That said Portland Rail way Light and Power Company, its successors and assigns, shall ereot, maintain and use such poles, wires, cables, ducts, appliances aud appara tus so as not to interlere with the free and unobstructed use of suid streets or roads, tor travel, aud all such pjles shall be placed aud maintained iu ac cordance with and pursuant to the provisions of Ordiuanoe No. 205 of Or egon City, entitled! "An ordinance to provide for the erectiou, care or re moval of telephone, teleragph aud electrio wires and poles. Passed November 17thjlt)97. Approved Nov ember 19tl', 189i, " as now amended or as the same may be hereufter amend ed. Section 3. That all poles, wires, cables, appliances and apparatus, heretofore and now erected and -iu uso by said Portland Railway Light and Power Company, on that part, of Main street north of Twelfth street, of said city, aud used for the trans mission of electricity to points with out the corporate limits of said Ore gon City, and tho erection thereof are hereby approved, ratified and arfliined, and, in all respects, shall be, and be deemed to be covered and within tho franchise and rights herein granted, as though erected or used uuder such franchise and rights herein given or granted or any such franchise or rights Herein contained. Section 4. Whenever it shall be come necessary in the reotion, main tenance, use or removal of such poles, wires, cables, ducts, appliances and apparatus for the said Portland Rail way Light and Power Company, its successors or assigns, to dig into or in any munuer interfere with any street, alley, way, publio park or. pnblio grouud of said city, said Portland Railway Light and Power Company, its successors and assigns, shall, with out delay, put suoh street, alley, way, public park or publio ground in as good oondition as it was before it wsb broken up, dug up, or destroyed, and shall remove all surplus sand, earth, rubbish or other material caused by such erection, maintenance or removal b y said Portland Railway Light and Power Company, its successors or as signs. The surfaoe of no street shall be dug into or in any manner opened without the permission of the con noil of Oregon Oity, cr a duly authorized committee thereof, first in writing ob tained. Section 5. Said Portland Railway Light aud Power Company, its suc cessors aud assigns, in consideration of the franohise, rights and privileges grunted by this ordinance, and as compensation therefor, snail within thirty days from the date ot the pas sage of this ordinance, enter into a written agreement with Oregon City, granting to Oregon City an extension of term (with all its terms and con ditions) of a certain indenture ot lease made and entered into on theith day of April, 1801, by and between the Willamette Transportation and Locks Cjmpuuy, a corporation, party of the first part thereto, . and said Oregon City ,party of thojseoond part thereto, and which is reoorded in the Reoords of Clackamas County, Oregon in Book of Deeds No. 47 at page 99 et seq thereof and which agreement shall provide that said lsase dated April 6, 1891, shall be extended to and shall terminate at the expiration of the term of the francise granted by this ordi nance to said Portand Railway Light and Power Company. Provided that snob agreement may provide for the relinquishment by Oregon City of the lands now oocupied by said Oregon City under said indenture of lease dated April 6, 1891, and may also po vide for the use of the water for power purposes leased by said inden ture of lease at other places and upon other land than li tut ocoupied by said Oregon City under said lease dated April 6. 1891. And the failure of said Portland Railway Light and Power Company to execute an agreement ex tending the term of said indenture of lease, as aforesaid, within thirty days from the date of the passage of this ordinance shall render this ordinanoa null aud void and all the rights here in granted shall remain, in and revert to said Oregon City. Section. 6 The failure of the said Portland Railway Light and Power Company, its successors or assigns, to at all times conform to eaoh and all the provisions of this ordinance and the provisions of said indenture of lease herein mentioned, or as said in denture of lease may be extended or mortified, or to oomply with all rea sonable rules and regualtions of Ore gon City as hereinbefore provided, shall operate as a forfeiture of all the rights, franchises aud privileges granted by this ordinance. Sootion 7. All rights, powers and privileges horeby granted shall termi nate at the expiration of twenty-five years from the date of aooeptance of this franchise and all of the provis ions of this ordinance shall inure to, apply to and bind the sucessors and assigns of said Portland Railway Light and Power Compai y. Section 8 The Portland Railway LiRht and"" Power Company shall, within thirty days from and after the passage of this ordinance, file with the recorder of Oregon City, its writ ten acceptance thereof. Sootion 9. This ordinance shall be oorae effective and be in full force from aud after its acceptance by said Portland Railway Light and Power Company, its successors or assigns. Provided, however, that failure ot said Portland Railway Light and Power Company to file its written ac ceptance as aforesaid and also to exe cute the said agreement extending the term of indenture of lease mentioned in Seotion Five of this ordinance, shall render this-ordinance void and the same shall not be in force oi effect.
