r - orrioMi. LAWS OF THE UNITED STATES, ' , FAHIiTTH ' First Ma of the nirly-Eigkh Congress. An Act in addition to tht eoynral Acta eonceriiing Commercial Intercourae botween loyal and inaurrectionary Statos, and to provide for the Collection of captured and abandoned Proper ty, and the Prevention of Frauds in States de clared In Insurrection. Be it enacted by the Senate and House of Rep resentatives of the United State of America in Congress assembled, That tales of captured and abandoned property under the act approved March twelve, eightoon hundred and sixty-throo, My be made at auch places, in atatea declared in inaurrection, aa may be designated by the Secre tary of the Treasury, aa well as at other places now authorised by aaid act. See. 2. And be it further enacted, That in ad-. dltion to the captured and abandoned proporty to be received, collected, and disposed of, aa provi ded ill aaid act, the aaid agents shall take charge af and lease, for periods not exceeding twelve months, the abandoned lands, houses, and tone menta within the districts therein named, and sbal alio provide, in auch leases or otherwise, for the employment and general welfare of all per aona within the linos of national military occupa tion within aaid insurrectionary states formerly held as slaves, who are or shall become free. Property, real or personal, shall be regarded aa abandoned when the lawful owner thereof shall be voluntarially abaent therefrom, and engaged, either in arms or otherwise, in aiding or encour aging the rebellion, .Bee. 3. And be it further enacted, That all moneya arising from the leasing of abandoned landa, houses, and tenements, or from sales of captured and abandonod property collected and aold in pursuance of aaid act, or of this act, or from feca collected under the rules and regula tions mado by the Secretary of the Treasury, and approved by tho President, dated respec tively the twenty-eighth day of August, eiglitoon hundred and sixty-two, the thirty-lirat day of March, and the eleventh day of September, eigh teen hundred and sixty-throe, or under any amendments or modifications thereof, which have been or shall be mado by tho Secretary of the Treasury, and approvod by the President, for conducting the commercial intercourse which has been or shall be licensed and permitted by the President, with aud in states declared in insurrec tion, shall, after satisfying therefrom all pn.pnr and necessary expenses, to bo approved by the Secretary of the Treasury, bo paid into the treas ury of the United Status ; and all accounts of moneys received or expended in connection there with shall be audited by the propor accounting officers of the treasury. That tho first section of ' the "Act to provide for the collection of abandon ed property aud for tho prevention of fraud in insurrectionary districts in tho United States," approved March twelvo, eighteen hundred and sixty-three, is hereby extended so as to includo the descriptions of property mentioned in an act entitled "An act further to provide for tho collec tion of duties on imports, and for other purposes," approved July thirteen, eiglitoon hundred and aixty-oue. and an act entitled "An act to suppress insurrection, to punish treason and rebellion, to seise and confiscate the property of rebels, and for other purposes," approvod July seventeen, eighteen huudrod and sixty-two, respectively ) and that the sales provided for in said act first mentioned may be made at such places as may be designated by the Secretary of the Treasury. And section six of said first-mentioned act is here by amended so as to include every description of property mentioned in the acts of July thirteen, uignteen hundred and sixty-two aforeaaid i and that all property, roal or personal, described in the acta to which this is in addition, shall be re garded as abandoned when the lawful owner thereof shall be voluntarially absent therefrom, and engaged, either In arms or otherwise in aid ing orencouraglng the rebellion. Seer 4. And he it further enacted, That the prohibitions and provisions of the act approved July thirteen, eighteen hundred and sixty-one, and of the acts amendatory or supplementary thereto, shall apply to all commorcial intercourse by and betweeue persons residing or being within districts within the present or future lines of na tional military occupation in the atates or parts of states declared in insurrection, whothor with naeh other or with peraons residing or being with in dlstriotadeclsred in inaurrection and not within those lines) and that all persons within the Uni ted States, not native or naturalised citisens thereof, shall be subject to the same prohibitions, in all commercial intercourse with inhabitants of states or parts of statos declared in insurrection, na citisens of loyal states are subject to nuder the said act or acts. Boo. 6. And be it further enacted, That when over any part of loyal atato shall be under the centrol of insurgents, or shall be in dangerous proximity to places under tlioir control, all com mercial intercourse therein and therewith shall be subject to the same prohibitions and condit ions as are created by Uie said acts, aa to such intercourse between loyal and roaurroutionary atates, for such time and to such extent as shall from time to time become necessary to protect the public Interests, and be directed by the Secre tary of tl Treasury, with tho approval of tho President. i ,r Sec. fi. And be it further enacted, That so roach of the fifth section of the act