AGAINST OREGON STATUTE Lawyers Expect Favorable Order From Court on Petition foi Writ of Review and Cite Oregon Precedent. That the trial of rase in the Municipal Court before a jury chosen by a police man from hangers-on about the police station la against the Oregon statute ia the contention of seven Chinese, who, through Lawyer John F. Logan and John C. Shlllock. filed a petition for a writ of review with the Circuit Court yesterday. It i the contention of the petition that Municipal Judge Cameron exceeded hia authority when he ordered Ah Sam, Ah Louis, Ah Yet, Lung Sing, Ah Wins, Ah Fung and Ong Fit. to be tried for visiting a gambling joint, be fore a jury composed of loafers about the Courtroom. It Is alleged that the Chinese contended at the time of trial that they had a right to go before a jury selected from a jury list, having deposited the $6 required by law In such caaes. The court denied the demand. Besides Judge Cameron, the City of Portland and Clerk F. D. Hen xieaay are made parties defendant to the petition. For several years the selection of juries Tor Municipal Court trials has been left to the Chief of Police, says Lawyer ShUlock. The clerk has been in the habit of making out the subpenas for the six Jurymen, leaving the apace for the name blank. It was then a very easy matter for the Chief to send a bluecoat into the Courtroom, or down the street, to pick up a Jury. Mr. 6 hillock said last night that the power of "railroading" persons through had been accorded the Chief of Police for years. "He is given the chance to pick up a convicting jury or an acquitting jury at will," said Mr. Shillock. "An op portunity is also given for graft to play some part with the jury. I am sure my Chinese clients will be given another trial, as the Oregon Supreme Court has once ruled on a similar case, that of George A. Cuslter against the City of Sllverton." In the Sllverton Police Court. In this case, the jury was called by the same method which has been in vogue in Judge Cameron's court. The defendant pro tested, but his protest was ignored. He took his petition for a writ of review to the Circuit Court, and was awarded a new trial, with the result that the City of Sllverton appealed the case to the Supreme Court. There the decision of the lower court was sustained. In his dec if ion Pup re me Court Commissioner Slater said: It seems to have been conceded ly the court that the defendant in the action was at least entitled to trial by a jury: and, if he were entitled to a Jury at all and made the proper demand for a selected jury, hlch we think the record shows, van entitled to have It selected an the law provided, and he could not r-e legally compelled, over htn oniections. to go to trial before a jury selected by the officer. Stanley Retires In Favor of Widow of Oraer B. Wirt. The estate of Omer B. "Wirtl valued at 16000, is now In tlie hands of Sarah A. Wirt, the widow, who was appointed yesterday morning- by Judge Webster, administratrix. A. B. Manley, who was appointed March 4 as administrator, resigned in favor of the widow without protest. He said that his petition that he. be appointed administrator was filed at the earnest solicitation of the family of Wirt, who died February 27 lut. Mrs. Wirt was x in ill health, Manley says, at the time he was ap pointed, but since learning; that she la Rble and willing to act as administra trix, he la in favor of her appoint ment. The estate of CInnle Nnnan, valued at 15300, Is now in th'e hands of Jerry Xunan. the husband. He was appoint ed administrator yesterday by the County Court. The County Court has ordered that 1400 belonging- to Charles Scott be paid to the Benedictine Sisters' Sanitarium at Oak Grove, which is to care for the aged man the remainder of his life. The order was issued upon the appli cation of Judge Bolre, the guardian. SATS HUSBAND STARVED HER Sir. Ida Firth Charg, Cruelty In Divorce Suit. That her husband starved her into sub mission by locking; her in a room without food for three days, is the assertion of Ida Firth in a suit for divorce filed against John E. Firth. In the Circuit Court yeaterday. The Incident occurred in January. VM. only six months after their marriage, according to Mrs. Firth. Mrs. Firth also charges that her hus band often struck her with articles of rurnlture. that he refused to sunnort her and that she was finally compelled to leave him. His (wife noticed that he was still out of iumor. but did not suspect that anything j.-erlous would happen. Without attract ing the attention of the family. Messenger took a rifle from the wall, stepped outside fcnd wiiat followed remains somewhat ob-li-ure. But upon hearing the report of a tun his wife ran to tne scene and found lier husband dying from the effects of a gunshot wound. Mc Cormack Invited two good looking wom en to dine with him and together they repaired to a Chinese restaurant on Burnside street, near Fifth street. Here McCormack's spirit of hospitality waxed warm under i the mellowing in fluence of numerous libations and desiring to initiate his fair companions Into the mystery and luxury of a Chinese feast he ordered all kinds of expensive dishes nonular with the ultra swell set of China town. The two enjoyed the repast and made exceeding merry at the proprietor's expense. When the waiter presented the bill, Mc Cormack fountthat the sum total of his finances consisted of only a few cents. In response to reproachful looks and words from the Chinese proprietor. .Mc Cormack grew abusive and rough.
