Representative Tonsrae Fathered Measure Why Be Thinks Gorr ernment Should Make DeaL WASHINGTON, Jan. 28. The follow ing Is the text of the bill introduced by Representative Tongue, providing for the payment to the Klamath Indians of the sum recommended by Special Agent McConnell, for the landj erroneously ex cluded from their reservation; That said agreement with the Klamath Indians be, and the same hereby Is, ac cepted, ratified and confirmed. That for the purpose of carrying the provisions of said agreement Into ef fect there is hereby appropriated, out of any money in the Treasury not oth erwise appropriated, the sum of J537.Q07 20. of which amount the sum of $350,000 shall be placed to the credit of the Indians of the Klamath agency. In the State of Oregon, in the Treasury of the United States, and shall bear Interest at the rate of 5 per cent per annum. The re mainder of. said sum of $537,007 20, after the payment of the legal fees of attor neys having duly approved contracts, tq gether with the interest on said sum of $350,000 shall be paid to said Indians or expended for their benefit as provided in article three of said agreement; pro- vided, that the Secretary of the Interior may, in his discretion, expend for the benefit of said Indians, Including reas onable cash payments per capita, not to exceed 10 per cent per annum of the prin cipal fund, upon a majority of the male adult Indians of said Klamath agency petitioning for the same through the Com. missloner of Indian Affairs. Provided, that nothing hereinafter con tained shall be held to in any way mil itate against the indemnity school land selections made by the State of Oregon on the basis of sections 16 and 36, within the boundary of the Klamath Indian reservation, as erroneously fixed in 1871 on the boundary agreed upon in the treaty with the Indians of 1S64, but by which Indemnity selections made by the state in lieu of lands within such boun daries shall be passed to approval in the usual way. In explaining his purpose in Introduc ing this bill and the necessity for Its passage, Mr. Tongue said: "Although the suggestion has been made that the lands involved number ing In all some 621,834 acres, should be given back to the Indians, Instead of paying them the sum provided by this bill, the fact of the case is that there is no question of giving back the lands. The land belongs to the Indians now. It belongs to the entire Indians upon the reservation. They have no use for it. All the lands that they can use have been allotted to them. If these lands re main in their present condition, they are of no use to the Indians; they cannot be settled by white people: they would not be Improved: they could not be taxed; they would be In the nature of 'no man's land,' useless alike to the Indians and whites. "In the end these lands must be ac quired by the Government, and opened up to settlement. This can be done now bet ter than at any other time. The Depart ment of the Interior, In pursuance of laws heretofore enacted, have negotiated with the Indians for the purchase of these lands. The agreement has been signed. The Government had the entire tract carefully surveyed and carefully ap praised. If the purchase is completed, it can be opened up for settlement under the land laws of the United States, will be improved, homes will be located upon It and it will contribute taxation for the support of schools and public expenses. "If this snould not be done, there are many settlers who have occupied these lands under the belief that they were Government lands. They would have to be removed, and lose their homes. The Government would probably pay them for their Improvements, but that would be small recompense. If not now, in tHe end we must do just as we are doing with the land on the Grand Honde res ervation and other Indian reservations authorize the Government to buy It. The surveys and negotiations have taken time and cost money. Presumably the land has been appraised at its true value. There is In all 621.834 acres. The agree ment has been made. It Is best to ratify it complete the transaction, open the lands to settlers and close the books. "The bill is in the main the one drawn by the Interior Department. I have aided a section to protect the rights of the state The state gave up Its right t" the lth and 36th sections upon this land, has selected lands in lieu thereof, and In many instances sold them to purchasers in good faith. I have aJded a section niovidlng that nothing In tMs act shall jeopardise the title of the State of Oregon te any of the lieu land selected in place of those lands surren dered by the state within this reservation. If this provision becomes a law, the state will of course have no further interest In the land covered by this bill." This bill Is heartily indorsed by the department, but unless it is made a pro vision in the general Indian bill, it will stand little chance of passing at this session, because of the appropriation it carries. DEMAND IS GROWING. Oregon Timber Continue to Attract Eastern Capital. Oregon timber must be keeping up Its good name In the East, judging from the constant arrival of prominent lumbermen from Minnesota, Michigan and Wiscon sin at the principal hotels of Portland. Many of these men have become perma nent clt.zens of the city within the past twi years, and they have found the sur roundings congenial and the climate so near perfection that they have inducer! their friends to come on. They all admit that timber land Is very low now. com pared to what It -will be in a few years, and quite a number of them have backed up their opinion by making heavy pur chases where the lands He adjacent to streams. As a result, mast of the tim ber lands along the tributaries of the Lower Columbia have passed from the hani?s of the original settlers, and their pr'ce has advanced very materially. Not krg ago timber land could be bought In those regions at the rate af 15 cents a 1000 feet sturapage, and now as high as $1 Is asked by the sellers. The time. s about passed, therefore, when "snaps" Can be found along the convenient s,reams. Among the recent arrivals of prominent t mber men is Judge J. "W. Cochran, of Ashland. Wis., who is registered at the Portland. He has been largely interested In the sawmill Industry for many years, and already has title to quite a tract of Oregon timber lands, as he was out here about a year ago and made purchases. He said yesterday that the time Is com ing when cheap timber lands will be among the things of the past In Oregon, although there is considerable yet to be had, at very low figures. In the more re in re (sections of the state. He finds that Oregon timber stands well as material for bul ding sailing ships, notwithstanding the large number of Iron vessels which have been launched of late years. "I was in San Franalsco last week when one of these vessels, the Tacoma. landed from Loverpool." the Judge said, "and I took especial pains to find out how she stood the voyage. Her cargo of general mer chandise was discharged In first-class con dition, although the captain or the ves sel averred that she had been under wa ter most of the time, on account of rough seas, since he left IJvepooi.,, The Judge thinks that the price of Ore gon timber lands will be strengthe,ned further by the passage of the-Nicaragua Canal bill, even though It should take 10 years to build the canal. "Once let u be understood," he said, "that we can take a cargo of lumber to New York City from Portland in 20 days, And the demand lor the product win be increased Immensely. I think, however, that the transconti nental railroads will find It to their In terest to take lumber East at much smaller rates than at present, and this concession will immediately extend the demand for Oregon fir, as It is needed throughout the East, but the high freights render it too costly." - m . , Gilbert Hesford, who was paroled from the penitentiary on October 26, 1893, and went to visit his parents at Castle Rock, was arrested at Seattle for violating the parole rules of the penitentiary. Hesford was sent up from Castle Bock for 15 years for murder in the second degree. His time would have been up on October 20 last. DAILY METEOROLOGICAL REPORT PORTLAND. Jan. 3l.-r3 P. M.
