TAXPAYERS BLED FOR FAIR Constitution 1 Is Only, a Paper Barrier. DECISION ONLY A FARCE Legislature Ma Compel Peo pie to Pay Debt Incurred By Fair Corporation. To the voters aud taxpayers of the state, of Oregon aud their represen tatives, the Oregon Legislature : We are informed through the publio press, common rumor and other, and especially interested parties, that ten years ago the state board of Commis sioners, conusisting of the Governor, secretary of State and State Trias Brer, for the sale of school and uni versity lands and for the investment of the funds arising therefrom' loaned ten thousand dollars of the common school fund to the state fair, a corporation, and took a mortgage upon the fair grounds to secure the payment uu the same with interest. i No interest lias been paid on this loan for all these years ; it should have been paid annually. Reoently the state fair company has been called into court, beiore Judge Galloway, who rendered a decision in favor of the state, for the sum of nineteen thousand dollars, more or less. This action of the court became necessary to prevent the mortgage from lapsing or oeasing to ant as security at the expiration of ten years. No defense was made by this debtor; for the very good reason fiat there was none at baud, and so judgment was taken by default. No further action will he taken in the case, says the attorney general, till the Legislature meets; 'and then if something is not done by the Legis lature to pay this debt, he will pro ceed to sell the fair grounds property. What is expected, or hoped for from the Legislature is more than intimated, it is plainly stated they are to do something and that something to is pay the debt. How do Legislatures pay debts in their official capaoity? It is answered by appropriating your, the taxpayers' money. Here I will insert Section 8 of Article eleven of the Constitution of the State of Oregon : "The state shall never assume the debt of any county, town or other incorporation whatever, unless such debts shallJhave been created to repel invasion, suppress insurrection or de fend the state in war." The state fair association is the whatever incorporation. Of course Section 8, Art. 11 bars the Legisla ture from any attempt at relief of this corporation or power to tax the loan ers for their own money loaned and interest on the same ; but it is only a paper barrier, hitherto found too often powerless to restrain the Legis lature from scoopiug the state treas ury, in the in ierest of themselves or friends. But for the frequent and wickedly wrongful use of the peoples' money, made by the Legislature, this reference to the Legislature of , the nineteen thousand dollar claim, from the fair company, already passed into a judgment by the court in favor of the school fund, could excite no alarm, because of its very absurdity. Who shall pay this debt? The court says the borrowers, but the fair company have taken an appeal to the Legislature and named the judgment expected, that is that the tax payers shall pay this $19,00O cancel the mortgage and leave the company free to come to the school board for a larger loan and presumably to be paid in the same way and secured on the same property. Never was a more just deoision rendered by the court. If this decision of Judge Galloway can be set aside by the Legislature, then all decisions of courts can be set aside or abrogated, in the same way. What the Legislature may do, or neglect to do, in the interest of wealthy associations or corporations A ia not written in books of law or his tory, but depends upon other induce ments; there the danger rests and past experience warns. More than twenty years ago the price of school lands should have been fixed by appraisement at prices rang ing perhaps from five or more to fifty dollars per acre ; this would, doubt less, have produced a fund, ere this, of eight or ten millions of dollars, instead of two, perhaps none in the school fund ; but speculators had to be served, hence this unpardonable sacrifice of the school interest Now and from time to time, having nearly exhausted the source of the school fund, they attack the ttata treasury direotly, borrow the school funds, seek to outlaw the debt and when pre vented by the court from this out lawry, appeal to you, the taxpayers, through the Legislature, to pay their debt. The Legislature in the six years last passed January 1st next, has already appropriated the sum of ninety seven thousand, six hundred twenty eight and forty four hundreth dollars, ($97,628.44) to pay premiums for the society ; and yet not a oitizen of the state, unlesshe.has paid the re quired gate money, can enter these fair grounds. All the money takeiiin (goes to the fair associationn while all the money paid out, comes from you, the tax payers. Again it is rumored that the Salem fair company, alone', hope or an appropriation of $20,000 and this perhaps in addition to the trans fer, by the Legislature, of Judge Gal loway decision to a judgment against the taxpayers. It may be remarked here that two fair companies in East ern Oregon receive appropriations of $1500 each annnaly. And two in Southern Oregon $700, and JJ1800 re spectively, are paid annually, with more to be organized, I fear. A rural fair, as -1 understand them, are organized for pleasure and profit, by the associations, principally the latter. Let those who receive all the profits pay all the expenses. .The state should be unhitched from these associations and leave those that dance to pay f.he fiddler. These fairs, or even jthe Salem fair alone, cost the state annually more than the entire income, from the irreducible school fund, derived from one eighteenth part of all the land in Oregon. What a farce is legislation and the Legislature and others, what criminals. Of course I speak of the past Legislature. Taxpayers, paste this article upon your pantry door, read it night and morning, aud when tliis source of robbery shall equil one third of all the necessary expenses of the state, remember I forewarned you of your doom. Dimick, who has been elected reoorder of Oregon City, is a native son of Marion county and is 25 years of age. He is a son of G. W. Dimick, a well known citizen of Hubbard. Mr. Dim ick attended the public schools of Hubbard and graduated from Pa ciflo University at Forest Grove i in 1902. He read law in Forest Grove and in Oregon City with his cousin, Hon. G. B. The funeral of Mrs. Mary Toner, the wife of John O. Toner, was held Tuesday morning and the interment was in Mountain View cemetery. The body arrived on the overland train from McMinnville, where Mrs. Toner died Sunday. The deceased was a former resident of Oregon City and was well known here by the old residents.
