In sustaining the demurrer" of S.
Foster Kelly, a wealthy Seattle
banker, recently prominent In the
matrimonial troubles of Albert J.
Henry and Iva May Henry, his di
vorced wife, to a suit for $100,000
damages for seduction. Judge Sturte-
vant, of San Francisco, practically
threw the suit out of court, declaring
the statute of limitations fcr the of
fense one year favored Kelly.
The Desert Land Board
Members of the Peeert Land
Board and State Land Board left
the night of July 4 for a two
week's inspection trip of the irri
gation projects id southern and
Central Oregon.
The party included Governor
eat, State Treasurer Kay, At
torney-General Crawford and
State Engineer John H. Lewis.
James R. Linn, a member of the
State Parole Board, probably will
accompany the party. It is prob
ably Secretary Olcott will be un
able to attend because so far there
has been no appointment of a
chief clerk and he is conducting
the affairs of the office alone.
The first stop will be at Klamnth
Falls, from which place they will
go by automobile to Lakeview,
where the Governor and members
of the State Land Board will take
up questions in connection with
toe arner Valley Stock Com
pany case. From there the entire
party will go in to Warner Valley,
20 mile3 west of Lakeview, to ex
amine a Carey Act project of 130,-
000 acres, which has been more or
less actively under way for some
time. Returning to Lakeview the
party will go north to Paisley,
where considerable difficulty has
been encountered in sfcuring the
reclamation of a 12,000-acre pro
ject under the Carey Act.
From there they will go to La
Pine at the head of the Deschutes
Itiver to examine progress on a
31,000-acre project of the Deschutes
Land Company, where the party
expects to find steam shovels at
work and general activity appar
ent. From this point they will go to
Bend and over the work of the
Central Oregon Development Com
pany, which has taken over the
old Deschutes Irrigation & Power
Company. The Desert Land
Board has just approved the sale
of 63 tracts of land in that section,
aggregating 34G5 acres, the liens
on which amount to .f 88, 182. It is
probably the party will return di
rectly to Salem from Bend, com
ing over the new railroad. Later
in the year the boards will prob
ably cover all of the projects in
Eastern Oregon.

Cleveland Druggist Gets Tobacco Case
Decision Brought to Bear.
Cleveland, O. By appealing to the
Department of Justice, Clifton M.
Rawlins, druggist, has succeeded in
having the recent decision of the U.
S. Supreme Court in the tobacco case
brought to bear on the United Cigar
Stores Company, and the opening of
two new stores by that concern bore
is abandoned. This Is snld to be the
first time the decision has been put
into effect.
Mr. KawIIns pointed out to Attor
ney General Wickersham that the de
cision stated that the American To
bacco Company, or Its subsidiaries,
were not to enlarge tnelr business.
5000 Logs Lost at Sea.
San Francisco. The steamer Fran
cis H. LeRgett, upon arriving from
Astoria, reported that the huge log
raft, containing 6000 logs, which she
had left the Columbia River with in
tow had broken up in heavy weather
on the trip down.
