13 FEAR FEDERAL SUIT Purchasers of Granted Land Bring Influence to Bear. FIGHT FULTON RESOLUTION Induce Chamber of Commerce to In tercede in Their Behalf, Asking Congressional Committee to Amend Pending Measure. Because trie Fulton resolution as to lands In the Oregon & California Rail road grants may involve large and small purchasers of the lands, as well a the railroad, many protests are eo ina; to Washington against adoption of Senator Kulton's Joint resolution by the House of Representatives. The railroad holds 2.000,000 acres in viola tion of the terms of the grants,' and purchasers who bought in violation of the terms of the grants more than the 160-acre limit for each purchaser, at a prire exceeding $2.50 an acre and not being actual settlers hold some 700, 000 acres more. The resolution is so broad as to cov er all violations of the terms of the grants, both by the railroad and by timber speculators and by small buy ers. It authorizes and directs the At-torney-Oeneral to bring suits in equity "to enforce any and all rights and remedies of the United States.-' The Southern Pacific, obviously, is much pleased that it has company in the campaign for protection of its claims, and sees that the purchasers of the lands may form a strong bul wark to ward off the attack. Voicing the protest that has gone up from the large and small purchasers. .the Port land Chamber of Commerce and the Commercial Club yesterday sent to Frank W. Mondell,' chairman of the Houae committee on public lands, a dispatch as follows: "The Fulton Joint resolution direct ing Attorney-General to commence suit to annul title Oregon-California land grant, unless provision is made that innocent purchasers be excluded from the scope of this section would result in the most widespread disaster to Western Oregon. Hundreds of settlers, farmers, fruitgrowers and even townsites. have been located on these railroad lands, and the Chamber of Commerce of Portland most urgent ly asks that you specifically eliminate any danger of bringing these innocent purchaser Into any legal complica tions endangering titles to their prop erties. Public opinion heartily favors resolution with above exceptions." It will prohahly be asserted by author ities of the Department of Justice, in cluding B. T. Townsend. the special attorney of the Government who probed the land grants last Summer and Fall, that the resolution does not impair any land titles, either of the railroad or of larce and small purchasers, since it ex pressly declares: "It not being intended hereby to de termine the right of the United States to any such forfeiture or forfeitures, but It being Intended to fully authorize the Attorney-Heneral. in and by such suiJs.v actions and proceedings, to assert on behalf of the United States and the court or courts before which such suits, actions or proceedings may be instituted or pending, to entertain, consider and adjudicate the claim and right of the United States to such forfeiture or for feitures, and if found, to enforce the same." The purpose of this resolution is to open the door fully to any suits that the Government may see fit to begin. Without the resolution thero is doubt of the Government's authority. The Government desires to clear away as completely as possible all obstacles to Its proceedings. It will present the facta to the court of equity, and the court will determine the means of re lief, whether to order the railroad to comply with the terms of the grants or to forfeit the S.noo.ono acres pt land , remaining In Its possession or also to In clude in the decree of forfeiture the lands held by purchasers. , In this aspect the Department of Jus tice Is expected to maintain that the resolution cannot Impair any land titles, since they will be at the disposition of the court. INDIAN PHOTOS EXHIBITED Splendid Curtis Portfolios Shown at ' Museum of Art. The flint two portfolios of the famous North American Indian pictures by Ed ward Curtis, of Seattle, have attracted much attention this week while, on ex hibition at the Museum of Art, at Fifth and Taylor streets. Ten years have been consumed In the preparation of these two portfolios, and seven years hence the en tire set. including 30 volumes. Is to be completed at a cost of The edition Is to be limited to 5tX sets. .100 to be sold In this country and the remainder abroad. The preface is written by President Roosevelt, who has declared Mr. Curtis to have accomplished the greatest work of the century. The portraits are done in sepia tones and are printed on the finest Japanese tisstie paper. The two complete volumes are of the Southwestern Indian type. Apache and Navajo predom inating. In this collection are depicted portraits of warriors, squaws, papooses and charming Indian scenery, notably the ' beautiful canyon scenes. Of great inter est are the pictures showing the home life of these tribes, and the manner in which the religious ceremonies were con ducted. No more Inferior street work will be tolerated in Multnomah Addition to Albina, such as is being complained of by property owners on Fremont street. In order to prevent bad work and make tip for lack of inspection the Multnomah Improvement Club at its meeting Wed nesday night decided to appoint special committees on all streets to be improved, to watch the progress of the work and nee that it is done according to contract. Committees of property owners were ap pointed on Albina avenue and Mason street, which are to be paved with crushed rock. Theme committees were instructed to watch the work and report any deviation from the contract. As fast as other street contracts are let special committees will be appointed to look after them.
