RECALL INOPERATIVE
Attorney-General Gives Opinion
Act
Is Not Self-Executing.
Salem. That the recall amendment
tto the Oregon constitution Is Inopera
tive and ineffective because it is not
self-executing is the final opinion
of Attorney -General Crawford,
handed down for R. H. Howell,
county clerk of Lincoln county, who
requested Information on the point be
cause of a move on foot in that coun
ty to circulate recall petitions against
ithe county Judge and one of the coun
ity commissioners.
Once before this point had been
passed on by the office of the attorney-general
when an assistant offered
Jn opinion that the amendment was
self executing. The opinion Is sweep
ing In its nature and declares that the
recall provision Is not self-executing
and that further lcgslative enact
ment is required before the recall
intendment will become effective.
Port Win Decision.
Marshfleld. Judge John S. Coke, of
the circuit court, has given a decision
in the injunction case regarding the
formation of the Port of Port Orford
In Curry county, deciding in favor of
the port, thus dissolving the tempo
rary Injunction. It will now be pos
sible for the canvass of the Tote on
the port question to be made by the
county officials of Curry county and
the port proposition declared carried.
Estate to Be Cut Up.
Marshfleld The estate of the late
R. D. Hume, recently purchased by
Portland men, has passed into the
lands of the new owners and their
representative. V. H. Leach, has
taken charge of the property. It is
Vhe intention to establish a settie
aawnt and sell much of the land in
mall tracts to homeseekers.

Pacific Great Western Work to Begin
at Once, Say Chief Engineer.
Eugene. The McArthur-Perka Com
pany, Limited, of Chicago, was
-awarded the contract for construction
of 11 miles of railway between Eu-
Xene and the coast, to be known as

Rock Roads Planned.
Hillsboro. Several road districts in
this county are publishing notices of
pecial road meetings to levy taxes
for rock roads. This will be in addition
o the levy to be made by the county
commissioners' court, which has an
nounced its intention to levy to the
full limit and turn half of the funds
over lo th road districts for spedal
work..
Anderson Jury Disagree.
Canyon City.-The jury in the case
of V.eorge W. Anderson, who shot and
killed Attorney tJeorjre It.irm , in this
city last June and was indicted lor
Jiiunier in the second degree by the

Astoria authorities have Inaugurat
ed a campaign to put a stop to th
telling of tobacco and cigarette to
minora.
A demonstration road quarter of a

The first carload of grain for Imme
diate railroad shipment that has ever
been sold In Goose Lak Valley was
disposed of by B. Keller, of New Pine
Creek, to Reno parties.
The Baker Commercial Club will
try to raise a fund for a 110,000 ar
mory. Centralisation In Portland of the
government of the Oregon-Washington
Railroad ft Navigation Company will
be completed December 15, at which
time all the company's lines will be
placed under the supervision of the
Portland official.
A referendum having for its object
the revoking of a franchise granted
the Prineville ft Eastern Railway on
the streets ot Prineville will be con
sidered by the voters Monday. Decem
ber IS, the date of the regular annual
city election.
The first bird and game refuge to
be created under the new game laws
is on the ban' s of the Willamette
slough, opposite Sauvles' Island. It
has been created by Hannah Hoi
brook and M. C. llolbrook. and Is
2S5 acres in extent.
The Oreson Development League
has asked the Marshfleld Chamber of
Commerce to Induce the farmer to
raise peas for seed. The county grows
One peas, and it Is suggested that the
farmers could mk big money bv
growing peas to furnish seed.
In one of the swiftest trials in the
history of Polk county, John Magers,
a negro, who on August 14. while ft'
paroled convict, attacked Miss Beulah I
Walton in West Salem and shortly !
afterward attacked Mrs. M-. Jorgenson '
on Eola road, was sentenced to the '
penitentiary. j
It was booster day In Eugene Fri-1
day. delegations from the commercial j
organisations ot Portland. Salem. Al-i
bany, Corvallis. McMinnville. Rose
burg and all the valley towns gather
ing to help the Eugene Commercial
Club dedicate the pleasant new quar
ters. Into which It has Just moved.
With the appointment of a special
legislative committee to go before the
legislature and see that the dairymen
receive consideration, and with the
passing of important resolutions hav
ing to do with the advancement of
the industry in Oregon, the annual
convention of the State Dairymen's
Associaticn closed at Portland to
meet next year in Albauy.

practically assured that company that
it can take over the Paisley project
of 12 000 acres, the contract for
which, to the Portland Irrigation Com
pany, as cancelled some time ago.
The report of the Oregon & Wash
ington Railroad received by the
sta'e railroad commission showed op
