N 1 THE MORNING OJREGONIAN, THURSDAY, NOVEMBER 9, 1905. FIXES LICENSES ID EVADES Li Oregon Water Power & Rail way Thwarts Public Will at Sellwood'. BOX ORDINANCE VIOLATED The Oaks Granted Privileges Denied Others Conducting; Similar En terprises Street-Car Vote Defeats Local Option. Without interference from the city ad ministration, the Oregon Water Power & Hallway Company last Summer conducted Its park at the Oaks in violation of the city liquor ordinances and the state Sur day laws, while at the same time other offenders of less weight elsewhere In the city were arrested. Games were permitted at the park on Sunday, among them being a shooting gallery and 4 knife rack, which, similarly conducted at other places last Sunday, were raided by the police and their owners fined in the Municipal Court Tuesday. Not only this, but the corporation used its Influence with the Council to secure passage of an ordinance for its own spe cial benefit namely, reduction of the total license which, under the existing ordi nances, would have been Imposed on the various attractions, to $300 a quarter. Had not the special-license ordinance become a law, the company would have had to pay three or four times as much just the same tax exacted from like attractions in other parts of the city. As things stand, an attraction at the Oaks pays a much smaller license than anywhere else In Portland. Mayor Lane at that time did not enforce the box ordinance at the Oaks, for rea sons which were not plain, but which were commented on widely, especially by less favored liquor venders outside the park. Much Complaint of Resort. Meanwhile, many complaints were made to the police of the drinking and rowdy ism at the Oaks, but nothing was done by those agents of the law to abate tff?TT evil. So disgraceful were the scenes that Councilman J. P. Sharkey declared on the floor of the Council In July that during the one evening he was at the park he had seen more Intoxicated persons than during any 30 days of his life in Portland. a.nd that most of them were young men and women and boys and girls. The rough clement at the park was so offensive that a woman employed In the kitchen of his home refused to attend the place. The Oregon Water Power & Railway Company conducted at the park a bar. In connection with which were two large rooms and a garden, where refreshments and liquors were sold. This traffic was Clearly a violation of the city box ordi nance, but Mayor Lane did not interfere, though he enforced the ordinance against restaurants and grillrooms in other parts of the city. He compelled the Quelle to desist from soiling liquor In Its grillroom, which adjoined the barroom, and arrested the proprietor of the Turner Hall for sell ing liquor in a similar room. Violated Box Ordinance. According to Mayor Lane's Interpreta tion of the act, liquor couia be sold in the barroom only, and not "in any room or box adjoining, and he enforced the ordi nance in conformity with this Interpreta tion in other parts of the city than the Oaks. At the latter place, liquor was sold outside the barroom -without molestation. At the Oaks also was a dancehall, which tvas run on Sunday, in violation of the law, which prohibits such doings on that day, and though dancehalLs are taxed heavily by city ordinance, the company secured from the Council a special license, thus escaping that tax. Many people of Sellwood, In -whose pre cinct the park is locate'd, desired to von the precinct dry In the last election, in order that they might clean out the sa loons and make it decent. But they lost the election by some 40 votes, a surpris ing outcome. In view of the strong "dry" sentiment of .the place. It has since cropped out that the Oregon Water Power & Railway Company used its influence to hold the precinct "wet," in order that it might sell liquor at the Oaks. Tne liquor traffic in the park was a source of profit to the company, and the company -wanted to keep it. Varied Methods Employed. This was one example of the thrifty methods adopted by the company for win ning money from the pockets of the pub lic. But the company was not content with the 5 cents car fare collected from each person who went to the Oaks and the 10 cents admission fee and the various fees for admission to the several attrac tions inside the park; it collected 5 cents from every person leaving the park, this sum ostensibly for the car ride home. But there were many persons who did not want the ride, yet they had to pay the 5 cents. Many Individuals resented this toll and two have begun suits -against the company to recover damages for rough treatment received, by them in resisting payment of the 5 cents. Otherwise it would not have found a place, in Japan's matchless ex hibit at the Lewis and Clark Exposition. At the sale in progress every article must be sold, regardless of the price it may bring. Many of the finest wares are being sold daily for less than the duty paid on them to get them into the country. No tnich opportunity for pur chasing art goods of this class has ever been presented the people on the Pa cific Coast and Portland is fortunate in that it was decided to close out the entire Japanese exhibit in this city. It is hoped to conclude the sale by the end of this week or the early part of next week at the latest. Searching for, Man and Boat. J. Mtllan, whose launch disappeared from Its moorings at Fulton at the same time O. H. Klser vanished, Is still search ing for it. The Sheriffs office Is also try ing to assist him in its recovery. The launch was constructed from a fishing boat by installing a gasoline engine. It Se painted a light blue. Sheriff Word hi still- looking for Klser.
