ALL CASES UNCONTESTED Six Wives and One Husband Apply to Judge Cleland lor ' Relief From Galling Ties Two Complaints Filed. Ftva divorces were granted by Judge Cleland In the State Circuit Court yester day on the around of desertion, and two because of cruelty. All the cases went by default. Anna C. Heatley testified that Lloyd E. Heatley had a habit of stayins away from home until unseemly hours of the night. She said that on December 15. 1906, while he was clerking in a store che found him at 11:30 P. M. at the store in the company of a woman she had never seen before. She testified further that one day, while her husband was writing to his mother she suggested that it would be well if he would tell her that he had been drunk the night be fore. Mrs. Heatley said she was sitting on the bed at the time. Her husband grabbed the bottle of ink, she said, and threw it at her. In November. 1907. said Mrs. Heatley, her husband left her. and said in the presence of her mother that he was going to California, and would never live with her again. The couple married at Eanta Rosa, Cal.. February 16. 1906. Mrs. Heatley will resume her maiden name, Scott. Hose Labell secured a divorce from Frank Labell. Bh said he was in the habit of "kick ing her like a brute" whenever the fancy struck him. Once he even resorted to the razor strop to beat her. and at another time threw water in her face. She said the only way she could get money to pay household expenses was to "go through" his trousers pockets while ha was asleep. She was given the custody of the three children, ranging in ages from 13 to S years. The couple married in Multnomah County, December 6, 1S95. Bthelyn I Bennett secured a divorce from Alva W. Bennett bn the ground of desertion. Bhe said they married In Port land, July 18, 1905, and that he deserted her at San Diego, Cal., November 1, 1905. Then he Joined the Army, and deserted after four months. He was sent to the Government prison on Alcatrax Island, San Francisco Bay. Mrs. Bennett was permitted to resume her maiden name, Miller. Other divorces granted were as follows: Eva C. Lewis from Linton S. Lewis, married at Lewlston. Idaho, January 16, .1897. He deserted January 5, 1907. Ellen Ingman from Olaf Ingman; mar ried August 14. 1898; at Milwaukee, 'Wis.; deserted February 16, 1907. Nettle 'Walters from Robert A. "Walters: married April 22, 1901, at Ful ton; deserted December, 1905. TV. M. Winans from Blanche Winans; married April 11, 1906; deserted July 23, 1906. , HUSBAND DENIES .HARRUGE Emory Harpole Declares Wife's Sen sational Allegations Untrue. Not only does Emory Harpole deny that he ever treated Mrs. .Anna Harpole with cruelty, but even asserts that he was never married to her and that he Is not the father of her 8-year-old girl. Beryl. A motion has been filed In the Circuit Court by attorneys for Mrs. Har polo to compel him to pay $200 for the prosecution of the suit. Mrs. Harpole complaint alleges that her husband first treated her with cruelty and afterward deserted her. Sha asserts that they were married at Salem. April 25. 1899. and that he ordered her away from homo at Condon in No vember. 1908. She says Harpole la worth $4000. She has been compelled to work In a factory at $10 a week, she says, paying $14 a month to keep the child in St. Mary's Academy. TOOK TO DRIXK LATE IN MFE Godfried Itelsenzahn Sued for Di vorce After Many Tears. That her husband has, in the last year, contracted the habit of going on pro longed sprees is the allegation of Mary Reiwenzahn, in a suit for divorce from Godfried RelHonzahn, which was filed Ih the Circuit . Court yesterday. The couple were married in Kelberg. Ger many. In January, 1882, and moved to America two years later. In 1892 they came to Oregon. Mrs. Reisenzahn does not complain as to her husband's con duct before last year. She says she has been compelled to take in washing to support herself and that she is now em ployed as a laundress at St. Vincent's Hospital. The couple have three children living, one being married. The wife asks that she be decreed the owner of a one-third Interest in a 160-acre farm near Buxton, said to be worth $1000. besides being granted the custody of the children and $2000 permanent alimony. Emma Snheurer has filed suit In the Circutt Court to obtain a divorce from William Scheurer, whom she married February 27, 1901. She alleges that he deserted her November 11, 1906. TOBACCONISTS VIOLATE LAW Juvenile Court Judge Threatens the Indictment of Dealers Five cases In which dealers were ac cused of having sold tobacco, principally cigarettes, to minors have come before the Juvenile Court during the last week; Judge Gantenbein says that the cases of children smoking are becoming . so com mon that something must be done to put a stop to it, and that the quickest way to do this Is to indict the tobacco-dealers. The state law covering this point is ex plicit. It reads as follows: It shall be unlawful to sell, barter, trade, Blve. or In any manner furnish to any minor under the ae of 18 year, any tobacco, c-lgara or cigarettes in any form, or any compound In which tobacco forma & com ponent part, without the written consent or order of such minor's parent or guardian: and whan such minor has no paren-t or guardian, then In that case content may be given by the County Court, sluing for th transaction of such county business, upon proper application In the county In which aid minor may have his residence. Any per son violating the provisions of this act snarl, upon conviction, be fined in any sum not less than (5 nor more than $50. The ease is important, as the question of whether or not the referendum can be invoked against city ordinances is in volved In the suit. A petition was cir culated and the required number of sig natures secured for the submission of the vehicle tax question to the voters on June 1. Until the vote is taken the city, can not make collections, according to the contention of the plaintiffs. Officials of the city government believe that should the decision hold that the -state referen dum law applies to measures passed by the City Council it will play havoc with the business done by the Council in the last year. Judge Cleland, of the Circuit Court, will render decisions in the following cases this morning:' P. A. Marquam against the United States Mortgage & Trust Company and others, mo tion of plaintiff for leave to file second amended complaint and motion of defend ant for a final decree. Carl Frltsche asalnst Bertha Fiitache and others, demurrer to complaint. John Dean against Amelia M. Robinson, motion for a decree. ' y Astoria Columbia River Railroad Com pany against Multnomah County, demurrer to complaint. Maurice Barrel I against Colburn Barrell, on the merits. Decisions by Judge Gantenbein will bo rendered in the following cases: R. E. Marshall against P. J. Cook, de murrer to complaint. D. C. Rogers against City of St. John, demurrer to complaint. Moy Bow Wing against Carrie Howe and others, demurrer to amended answer. Charles A. Benbow against the steamer James John, motion to elect. C. E. Dubois against the Suburban Lum ber Company, demurrer to plea in abate ment. Sued by Map-Makers. The suit of J. P. Wicks and Peter Stevenson, -of the Portland Blue-Print Company, against B. A. Tyroll, of the Portland Block-Book Company. Is on trial before Judge Bronaugh, of the Circuit Court. The plaintiffs are seeking to re cover $110.25 for making 200 cloth maps of Portland.
