Th Pacific Telephone & Telcpragh Company and the Home Telephone Onmpany may be compelled to furnish underground "conductors"' for the city 'a lire-alarm ayaiem. if certain clauses in their franchise are construed in favor of the municipality by City Attorney Kavanausn. Both grants were taken up and llscuied at length by Mayor Lane s, pedal committee yesterday afternoon and an opinion has been aked of Mr. Kavanaugh as to what rights the ctty liss In the matter. Thi constitutes one of the most Important questions recently suhmltted to the law .department in Port land. Neither telephone company hfs furnish ed the city any "conductors," such as thosn used by th city for its fire-alarm system, and whether this constitutes a violation of the terms of the franchises is the question to be decided. When Mr. Kavanaugh gives his opinion the Mayor and his special committee, consisting of Couneilmen Kellaher. Rug-hlight and Vaughn, will determine on a course of action. During the session of the committee careful scrutiny of the franchises of both telephone companies was made by Coun eilmen Kellaher and Vaughn, Council man Rughlight being absent. Mayor Iane also took aome part in the proceedings in the capacity of advisor. He thinks the city may be able to force the cor porations to furnish such wires as are thought to be adequate In the opinion of competent electricians. Mr. Vaughn and Mr. Kellaher are of the same belief. In tho franchise of the Pacific Telephone A- Telegraph Company it Is provided that tho company shall furnish free of charge to the city such under ground "conductors" as may be neces sary, and In the Home Telephone Com pany's franchise It is stipulated that, it ah all furnish such fire-alarm cables as may be regarded as necessary. t'nder these clauses some are of the opinion that the companies can. be forced to supply the particular kind of wires that is used by the city. These are heavy and rubber insulated, being the best quality on the market for underground cables. it is said, and more expensive and far different from those used in overhead systems Because of the vast difference between the wires used by the city for its fire alarm system and those used y the tele phone companies, representatives of the corporations have announced that they will not furnish the kind used by the city. They declare that to require them to do so would be unreasonable, and they say that they will appeal to the courts against such an order. City Klectriclan bavarian was a wit ness from whom the committee secured much valuable information yesterday. He said that the telephone companies have complied with the terms of their grants fairly well, but seemed surprised that the members of the committee would attempt to force the corporations to supply the brand of wire used by the city for fire alarm purposes. He said he thought that the terms of the franchises were not so framed as to make such an attempt successful. Fire Department Changes. Chief - Campbell, of the fire depart ment. Is working out new assignments for the forces in the two new districts on the East Side. Captains Stevens and Dowel will today be officially - ap pointed to take charge of the districts. They will then become battalion chiefs and Stevens will be in charge of the southeast district. Dowell will have charge in the northeast district. Bids on Vault Opened. Bids for the new vault for. the City Treasurer's office were opened by the City Hall committee of the Executive Board ye3terday morning. That of the Portland Safe Company was the lowest, it being $5300. All bids were referred to a committee for consideration as to specifications. Ios Angeles Hearings Make It Im possible lor Special Prosecutor to Come" Here April 13. It was announced yesterday by the Federal Court officials that it would be impossible to resume the Oregon land fraud prosecutions before the middle of May. . This decision was reached after a conference of those directly interested in the trial of these cases. Tracy C. Becker, Special Assistant to the United States Attorney-General, assisted by United States Attorney John McCourt, will conduct these trials for the Govern ment, with the exception of the Hermann and Williamson cases, which will be re served for Francis J. Heney. the Govern ment Special Prosecutor. Mr. Becker will not be able to leave Los Angeles for two weeks and that is the excuse srlven for deferring the trials another month. They were scheduled to be taken up April 13. It has been decided that when the April term of court convenes, a week from Monday, District Attorney MoCourt is to proceed with the trial of all pending criminal cases In which indictments will have been returned by the grand jury which Is now in session. This is expected to require about ten days, when the civil docket will be taken up. It is net be lieved that-more than three weeks will be required to dispose of this business and then everything will be ready, about tho middle of May, for the land-fraud defendants. With the exception of the Hermann and Williamson cases, all of the pending land-fraud trials will be held before Judge Wolverton. When they have been disposed of, the plan is to call the cases against Hermann and Williamson, which will be presided over by Judge William H. Hunt, of Montana. There is pending In the Federal Court an application for a new trial in the case of the Government against John H. Hall, ex-United States Attorney, who was convicted of conspiracy in February. This application has been set for argu ment before Judge Hunt, April 13, but owing to the fact that Judge Hunt, who presided at the Hall trial and before whom the motion must be argued, will not be in Portland until late in the Sum mer, the motion will not be argued until Judge Hunt returns to Portland. Thomas B. Xeuhausen. Special Inspec tor of the Interior Department, who is one of the Government's assistants in the prosecution of these cases, expects to leave Friday for Washington, where he will appear as a witness for the Govern ment In the Hyde-Benson case, which will be called for trial in that city Mon day, April 13. This case probably will be concluded in time to enable Mr. Neu hauscn to return to Portland and assist Mr. Becker and Mr. McCourt conduct the untried land-fraud cases. BODY WILL BE EXAMINED Fot-Mortem Ordered on Remains or 14-Year-Old Mother. A post-mortem examination will be held today at the Flnley undertaking establishment to determine the cause of the death of 14-year-old Viava Gllllns. recently brought to Portland for medical attention from Baker City. The child died yesterday at a ma ternity hospital conducted by Dr. C. H. T. Atwood. Her death followed the birth of a son. Pneumonia was given as the cause of death. In applying for a burial certificate Dr. Atwood and B. N. Matthews, of Baker City, uncle of the girl, suggested that a Coroner's Investigation might be advisable to removt the possibility of future suspi cion. The little girl had been visiting in a Utah mining camp. She returned to her uncle's home at Baker City In a delicate condition, it is said. She was at once sent on to the maternity hos pital. Here she caught cold which developed Into pneumonia. Dr. Atwood says. The son was born on Saturday and was dead at birth. Tho child mother lived until yesterday morning.
