Be it enacted by the Senate and Home of Rep
rctesentative of the United 8tate of Amrrica in
Coafrrai! assembled, That from and after the
passage of thU act, in the location of landi by
atatei and corporation! under grant! from con.
gress for railroad! and other purposes, (except
for agricultural college,) the regUtara and receiv.
' en of the land-ofiicei of the several itatei and
territoriea, in the diitrioti where inch landi mar
be located, for their service therein, ihall be en-
1 titled to receiv a fee of one dollar for each final
location of ono hundred and lixty acres, to be
paid by the state or corporation making ancb lo
cation of one hundred and sixty acres, to be paid
by the state or corporation making such location,
the same to be accounted for in the aauie manner
M feee and commissions on warrants and pre
emption locations, with limitation! as to maxi
mums of lalary preacribed by existing laws, in
aceordinc with such instructions as shall be giv
en by the commissioner ol the general land-office.
Seo. 8, And be it further enacted, That the
Bnrlington and Missouri Hirer railroad company
ntny so far change or modify the location of the
uncompleted portion of its line, as shown by the
snap thereof now on file in tho general land-office
of the United States, so as to secure a bettor and
; mors expeditioui route to the terminus of laid
line on the Missouri Rivr, said new line to be lo
rua !iln the limit! of the land grant made by
the United States to aid in its construction ; and
said change shall not Impair the right to, nor
ehaoge the location of, their present-land grant.
A map of the change shall be filed with the com
missioner of the general Innd-offiice within one
year after the passage of this act.

An Act to encourage and facilitate Tolegranhlo
Communication between the Eestero and Wes
Tern Continents.
' - Whereas tha government! of Russia and Great
Britain have granted to Perry MacDonough Col-
. tins, a sititen of tha United states, the right to
construct and maintain a line electric telegraph
through their rospectiv territories, from the
mouth of the Amoor Hirer, in Asiatic Russia, by
1 way of Bebring'i strait and along the Pacific
coatt to tha northern boundary of the United
Btates, with a view or thereby milling the tele
praphio system of both continents, and of promo
ting International and commercial intercourse ;
and whereas, the government of Russia, in fur
therano of that objeot, is now constructing a
line of telegraph through its Asiatic territory to
unite at the mouth of the Amoor River with the
line projected by said Colins I and Mheras the
government of the United States desires cordially
to co-operate with liuasia and Great Britain in
the establishment and maintenance of such aline
of communication I now, therefore
Be it enacted by the Senate and House of Ren-'
rosentatives of the United States of America in
Congress assembled, That Perry McDonougb Col-
: lias, of California, hi associates and assignees,
shall have the right to construct and maintain a
line or lines of telegraph from any point or points
' on th line of the Pacific telegraph, constructed
in pursuance of the act of congress, approved
June sixteen, (ixhteen hundred and sixty, north
erly, through any of the territories of the United
(State, to the boundaries of British America, with
suih branch line as may be needed to opn com
munication with the various mining districts and
other settlements in said terrirorie. And for tha
purposes aforesaid, the said Collins, hi associate
and assignees, shall have a permanent right of
way over any unappropriated public lands of the
' United 8tates, together with the right to take any
. limber and atone for constructing purposes and
. for th purpose of establishing aud maintaining
laid line and tha station necessary for th re
pair and working thereof, there is heraby'grsuted
to said panic th use of so much unappropriated
' public land not sold, granted, reserved, pre-empted,
nor occupied by homestead settlers, a may
i be necessary for stations, not exceediug forty
; acres for each fifteen mile of line constructed
across th public lands of the United States, io
long ai the same may be used for said purpose t
Provided, however, that so much of eection one
of this act aa authorises the construction of tele
graph line to open communication with the va
rioos mining district and ether settlements in
, said territories, shall be null aud void, nnlessaid
branch-line shall be completed within fir year
from the the approval hereof.
Sec. 9. And be it further enaoted. That In or
der to encourage and aid the construction of said
line of telegraph beyond the limit of tha United
State, the Secretary of the Navy la authorised to
detail for the the use of tho surveys and sound
ings along that portion of the Pacific coast both
of America and Asia, where it is proposed to es
tablish said telegraph, one steam or sailing vessel,
in hi discretion, to assist in surveys ancf sound
' Ingi, laying down submerged cable, and in trans
porting material connected therewith, and gen
erally afford such assistance as may be deemed
hot calculated to secure a successful promotion
of th enterprise.
Sec 3. And be It further enacted, That tha
corernment of the United State shall, at all timea,
bare priorty in th the use of the line or lines, so
far as the earn are within Its territory, aud shall
hare the right, when authorised by law, to con
nect said Hue or tinea by telegraph with any mil
itary posts of th United Stales, and to use the
same for government purposes'. And in order to
secure the same from Injury by savage or other
evil-disposed persons, to the interruption of th
fiublie business, the Secretary of War is author
ised to direct the commanders of the military
districte or autious, and other officers, actiug un
der authority of the United Statee in the territo
ries traversed by aaid telegraph, to ne any avail
able force at their command to protect the same.
Subject to th right of prior as by th govern
ment, as aforesaid, said line or linea shall be at all
timea open to the public and to any othor tele
graph company upon the payment of tho regular
charge for transmission or despatches, and all
despatches received sbsll be transmitted ever said
line and line in th order of their reception at
the telegraphic effice i and the answer to said de
spatches shall be delivered to such parties as may
Ik directed by th sender.
Sec 4 And be It further enactej, That th
lo:ier to accomplish the object of this act, namely i
tn promote the public. Interest and welfare, by
facilitating International and commercial Inter
course between th eastern and western conti
nents in the construction of said telegraph and
Itreping th ssme in working order, aud to secure
to tn government at all limes, but particularly
In time of war, the use and benefits of th same
for diplomatic, naval, military, postal, commercial,
and other purpose, congress may, at any time,
add lo, alter, amend, or repeal this act.
Sec 6. And be it further enacted, That th
rat of charge for publie or private messages
shall not exceed on eaid line the average usual
rates in Europe and America for the came service,
or such rate as shall be ascertained aud filed by
a oenveution betwe th United Slate, Russia,
and Great Britain! Provided, That it shall net
be lawful for the owner or officers of said tele
graph line to make auy contract, either directly
or through any Intervening party or parties, fur
th transmission of despatches fur any newspaper
or newspaper association, npon termi different
from those open to th enjoyment of all other
newspapsrs or newspaper assuciolion.

