORDER PROSECUTION OF NOTTINGHAM DRgPPED. City Attorney Put In Embarrassing Position as Result' of Contro versy Over Special Permits. Does the City Council have authority to order the City Attorney to suspend proceedings for alleged violations of city ordinances? This question has been presented in the controversy be tween Building Inspector Dobson and State Senator Nottingham over the erection by the latter of a frame build ing inside the fire limits on the East Side. In the first place, the Council granted Mr. Nottingham a permit, which is ald to have been unlawful. Later, on com plaint of the Building Inspector. City Attorney Kavanaugh filed a complaint against Mr. Nottingham in the Munici pal Court. At Its meeting Friday the Council committee on health and police decided to recommend to the City Council at its meeting Wednesday that the further prosecution of the case against Mr. Nottingham be suspended. Mr. Kavanaugh has not been advised officially of the committee's action; neither has he been instructed to drop the suit. The report and recommenda tions of the committee on health and police are merely advisory to the Coun cil and it will not be until after the Council has Anally acted on the matter that the City Attorney will be advised. In the meantime, that official is Inves tigating the question to learn what right.- the Council has to dictate his course In the prosecution of such suits. It is expected that the report of the committee will be ratified by the Coun cil which will desire to approve Its original action In granting- the permit. It Is for that reason considerable inter est is taken In the discussion, which at best puts the City Attorney in an em barrassing dilemma. At the request of one of the city's .officials, be 'caused a complaint to be filed In the Municipal Court against Mr. Nottingham for vio lating one of the city's ordinances. The authority by which the right to violate the ordinance was extended to Mr. Not tingham now proposes to order the City Attorney not to prosecute the case. Mr. Kavanaugh said yesterday that he would make a thorough investigation of the ordinances of the city that he may be in a position Wednesday intelli gently to advise with the Council on the subject. Mayor France has - come out strongly against the building of more planked streets and has declared his Intention of refusing again to attach his signature to any resolution calling for a planked street. The Mayor says planked streets have helped the raillrnen, but kept the property owners "broke" putting them In and the city "broke" keeping them in repair. It has cost Aberdeen for planked streets $200,000 or $300,000 and yet today there Is not a permanently Improved thoroughfare in the community. Mayor France's pronunclamento -Is meeting the approval of the property owners. Home Burns to Gronnd. GARFIELD. Wash., July 5. (Special.) The residence of Jonas 'Crumbaker was MAKER or 231 WASHINGTON ST: PORTLAND ORCQ0N. MENS CLOTHES burned to the ground yesterday with the furniture and all wearing apparel of the family. Mr. Crumbaker's loss is $2500, with but a small insurance. It is not known how the fire originated. Mr. Crumbaker is a pioneer of Whitman County and senior partner in the Crura baker.