approved May twenty, eighteen hundred and sixty-two, aud the fourth section of tho act approved March twelvo, eighteen hundred and aixty-threo, aa directs the inaune.'of distributing tinea, penalties, and for feitures, ia hereby repealed, and thnt, in lion of lb distribution tncrouy directed to bo mado to informers, collectors, and other officers ol the customs, the court decreeing condemnation may award such compensation to ciiatonis-oliiccrs. in formers, or other porsons, for any service connec ted therewith, as will tend to promote vigilance in protecting tho public liitcrusts, and as shall he just and equitable, iu no cam, however, to exceed the aggregate auiuunt heretofore directed by the said fifth section. Sec. T. And be it further enacted, That no property seised or taken upon any of the inland naters ef the United Stab's by the naval forces thereof, shall be regarded as maritime prise t hut all property so seised or taken shall be promptly delivered to the proper officers of the fount, or aa provided in this act and in tho aaid act ap proved in this act and In the said act approved March twelve, eighteen hundred and sixty three. Bee. S. And be it further enacted. That, it shall bo lawful for the Secretary of the Treasury, with Ike approval of tho President, to authorise agents to purchase for the United Stales any products of slates declared in Insurrection, at such plaeea therein as shall be designated by him, at auch prion as shall be agreed on v itb the seller, not exceeding the market value thereof at the plnre of delivery, nor exceeding three fourths of the market-value thereof In the city of New York at tlx latest quotations known to thengent purchas ing I Provided, That no part of the purchase money for any products to purchased shall be paid, or agreed to be paid, out of any other fund than that arising from property told aa captured or abandoned, or purchased and sold under the provisions of this act All property so purchased hall be forwarded for sale ot such place or pla ces as shall be designated by the Secretary of the Treasury, and the moneys arising therefrom, af ter payment af the purchase-aiouoy aud the oth er axpenses connected therewith, shall be paid in to the treoenry of the United States i and the accounts af all moneys so received and paid shall be Tendered to, and audited by, the proper ac counting officers of the treasury. Sea. 6. Incited from baying or telling, tradeing, at ia arf way dealing ia the kind er deseriptle ef up -vty mentioned in this act to wheih title la la a. it, wbweby to receive or expect any profit, be , er auranlai'e to himself, or any other par at, i. y or uwirectly conuectrd ailh kiui ay 1 it t.ail be the duty of such officer, private, a at suaruts, araeai sues property tut into his possession or custudy, or within hit con trol, to givs notics thereof to some agent, appoint ed by virtue of this act, and to turn the same over to such agent without delay i any officer of the United Statos, civil, military, or nnvnl, or any sutler, soldier, marine, or other person, who shall violrto any provision of this act, or who ahull tako, or cavse to bo taken, into a state declared to be in insurrection, or to any other point to bo thence taken into such state, or who sbull trans port or sell or otherwise disposo of thoruin. any goods, wares, or merchandise whatsoovcr, except in pursuance of license and authority of the President, aa provided in said fifth section of the act of July thirteen, eighteen hundred and sixty one, aforesaid, and any officer or other person aforesaid who shall make any false statement or representation upon which liconso and authority shall be granted for auch transportation, salo, or other disposition, and any officer or ollioricrson aforesaid who shall, under any license or author ity obtained, wilfully and knowingly transport, sell, or otherwise disposo of, any other goods, wares, or merchandiso than such as aro in good faith so licensed and authorised, or fhnll wilfully aud knowingly transport, sell, or disposo of the same, or any portion thereof, in violation of the tonus of such license or authority, or of any rulo or regulation prescribed by the Secretary of ihe Treasury concerning the enino, or shall be guilty of any act of embezzlement, of wilful misnp nrnuriatlnn of nubile or nrivato muncv or nron- erty, of keening false accounts, or of wilfully making any lalso returns, or ot any oilier act amounting to a telony shall tie name to indict ment at for a misdemeanor, and tine not exceed ing five thousand dollars, and to punishment in the penitentiary not exceeding three years, before any court, civil or military, competent to try tho snme. And Italian be the duty ot the Secretary of the Treasury, from timo to lime, to institute auch investigations aa may bo necessary to detect and nrovent frauds and abuses in tho trade nnd other transactions contomplatod by this act, or by the acts to which this ia supplomontcry. And tlio agenta making such investigations shall havo power to compcll tho attendance vf witnussos, and to make examinations on oath. Sec. II. And he it further enacted, That tho Secretary of tho Treasury, with the approval of the President, shall maKe such rules aim regula tions as are necessary to secure the proper and ocnnomical execution of the provisions of inn act. and shall dofrav all expenses of such rxocu tion from tho proceeds of foes imposed by said rules and regulations, of sales of captured and ahondoned proporty, and of sales huroiiibofore authorized.