An Act repealing so much of "An Act to supply
Deficincies in the Appropriation! for the Ser
vice of the Fiscal Year ending the thirtieth of
June, eighteen hundred and sixty-four, and for
other Purposes," approred March fourtoen,
eighteen hundred and sixty-four, a appropri
ates twenty five thousand Dollars for erecting a
Naval Hospital at Klttery, Maine.
Be it enacted by the Senate and House of Rep
resentatives of the United Btates of America in
Congress assembled, That so much of "An act to
supply deficiencies in the appropriations for the
service of the fiscal year ending the thirtieth of
June, ighWn hundred and sixty-four, and for
other purposes," approved, March fourteen, eigh
teen hundred and sixty-four, as appropriates "for
erecting naval hospital at Klttery, Maine, twenty
five thousand dollars," be, and tho samo is hereby,
repealed.

An Act to provide for the Efficiency of the Navy.
Be it enacted by the Senate and House of Rep
resentative of the United State of America In
Congress assembled. That any person enlisted in
the military service of the United States, who
shall apply to the Navy Department to be trans
ferred to the navy or mariue corps shall, if his
application be approved by the President of the
united states, be transferred to tne navy or ma
rine corps to serve the residue of his term of en
listment therein, subject to the law and regula
tion for the government of the navy t 1'rovided,
That such transfer shall not release the transferr
ed person from any indeptednesi to the govern
ment, nor, without the consent of the President
of the United States, from any penalty incured
fur a breach of military law.
Sec. 2. And be it further enacted, That any
seaman or mariner, or person, who may have
served ai inch, drafted into the military service,
may, by order of the President of the United
States, be transferred to the naval service, to
serve therein, subject to the law! and regulation!
for the government of the navy, for the term, or
residue of the term, for which he was drafted.
Sec. 3. And be it further enacted, That all en
listments into the naval sorvice, or marine corps
during the present war shall be credited to the
appropriate township, precinct) or district, In the
lame manner as enlistments for the army.
Sec. 4. And be it further onacted, That person
hereafter enlisted into the naval service or marine
corps during the present war shall be entitled to
receive the same bounty aa if enlisted in the ar
my. And the resolution approred February
twentv-four, eighteen hundred and sixty-four,
entitled "A resolution relative to Die transfer of
persons in tho military service to the naval serv
ice," Is hereby repealed t Provided, neverthelea,
That such semi as may have been paid aa bounty
to persona transferred from the military to the
naval sorvice or marine corps shall be charged to,
and paid out of, the proper naval appropriation
lor tne marine corps.

An Act to establish Portland, in the Slate of Or
rgon, and Leavenwoth, in the Srute of Kansas,
forts of Delivery,
Be it enacted by the Senate and House of Rep-
resontatives of the United States of America in
Congress assembled. That Portland, in the Stat
of Oregon, and within the collection district of
Oregon, and Leavenworth, in the Statu or Kan
sas, and within the collection district of Missis
sippi, be, and hereby are. declared lo be ports
of delivery within their respective collection dis
tricts, And there shall be appointed a surveyor
of customs, io reside at each of said ports, who
snail perturm tne duties and rocelve the compen
sation and emoluments prescribed in the act of
congress approved March the second, eighteen
hundred and thirty-one, being "An act allowing
the dutiea on foreign merchandise imported Into
rmsourg, rvneeung, viuciunaii, xouiviii, oi.
Louis, Nashville, aud Natchei to be secured and
paid at these places.

Be It enaeted by the Senate and House of Ren-
resentatlves of the United State of America in
Congrosa assembled, That the sum of twenty -live
thousand dollar bo. and the same la herebv. ap
propriated, out of any money in the treasury not
otherwise appropriated, to enable the Secre
tary of the Navy to pay to the officers and
crew of the irou-clad gunboat Esaex. for the de
struction of th rebel ram Arkansas, the bounty
provided ny tne lourtneecllon of tne act entitled
"An act fur the better government of the navy, of
tne united Biaies," approved July seventeen,
eighteen hundred and sixty-two.

An Act prescribing the Puulshment for enticing
or aiding Seamen to desert the Naval Service
of the United States.
Be it enacted by the 8anate and Hnnso of Run
resentative of th United State of America In
Congress assembled, That any person w ho shall
entice or procure, or attempt or endeavor to en.
tiee or procure any seaman or other person in the
naval service of the United States, or who hae
beeu recruited for such service, to desert there
from, or who shall in any wise aid or assist any
such seaman or other person In deserting, or I n
attempting to desert from said naval service, or
who shall harbor, onncear, protect, or ill any wise
assist any such seaman or othor persons who may
have deserted from said naval service knowing
him to have deserted therefrom, or who shall re
fuse lo give up and deliver such person on the
demand of any officer authorised to receive him,
shall be punished by imprisonment not loss than
six months nor more than two thousand dollar,
to be enforced in any court of th United Stale
having jurisdiction.
