Herman’s lawyer, Anne Fos- ter, ¿ led a motion for an amend- ed complaint earlier this month asking to add Raichl as a defen- dant. Downs said the alleged ob- scenity by Hunsinger has no established link with her alleged whistleblowing against the P ort. “Likewise, here the alleged comment was made 10 months after plaintiff was discharged and approximately 14 months after plaintiff allegedly engaged in protected activity,” Downs’ response said. Foster’s motion also asked to add a third claim of post-em- ployment retaliation, alleging Commissioner Bill Hunsinger yelled “you’re a piece of s---“ to Herman last month in down- town Astoria. The new claim of post-em- ployment retaliation comes along with claims by Herman of whistleblower retaliation, aiding and abetting in whistleblower retaliation, releasing the name of a whistleblower, disability discrimination, injured worker discrimination, breach of con- tract, defamation of character and two claims of post-employ- ment retaliation. Barbara Nelson Walters passed peacefully on Oct. 9, 2015, at Redmond, Oregon, Medical Center, after her chronic obstructive pulmo- nary disease could no longer be managed. Barbara was born in Astoria, Oregon, to Al- fred and Martha Nelson, on June 21, 1952. She attended Lewis and Clark Consolidated, then went on to Astoria High School class of 1970. She enjoyed spending her time outside in her garden, woodworking, doing hand crafts, art projects and reading. Barb was ¿ ercely inde- pendent, had a quick wit and loved a good joke. She also was a great cook and made the world’s best salsa, with peppers and tomatoes from her garden. When asked what she would like for Christmas or a birthday, Barb would always choose to receive a power tool over jewelry, or anything else, for her many craft projects. Her heart was always with the animals, whether it be watching and feeding the wild birds in the yard or taking care of her dogs, cats, and the many other animals they had throughout the years. Barb loved family and friends, and even when health concerns limited her ability to travel, she always kept in touch. She is survived by her husband of 29 years, Michael Walters of Madras, Oregon; stepson Spenser Walters, wife Karrie, with grandsons Conner and Hudson; stepdaughter Stephanie Ross, husband Bob, and granddaughter Audry Anna; brother Ken Nelson of Astoria, Oregon; sister Deb Nelson of Casa Grande, Arizo- na; eight nieces and nephews; 18 grandnieces and nephews; and many cousins and friends. Her older brother Alfred Nelson passed in 2013. In honor of her great love of animals, if you like, in lieu of À owers, please donate to High Desert Wildlife Rescue and Rehabilitation, http://highdesertwildlife.com. Just indicate it is in loving memory of Barbara Nelson Walters. High Desert Wildlife is a registered 501(c)3 nonpro¿ t organization.
