An Act to authorize the Corporation of Washing ton to lovy and collect thu Direct Tax imposed by Act approved August live, eighteen hundred and sixty-one. , s le it enacted liy the Senate, and House of Kori lesentatives of the United Htntcs of America in ('engross assembled, That the corporation of tlio eity of Washington bo, and they ar hereby, au thorized to assess and collect a tax not exceeding the rate of liltcen cents on every ono hundred dol lars of the value of all real and personal property jti said city, and on any ami all other subjects of taxation as made and returned by the board of assessors of said city, to unable tlio said corpora tion to pay to the government of the United Mates the tax imposed by act approved August live, eighteen hundred and sixty-une: Provided, 'I but any surplus that may accrno from His im position of tho tnx ns herein pruvined shall bo deposited and applied to the use of tbo general i'niid of the said city of Washington. Be it enacted by the Hetisto and I louse of Kop I'esontntives of tbo United (Slates of America in Congress assembled, That ivlienever the surveyor g neral of California shall, in compliance with the thirteenth suction of an act entitled "An act to ascertain and settle the private laud claims in the White of California," approved March third, eighteen hundred and fifty- one, have caused any private land claim to be surveyed and a plat lo bo made thereof, ho p hail give notice that the sanm has been done by n publication, once a neck fur four consecutive weeks, In two newspapers, una publiseed in the rily of Wan Francisco, and ono published near the land surveyed ; and shall re tain in his olilco, for public inspection, the sur vey and plat until ninety days from tlindiito of .the tint publication in thin Francisco shall havo expired ; and if no objections aro made lo said survey, hi shall approve tlio same, mid transmit , a copy of the survey and plat thereof to the coin inissiouer of the general laml-otlicu at Washing ton, for his examination and approval ; but If ob jections are made to said survcl within tlio saij ninety days, by any parly claiming to havo an Interest in the tract embraced by the survey, or iu any part thereof, such objections shall bo re duced to writing, stating distinctly the interest of the objector, ami Bigued by him or his attorney, and Hied with tbususveyor geiieral, together wiili such affidavits or ol her proofs at ho may produco in support of tho objections. At the expiration of said ninety days tho surveyor-general shall transmit to the commissioner of tho general laud- . Ulrica at Waseingtou a copy of tho curvey nnd plat, and objections, and proofs tiled with him in support of the objections, and also of any proofs produced by tbo claimant and tiled with him in support of tho survey, togother with his opinion thereon t and If the survey and plat are approved by the said commissioner ho shall indorse thereon a certificate of bis approval. If disapproved hy l ull, or if, in his opinion, the otids of justice ivonld bo subservs'd thereby, bo may reiiuiro a further report from tho surveyor-general of Cali fornia, touching the matters indicated hy him, or proofs to be taken thereon, or may direct a new I'U-vey and plat to be imulo. Whenever the ob jections aro disposed of, or tho survey and pint ro corrected, or a new survey nnd plat are niu.lo in conformity with his directions, ho shall indorse upon tho survey and plat adopted his certiticnto ot approval. Hut where from such dif reo of approval or correction iu appeal has becu taken to the supremo court, no appeal 10 that court shall bo allowed, but an appeal may I e taken, within twelve months after this act shnil l ike effect to the circuit court of tho I'liiteil Mates, for California, and said circuit court shall proceed lo fully determine the mailer. And be it further enacted, Tint it shall In Ihe duty of ihe surveyor general of California to cause all the private land clniuis tleslly con. tinned Ic be accural, ly surv. yed and plats there of to ho uiado, whenever reipiosted by the claim ants : l'rovided4 That each claimant rcipiesting n survey and plat shall first deposit in 1 tin district court or me uisinci wnnui yvim:u ion hoiu unted a sufficient sum of money to pay tho ex penses of such survey and plat, and of the pub lication required by tho first section of this act. Whenever tho survey and plat requested shall have been completed and forwarded to tho com missioner of the general land-oflico, as required by this oct, the district court may direct the ap plication of tbo money deposited, or so much thereof as may bo necessary, to tho payment of the expenses of said survey and publication. Sec. 7. And be it further enacted, That it shall be the duty of tho surveyor-general of Califorim, in milking surveys of the private land claims finally eonlirmcd, to follow tho docree of confirm ation as closoly aa practicable whenever such do crco designates the specific boundaries of tbo claim. Hut when such decree designates only tlio out homidarics within which tbo quantity con firmed is to bo takon, the location of such ijuanti ty shall be msda, as near as practicable, in one tract and in a compact form. And if the diame ter of the land, or intervening grnnts, be such as to render the location impracticable iu one tract, then each separate location shall bo made, as near as practicable, in n compact form. And it shall bo the duty .of tlio commissioner of the general laud-onico to require a substantial compliance with tlio directions of this section before approv ing; any surven and nlat forwarded to him, Sec. n. Jla it enacted bv the Seuato and I lento of Hop rcscntalivos of tho United Ktatos of America in Coiigaess nsiembled, That it shall and may bo Inwlul for the commissioner of tbo general land oflicu to causo to be sold, after public notice, the tract described ns lot numbered ono, in township ninety-five north, of range three west of the lifth principal meridian, in the State of luwa, situated in what Is known as the Fort Crawford military reservation, subject to such minimum price per acre ns the snid commissioner may establish as lair and reasonable, not less than two dollars anil fifty cents per acroj and in tho event of said lot not being disposed ol at public solo, tho commis sioner is hereby authorized to roolfer the sumo at public sale, or after the second offering to dispose of said lot at such minimum ns he may establish , and for the sale so made a patent shall unions in ordinary cases.
